-to be clear I don't write the GOAL Post Joe Waldron does this- GOAL Post 2019-15 Legislative Update from Olympia 19 April 2019 RALLY FOR YOUR RIGHTS BILLS PASS, ONE DIES CONCURRENCE VOTES ONE MORE WEEK SPECIAL SESSION LOOMS BUMP STOCK WARNING LATE DISSEMINATION ON THE ROAD A pro-gun “Rally for your Rights” will be held on the Capitol Campus on Saturday, 27 APRIL at12 noon. A little late in the session, but still an opportunity to show your support. It IS on a Saturday. Try to make it and show them the gun lobby is not a paper tiger.. Several bills passed by the end of the second chamber cut-off on Wednesday evening. House Bills 1465 (handgun delivery), 1739 (undetectable/untraceable firearms), 1786 (firearms/protective orders) and 1934 (military online/mail CPL renewal) all passed out of the Senate. HB 1934 was rushed off to Governor Inslee for his signature. The remainder await a concurrence vote or conference committee action because they were amended in the second chamber. It’s not over yet! Senate Bill 5782 (assisted-opening knives) died on the House floor without a vote. What a surprise! The Senate has concurred in House amendments to HBs 5027 (Extreme risk protection orders, under 18), 5181 (firearms/mental health) and 5205 (firearms/incompetence for trial). All three are on their way to the governor. There is one week left for the House and Senate to review difference between passed versions of the bills and kick them to the governor – or they die for the session. That doesn’t mean they won’t be back next year… or in a week or two in a special session. The regular legislative session ends at midnight on Sunday, 28 April.It appears the Democrats who control the House and the Democrats who control the Senate can’t agree on how much to raise taxes for the biennium. This means it is likely we will enter one or more 30-day special sessions until they get it sorted out. Apparently there is no honor among thieves. As the saying goes, neither you life nor your wallet are safe as long as the legislature is in session. An individual with what appears to be a fictitious name, “Yati Arguna,” has sent a Public Records Act request to the State Patrol asking for the names and addresses of everyone who turned in a bump stock for cash compensation. That’s about 1,000 individuals. Unless a judge blocks the release (reasonable as a public safety measure), state law requires the names be released. Who is behind this and where or how the information will be used remains to be seen. Should one assume that anyone who turned in a bump stock has a Modern Sporting Rifle in their home? I will likely hold off on posting next week’s GOAL Post until Sunday night (when I’ll be flying back from the NRA annual meeting in Indianapolis) or Monday, when we know for sure what passed and what died. Recognize that in the event of a special session ALL BILLS from the previous regular session come alive again and may be considered, voted on, and passed. The week after I’m off for Europe – allegedly. I’ll be flying on an airline family pass, so it’s “space available” and any movement will depend on empty seats available AND my (very low) seniority number. I sent my wife to visit family ten days ago, and now I have to go bring her back. This living alone (not entirely alone, I have a Lab, but she doesn’t talk) isn’t all it’s cracked up to be when you’ve had a wife to spoil you for 50+ years now! Should a special session be called, it is my intention to continue GOAL Post… all dependent on information being available to me wherever I am. Historically they don’t use special sessions to drag back gun bills, so unless there’s a major gun incident, we should be safe. 2019-1 Legislative Update from Olympia 11 January 2019 RALLY IN OLY FRIDAY 18 JANUARY LEGISLATURE CONVENES MONDAY, 14 JANUARY (105 DAY SESSION) DEMOCRATS IN COMPLETE CONTROL BILL INFORMATION NEW GUN BILLS PRE-FILED LEGISLATIVE TUTORIAL LEGISLATIVE CALENDAR NEXT WEEK’S HEARING SCHEDULE LEGISLATOR CONTACT INFORMATION HOW TO TESTIFY AT A PUBLIC HEARING PUBLIC HEARING VERSUS EXECUTIVE SESSION (This will be a long GOAL Post as I have to describe the environment and the processes involved for new readers. Future issues will be shorter. Also keep in mind that GOAL Post focuses on gun law only, we do not cover hunting issues. The Hunters Heritage Council does that well. I normally post GP on Friday evenings to summarize that week’s activities and provide a forecast for the next. I’ll be on the road for the next two weeks, so some issues might be late – or early.) First business first: a gun rights rally will be held on the Capitol Campus next Friday, January 18th,. The rally will be held on the north steps of the Legislative Building and will begin at 9 a.m., ending at 12 noon. The rally is sponsored by the Gun Rights Coalition. (Yes, it’s a Friday, and unlike the people bussed in to attend many liberal rallies, gunnies have to work. Are your gun rights worth a day off?) After the formal presentation, attendees are encouraged to familiarize themselves with the campus layout (the Capitol, or “legislative” building where floor sessions are conducted, as well as the John L. O’Brien House Office Building, the John A. Cherberg Senate Office Building, and the Irv Newhouse Senate Office Building. This is a great opportunity to locate your two representatives’ and one senator’s office and introduce yourself to their legislative aides. Hopefully over the coming session they’ll become familiar with your name and maybe even your face! The legislature convenes on Monday, January 14th, for its “long” (105 day) session. This is the start of the 66th biennium, which will run through next year (2020). The primary focus of the long session is supposed to be preparation and passage of a two-year budget, but worry not – they’ll find plenty of time for gun control. If their work is not completed, they can be called back by the governor for any number of 30-day special sessions, as happened two years ago with THREE back-to-back special sessions. I’m not going to point fingers, as it’s not clear who to point fingers at: overly enthusiastic liberal voters or discouraged conservatives. Either way, the Democrats now have solid control of BOTH the Senate and the House. We still have a few friendly Democrats in the Senate and the House, but not enough to overcome the liberal majority. The new Senate has 28 Democrats, 21 Republicans. The House will have 57 Democrats to 41 Republicans. This means not only will every committee chair be Democrat (the committee chair controls which bills will receive a hearing), but most committees will have a two-seat Democrat majority. In the first session of the biennium, all new bills must be filed. You may see familiar subjects brought back, but the bill numbers will be new. Bills stay alive for the entire two-year biennium. Text of newly filed bills can be found at https://app.leg.wa.gov/billinfo/ Also on the bill information page are links to “New Introductions” (daily), and at the bottom, “Bills by topic” and “Bill Tracking.” Pre-filing of bills for the new legislature begins in December, and there are already a handful of gun-related bills in the hopper. A complete list of bills under consideration is included below in the “BILL STATUS” section. It also contains the bill’s prime sponsor, the current status of the bill (committee location) and the GOAL position on the bill. Committee abbreviations are provided at the bottom of that section. As this is written there are currently 12 gun bills available for consideration/action. For those new to legislative affairs, here’s how the process works: When a bill is filed in the House or Senate (or both, simultaneously, called “companion bills”) it is assigned to a policy committee. Most gun-related bills go to the Senate Law & Justice Committee in the Senate. In the House it’s a little more complicated, as it may be sent to House Civil Rights & Judiciary or House Public Safety (most will go to CR&J). Public hearings may be held, after which the bill may (or may not) be voted out of committee. If the bill has a fiscal impact (usually an expenditure of more than $50,000), it must then go to Senate Ways & Means or one of a couple of House fiscal committees. The bill then goes to the Senate or House Rules Committee, where it must be voted on to pass out to the floor for a full vote. After a bill passes the Senate or House, it then goes over to the opposite chamber (House or Senate), where the whole process starts over again. If the bill passes the second chamber in the same form it passed the first, it goes to the governor for signature (or veto or partial veto). If changes are made in the second chamber, it goes back to the first for concurrence. It may also go to a conference committee from both chambers to resolve differences. The final version must pass both chambers. The bill then goes to the Governor, who may sign it into law, veto (kill) the bill, or sign a partial veto (killing just selected section(s) of the bill). The governor may also allow a bill to become law without his signature. Most signed bills take effect on 1 July, although bills with an “emergency clause” (considered immediately necessary for public safety) take effect upon signature by the governor. One of the first items of business in each session is the adoption of the session calendar, identifying dates by which bills must clear various hurdles. A bill that fails to clear the policy committee or chamber floor by the designated date is generally considered dead for the year, although they may be “resurrected” by parliamentary procedure. I’ll post the cut-off dates for the 2018 session in the next issue of GOAL Post. At this time, public hearings are scheduled for HB 1010 (disposal of forfeited firearm) on Tuesday, January 15th, at 10 a.m. in the House Civil Rights and Judiciary Committee, and for SBs 5072 (extreme risk protection orders, under 18) and 5027 (extreme risk protection orders, under 18) on Thursday, 17 January at 10 a.m. in the Senate Law & Justice Committee. But all votes on bills taken by a committee are conducted in what are called “executive sessions.” They are typically part of a public session, with a few minutes set aside to vote on bills previously heard by the committee. Public testimony is just that, open to the public for comment. On the other hand, no public input is allowed during executive session. You are welcome to sit there, and to count votes, but silence from the public is the rule. Just FYI for those of you who have not attended legislative public meetings before. And you won’t find the House Judiciary Committee listed any more. It’s now the House Civil Rights and Judiciary Committee. Legislative committee schedule are posted on the legislative web site on Wednesday evenings. It is not on the schedule yet, but I have been informed that the Senate Law & Justice Committee will conduct a public hearing on Monday, 15 January (Martin Luther King Day), at 1000, in Senate Hearing Room 4 (John A Cherberg Building). Bills reportedly under consideration include SBs 5992 (“trigger devices”) and 6049 (“high capacity magazine’ ban). A strong turnout is helpful. As is carpooling, given parking limitations on the Capitol Campus. (Who knows how many busloads of people will show up from Seattle supporting the gun control bills on this holiday?) Anyone yet have a GOOD, POLITE but FIRM letter written opposing all the bullshit that others can use as a starting point?
Talk first about the State Constitution, then about how only law abiding citizens would likely ever comply, statistics about how safe society and schools REALLY are, lack of effectiveness of ALL previous mag size limits and "assault weapons" bans, etc.? This is what I wrote last year after the Feb 14 murders in Parkland: Tonight I was upset to find that the legislature is abandoning its own rules and attempting to “pull a fast one” by passing gun control measures seemingly in in the middle of the night. It is shameful that the Legislators making this gambit feel the citizens of our state should have laws passed in the late night hours, without due diligence and citizen feedback. This is especially disturbing when the legislation in question strives to attack a vital civil liberty. In light of last week’s horrific school shooting in Florida, the emotional demand to “do something, do anything” may sound good, but in fact leads down a path of pointless or even harmful restrictions on the RIGHTS of Washingtonians while likely being completely ineffective in making our schools and children safer. Unlike those in the mainstream media and the emotion-laden but fact-free people they plant in front of their cameras, I know that there is no simple black-and-white solution to the problem of violence in schools. I know that the GUN is not responsible for the murder of 17 high schoolers. Only the shooter is to blame. Anyone who calls me, the NRA or other gun owners “complicit” in the murder of innocents is showing how thin is their own understanding of the world we live in. A focus on mental health, school security, eliminating the fallacy of “gun free zones” and eliminating the glorification of past mass murderers will all contribute far more to our security than blaming guns and law abiding citizens. Rifles and the sub-set of “Assault Weapons” account for a TINY percentage of all homicides yet are the target of attempts to reduce “gun deaths”? SB 6620 is NOT the right “something, anything”. The failed SB 5444 was bad legislation before February 14 and it is still bad now, shamefully tacked on to a possibly useful school safety provision in SB 6620. The gun control provisions are poorly written, including making simple GUN PARTS “Semiautomatic rifle or shotgun with tactical features” in their own right and subject to waiting periods and restrictions. How do you plan to “register” a plastic pistol grip as a “Semiautomatic rifle or shotgun with tactical features” ? You better have a plan because as written, the State Patrol and other Agencies will have to handle background checks on EVERY $10 AR-14 PISTOL GRIP SOLD IN THE STATE. It also defines “Semiautomatic rifle or shotgun with tactical features” based purely on cosmetic features that that some people apparently find “evil” or “undesirable”. Just say NO! And this is what I had sent earlier in the year to my legislator: I am writing today to you and to all of my Washington State legislators to urge you to OPPOSE any and all anti-gun legislation being considered in our great State. There are more than enough regulations on the books to handle any criminal misuse of firearms. Assault, murder and intimidation are already illegal. New laws will only be followed by those of us who already follow the law. Firearms and standard-capacity magazines (yes STANDARD capacity, as 15 to 30 rounds or more IS THE STANDARD for the most commonly owned firearms in the U.S.) are inanimate objects and are NOT the cause of crime or disgusting acts of violence--people are. Further, the so-call "assault weapon" is used in less than 1% of violent crime committed with a firearm. If your goal really is to reduce "gun violence" (an absurd term), look first to reducing the most common cause of death by firearm--suicide. Rob |

Saw this posted in the comments about the proposed bullshit in Oregon...
Let's do some CDC and FBI math on gun deaths: Therewere 32,000 gun deaths in 2016. 60%were suicides-19,200 3% were accidents-960 4% were justified-1,280 33% were homicides-10,560 80% of those homicides were gang related-8,448 That leaves 1,712 people in a country with a population of 312 million. You have a 0.00010256410256% chance of death by firearm. If you are not part of a gang, don't commit a crime or plan to commit suicide, you have a 0.0000085614102564% chance of death by firearm. The CDC also noted that 4,400 kids committed suicide last year due to bullying. Guns are not the problem. Someone is lying in order to get elected. So far, 11 teenagers a day die from texting and driving. 50,000 deaths per year from heroin overdoses. We have laws against that, so how’s that working our for you? If the numbers are correct, that looks like a pretty good argument for "what problem?" Rob |

(SBs 5027, 5061, 5062, and 5072) Washington Constitution Article I, Section 24 "The right of the individual citizen to bear arms in defense of himself, or the state, shall not be IMPAIRED, but nothing in this section shall be construed as authorizing individuals or corporations to organize, maintain or employ an armed body of men." Please stand with law-abiding citizens in support of the Second Amendment and oppose this misguided gun control agenda. Punishing law-abiding gun owners for the acts of criminals is flat out wrong and won’t solve any of the mental health and behavioral problems that we need to do something about. Criminals, by definition, DO NOT OBEY LAWS. The fact is, there are no crises facing us that will be solved or even improved by ANY of the proposed measures. No criminal, or person with evil in his/her heart, would be hindered in any way by these proposals should they become law. A useless and ineffective law is an unjust law. The Federal 1994 “assault weapon” ban was ENTIRELY ineffective in reducing crime and was properly allowed to expire. Magazine size limitations (I refuse to use the media’s term “high capacity” as most of the targeted magazine are STANDARD size at 15, 17, 20 and 30 rounds) have yet to save a life or prevent a crime. I recently heard an analogy that seems to capture this: Gun control is like trying to prevent drunk drivers from killing sober drivers by banning the sober drivers from driving. Statistically, the use of rifles, shotguns and even “assault weapons” (a term made up by the media and others with little understanding of firearms) account for a TINY FRACTION of all violent crime. Schools are the safest place for our children despite a few horrendous, highly publicized attacks. Suicide claims the lives of far more youth. The CDCrecently noted that 4,400 kids committed suicide last year due to bullying. Approximately 11 teenagers a day die from texting and driving. 50,000 people die each year from heroin overdoses. Seems clear to me that these issues are FAR MORE DESERVING of your attention, time and resources than restricting the rights of a law-abiding gun owners. Again, please oppose all of the gun control bills being brought before your committee. Thank you. |

Wow! As an old Olympia gun rally organizer (1990s/early 2000s), all I can say is that’s pretty piss poor performance. No wonder we’ve been getting our butts kicked. It’ll be interesting to see how many Mom’s Demand Action activists are there on Monday. For those new to political activism, the whole point in a rally is to flex your muscle. This one was a little more like Don Knotts than Charles Atlas or Arnold Schwarzenegger. When one long-time gun rights activist stopped to visit his Senator after the rally, he found the office area door locked and Senate Security told him no meeting without an appointment because there was a gun rally today. We (and they) are in serious trouble when elected officials fear their own constituents (like LtGov Habib earlier this week). How’s old Thomas Jefferson’s Tree of Liberty looking today? (They don’t hide from po-abortion activists, and there is a lot more blood on their hands.) It sounds like a minor thing, but I view it as very disturbing. For an elected official, OUR employee, to bar constituents “his bosses” because they MIGHT be exercising a fundamental constitutional right is bad. It shows us what they really think of us. With zero justification, no threat – they truly believe we are deplorable. The following cut-off dates are proposed for bills under consideration in the 2019 regular legislative session. As a general rule, if a bill fails to pass a hurdle, it is considered dead for the session. Several new gun bills have been filed this week. They include HB 1097, by Rep. Jim Walsh (R-19) that repeals confidentiality waivers citizens were required to sign when applying for firearm licenses, HB 1098, also by Rep. Walsh that repeals the penalties for unsafe storage of firearms contained in RCW 9.41.094 and 9.41.097, HB 1202, by Rep. Beth Doglio (D-22) mandating reporting of lost or stolen firearms and HB 1225, by Rep. Laurie Jinkins (D-27) that takes firearms away from those just accused in a domestic violence incident –take their guns first, go to court later. Totally ignoring the typical DV dynamic of “he said/she said” and it takes a jury to determine which one is lying.HB 1286, by Rep. Strom Peterson (D-21) bans transfer and sale of defined (1994 federal definitions PLU new additions) assault weapons and “large capacity magazines.” (more than 10 round capacity). Those in possession prior to the effective day may continue to possess. The bill contains several additional restrictions and measures. John Lovick (D-44), requires applicants show proof of training/proficiency when applying for a CPL. On the Senate side we have SB 5099 by Sen. Tim Sheldon (D-35) that expands opportunity for recreational shooting on some DNR-managed land, SB 5143, by Sen. Manka Dhingra (D-45) that authorizes seizure of firearms from individuals involved in domestic violence incidents even before conviction, SB 5150 by Sen. Lynda Wilson (R-17) that authorizes armed security officers for state colleges, SB 5172, by Sen. Phil Fortunato that requires legislators to show proof of having some form of firearms training before they can sponsor a gun bill of any kind, SB 5205, by Sen. Manka Dhingra, that prohibits those found incompetent to stand trial and who have a history of violent acts from possessing firearms. If you Google it, you will find that women are the aggressor in DV cases nearly or equally frequently as men. SB 5434, by Sen. Claire Wilson (D-30) prohibits firearms and most other defensive tools in all day care centers and amends RCW 9.41.300 to add public libraries and public parks to places where firearms are prohibited. The leftist disarmament agenda: impose hurdles like mandatory training (as a long time NRA-certified instructor I fully support all the training an individual can afford, but the state has no business mandating it – self defense is not rocket science). Then expand “gun free zones and prohibited places” to restrict where you can carry. Read the definition of “infringed” and “impaired” in your dictionary. More chipping away at Second Amendment and Article 1, Section 24 of the state constitution. Three public hearings on gun bills. On Monday, 21 January, the Senate Law & Justice Committee will take testimony on four gun bills: SBs 5061 (undetectable firearms), 5062 (high capacity magazines), 5143 (DV incident firearm seizure) and 5174 (training requirement for CPL). The hearing commences at 10 a.m. in Senate Hearing Room 4 in the John A. Cherberg Senate Office Building.The Senate Agriculture Committee will conduct a public hearing on SB 5099, recreational shooting on DNR land. The hearing will be conducted on Thursday, 24 January at 1:30 p.m. in Senate Hearing Room 3. On Tuesday, 22 January, the House Civil Rights & Judiciary Committee will take public testimony on HBs 1024 (prohibiting gun owner data base), 1068 (high capacity magazines), 1073 (undetectable firearms), 1203 (reporting lost/stolen guns) and 1225 (DV incidents). GOAL Post
2019-3 Legislative Update from Olympia 28 January 2019 Last week (and this week) are crazy ones for me. I was out of town all last week – and my laptop crashed, preventing me from transmitting GP 2019-2 by e-mail until Tuesday. I’m back on the road this week, hopefully without temperamental computers, this one for the annual meeting of the Florida Sport Shooting Assn, of which I am vice president. Hopefully no more travel… until the final week of the session (when my wife wants to visit family in Europe for the last week of the session AND the annual NRA convention and meetings go down in Phoenix! At that point it will be too late anyway!). HEARINGS ON TVWASHINGTON NEW GUN BILLS FILED ACTION ON BILLS PUBLIC HEARINGS SCHEDULED MY TRAVEL SCHEDULE If watching the hearings in Olympia didn’t bring the message home, in today’s world, feelings and emotions beat facts and logic every time. The one with the most emotional testimony wins. I’ve been watching that for 24 years. The link below goes to last Monday’s Senate Law & Justice hearing: Senate Law & Justice hearing, Monday, 21 January: https://www.tvw.org/watch/?eventID=2019011158 I know that everyone reading this message knows the difference between a democracy and a republic, but in case it slipped your mind… A democracy is mob rule: the issue or the side with the most votes wins. Five wolves and a lamb voting on what to have for lunch. A republic is governed by a constitution which places limits on the democracy, (i.e. the lamb has an AR-15.) There are certain things where a simple democratic majority does NOT win. Theoretically the Second Amendment and Article 1, Section 24 of the state constitution guarantees the right to keep and bear arms, no matter what the democratic legislature votes. “Shall not be infringed.” (2A) “Shall not be impaired.” (1/24) That seems pretty clear, but many legislators are constitutionally illiterate. Read the dictionary definitions of “infringed” and “impaired.” That’s where the Supreme Court (federal and state) step in to ensure the constitution is followed. Sometimes. Is a 10-round magazine limit an infringement? An impairment? Try SEVEN rounds under current New York State law. Or FIVE, as is being proposed in Oregon right now. (I can see the look on all you smug revolver shooters’ faces.) Only four new gun bills were filed last week, all in the House. HB 1319, by Rep. Sharon Wylie (D-49), prohibits firearms at all public meetings of a city, county or other governing body. HB 1346 by Rep. Gerry Pollett (D-46), would ban the transfer of any lead-based or lead core ammunition to anyone under the age of 21 – there go your junior rifle programs (all to prevent lead contamination and protect the chilluns, of course). HB 1374 by Rep. Macri (D-43), repeals state preemption in its entirety.—stand by for every city to enact a multitude of gun laws including restrictions on where and when you can carry firearms – with or without a CPL. The cities have been fighting this since it passed 30+ years ago. Good luck making it from one corner of the state to another without violating SOMEONE’s gun law. And HB 1381 BY Rep. Mike Pellicciotti (D-3), which prohibits the use of unmanned aerial vehicles (UAVs – drones) to deliver contraband to anyone in lawful detention – from guns to drugs to cellphones to anything they declare as contraband. Several bills passed out of their original policy committee, generally with amended versions (substitutes) offered, and now sit in their respective Rules committees, awaiting a pull to the chamber floor for a full floor vote. These include: HB 1010 (destruction of forfeited firearms), SB 5027 (extreme risk protection orders – substitute passed), SB 5061 (undetectable firearms – substitute passed), SB 5062 (high capacity magazine ban – substitute passed), SB 5143 (firearm seizure in DV cases – substitute passed) and SB 5174 (CPL training requirement – substitute passed that allows NRA or similar courses to qualify). These bills all now await a floor vote. Public hearings are also scheduled for several bills. The House Civil Rights & Justice Committee will conduct public hearings on HB 1315 (CPL training) on 29 January at 10:00 a.m. and on HBs 1319 (open carry/public meetings) and 1346 (lead ammo ban) on February 1st at 10:00 a,m. Senate Higher Ed will conduct a public hearing on SB 5150 (college safety officers) at 1:30 p.m. on 31 January. Senate Law & Justice will hear SBs 5181 (firearm possession/mental health) and 5205 (incompetent to stand trial) at 10:00 a.m. on 29 January. Action has yet to be taken on several more bills that have already had public hearings. Their time will come! It frequently means there is back-room negotiating going on to amend the bills after testimony. I have been using the “Bills by Topic” page to track firearm billsfor GOAL Post. I just learned that page runs about a week late. So much for automation. A quick search of introductions, cross-referencing by RCW, reveals at least a dozen more firearm related bills or bills that touch on RCW 9.41. I’ll be working the weekend to update this.What appears below is correct… as far as it goes.Several months ago the GOAL Post e-mail list ws hacked. Since then, I have received a couple of solicitations citing a voucher and asking for money. Other people on the list have informed me that they have received similar messages. IGNORE THEM. It’s a scam Do not open the “voucher” attached to the message. Six new gun bills filed this week, again all in the House. HB 1439 by Rep. Beth Doglio (D-22) prohibits a person from carrying a licensed concealed firearm into another’s residence without EXPRESS PERMISSION of the homeowner. HB 1464, by Rep. Roger Goodman (D-45), makes the Washington State Patrol the background check agent for initial issue of concealed pistol licenses. HB 1465, also by Goodman, removes the waiting period waiver for CPL holders when picking up a handgun. Clearly, a CPL holder already been subjected to a more comprehensive background check than a non-CPL-holding purchaser. HB 1649, by Rep. Robert Sutherland (R-39), exempts CPL holders from background checks upon firearm transfer. HB 1739, by Rep. Javier Valdez (D-46), again addresses undetectable/untraceable firearms. HB 1786, by Rep. Laurie Jinkins (D-27) is a rewrite of the procedures to be used in seizing firearms from those subject to a protective order.Again, each of these in and of itself doesn’t sound that extreme. But it DOES act to impose another hurdle to exercise of what should be a near absolute right, and discourage gun ownershipand/or carry. Public hearings were conducted on six gun bills, HBs 1315, 1319 and 1346, and on SBs 5150, 5181 and 5205. I was not able to monitor the hearings, but all are available on TVWashington intheir archive section. Many hearings are aired live, especially when they cover controversial topics. All hearings are typically available in archives a few hours after the end of the hearing. You can search for specific committee hearings (i.e. Senate Law & Justice Committee, House Civil Rights and Judiciary Committee, etc) at https://www.tvw.org/archives/ and type in the committee name in the “search” box.A few bills passed out of their policy committee and sit in their respective Rules committee awaiting a floor vote. HBs 1068 (magazine ban) and 1225 (firearms/domestic violence) are in House Rules. SB 5202 is in Senate Rules. SB 5181 was sent to Senate Ways & Means for fiscalaction.A public hearing is scheduled next week on HB 1381 (use of UAVs to deliver contraband) in the House Public Safety Committee at 1:30 p.m. on Tuesday, 5 February. A hearing will be held on 8 February, in House Civil Rights & Judiciary, on HB 1786 (seizure of firearms).(Note that all public hearings carry the annotation “subject to change.” Before you drive to Olympia, check to see if the hearing is still on. 90+% of the time they are. Keep in mind, too, that just because a bill hasn’t yet been scheduled for a public hearing, it’s still early days. We’re only three weeks into the 2019 session. They’re still filing dozens of bills every day. They have until 22 February to pass original bills out of committee. That’s three more weeks in which a lot of damage can be done.)They’re getting bolder. In line 5 of RCW 9.41.070 (CPL law), current law clearly states – and has for several decades – “the applicant’s constitutional right to bear arms shall not be denied, unless…” Concealed carry with a CPL was clearly tied to Article 1, Section 24 of the state constitution. The language of HB 1315 eliminates that phrase. So apparently Rep. John Lovick and the bill’s other 11 co-sponsors don’t believe concealed carry is a constitutional right. What other parts of the constitution do they find inconvenient? You know, the constitution they swore an oath to uphold. A public hearing will be held on HB 1315 on Tuesday, 5 February. It appears a little grassroots revolution may be brewing in some Washington counties. Six or more Washington county councils and/or county sheriffs have gone on record saying they believe portions of I-1639 are clearly unconstitutional or unenforceable and will not be enforced within their jurisdictions. I’m not going to name the counties, suffice it to say they’re not in or around Puget Sound, but they are on BOTH sides of the Cascades. These were all public statements to the best of my knowledge so a good Google search should reveal all. 2019-5 Legislative Update from Olympia 8 February 2019 NEW BILLS FILED BILLS PASS OUT OF COMMITTEE MORE COUNTY SHERIFFS QUESTION 1639 CONSTITUTIONALITY PUBLIC HEARINGS SCHEDULED HB 1934, by Rep. Michelle Caldier (R-25), allows deployed or certain other military members – active, reserve or National Guard – to renew their CPL either on-line or by mail… FOR A PERIOD OF ONE YEAR ONLY. HB 1949, by Rep. Drew Hansen (D-23), would authorize a study to determine if a single firearm background check system would benefit the state. One I missed last week is SB 5508, “clarifying” the role of the WSP in conducting CPL background checks. It is the counterpart (duplicate) bill to HB 1464. CPL background checks are currently conducted by county sheriffs or city police. While there may be advantages of uniformity and/or efficiency to a state agency doing the checks, it also removes the process from accountability to the voters (by an elected sheriff). Until we learn more, oppose. House Bills 1068 (magazine ban) and 1225 (firearms/domestic violence) were passed out of House Civil Rights and Judiciary with substitutes (amended bills) and now sit in House Rules awaiting a floor vote. A substitute for HB 1739 was passed. HB 1739 is in Rules. You will see bills stacking up in the respective Rules Committees awaiting a pull to the floor for passage. This is not uncommon early in the session when the focus is on getting bills out of their policy committee. Something else to keep in mind: the committee chair has total control over which bills receive public hearings, and which bills get a vote to pass committee. As a general rule, if a committee chair wants to block a bill, it’s effectively blocked. (Regarding HB 1346, the lead ammo ban to protect “youth” 21 and under, maybe we should raise the voting age back to 21 as well. If 18-20 years olds can’t safely handle lead ammo, they can’t safely vote, either.) The number of county sheriffs who have expressed reservations about the constitutionality or enforceability of I-1639 is rising while a TNT editorial advises them to hold their horses (and enforce the law). Unfortunately it remains the law – unless the current federal lawsuit ot another suit succeeds in overturning all or part of it. But that will take months. I’ve noticed some states with the initiative process require a 60% “yes” vote for passage. Too bad Washington is not one of them. Not that a fundamental, enumerated right should be subject to any public vote, anyway. And I thought the “I was only following orders/the law” defense went out with Nuremberg? Or could it be that, with the asaault weapon and magazine ban bills filed AFTER passage of I-1639, maybe the powers that be question the constitutionality of the initiative as well? Public hearings have been scheduled for four bills next week. Senate Law & Justice will hear SBs 5434 (expanded gun free zones) and 5508 (WSP background checks) at 10:00 a.m. on February 11th. House Civil Rights and Judiciary will hear HB 1530 (expanded gun free zones) at 08:00 a.m. on February 13th and HB 1465 (repeal delivery of handgun on CPL) at 10:00 a.m. on February 15th. 2019-6 Legislative Update from Olympia 15 February 2019 GOVERNOR AND AG SAY I-639 WILL BE ENFORCED NEW BILLS FILED BILLS PASS OUT OF COMMITTEE POLICY COMMITTEE CUT-OFF NEXT FRIDAY PUBLIC HEARINGS SCHEDULED In a press conference Thursday, both Governor Inslee and Attorney General Bob Ferguson said I-1639 WILL be enforced by Washington law enforcement officials. I wonder if they’ve ever heard of civil disobedience? There were no new gun bills filed this week. A few bills passed out of committee this week. HB 1381 (UAVs/contraband) and SB 5150 (college safety officers) apparently were amended and passed out of committee (final results not posted at this time). Presumably both are in their respective Rules Committees. As a general (procedural) rule, bills must pass out of their first policy committee by next Friday (22 Feb) or be considered dead for the session. Because bills with major fiscal impact usually go to a fiscal committee, that cut-off date is a week later. In most cases, the cut-off rule holds, but exceptions can be made, and bills revived. No bill is truly dead until the end of the session. Executive session (committee votes) will be held on several bills next week, given the Friday committee cut-off. Public hearings are scheduled next week for several bills. HBs 1934 (military CPL renewal) and 1949 (firearm background checks) will be heard in House Civil Rights and Judiciary on February 19th. SB 5782 (knives) will be heard in Senate Law & Justice on February 18th. SB 5016 (arming animal control officers) will be heard in Senate Law & Justice on February 19th. SB 5181 (firearms/mental health) will be heard in Senate Ways & Means on February 19th as well. GOAL Post
2019-7 Legislative Update from Olympia 22 February 2019 NEW BILLS FILED POLICY COMMITTEE CUT-OFF PASSES SOME BILLS NOMINALLY DIE FOCUS SHIFTS TO FLOOR ACTION HB 2103, by Rep Matt Shea (R-4) effectively rolls back much of I-1639. The bill was filed just before cut-off, and barring extraordinary action, will go nowhere – this year. SB 5954, by Sen. Christine Rolfes (D-23), modifies bump-stock buyback procedures. The week before the committee cut-offs and the final weeks of chamber floor votes are among the most hectic of the session. Hopefully I haven’t missed anything (I don’t think I have – as one of my drill instructors told me 55 years ago, to err is human, to forgive is divine, neither of which is Marine Corps policy!) Today was the last day to pass bills out of their original policy committee. Theoretically, any bills left in committee are dead for the session. Theoretically. For the time being, I will carry those bills in their original committee in the Bill Status column. As this was the last week to pass bills out of their original policy committee, several; bills were voted on and passed out to their respective chamber Rules Committee. They have until March 3rd to pass the bills out of their original chamber – floor vote (House bills out of the House, Senate Bills out of the Senate). So most of the action next week will be on the House and Senate floors. There are currently twenty bills awaiting a floor vote, 8 in the House and 12 in the Senate. That means about half of the gun bills filed are dying. It appears that the House Civil Rights & Judiciary and Senate Law & Justice Committee chair elected to split up the more controversial bills, with the House addressing magazine bans, delivery of a handgun for CPL holders and undetectable firearms. The Senate moved expanded protection orders, also undetectable firearms, more magazine bans, seizure of firearms in DV incidents, mandatory CPL training and expanded gun free zones. As or if these bills pass their chamber of origin, they move over to the other side for the same process – committee hearings, votes and eventually floor votes. We still have time to stop bills in multiple locations – floor votes nest week, committee votes and floor votes through mid-April -- provided enough gun owners get in touch with their legislators and scream loud enough. 2019-8 Legislative Update from Olympia 1 March 2019 CHAMBER CUT-OFF 13 MARCH SHERIFFS’ REVOLUTION SPREADS? NEW BILL FILED Correction: Last week I said the chamber cut-off was March 3rd. I missed a “1.” It’s March 13th! Ten more days to pass bills that threaten the constitution, threaten your wallet, or both!. 20 of 33 county commissions in New Mexico and their sheriffs have publicly stated their opposition to proposed gun legislation, declaring the proposals unenforceable. Not surprisingly, NM’s Democrat governor has ridiculed the sheriffs. Apparently it’s not just Washington sheriffs who have decided enough is enough. Several years ago a number of sheriffs and other law enforcement officers got together and formed the Constitutional Sheriffs and Peace Officers Association (cspoa.org). Their position is that the sheriff is the highest executive authority in any of our 3,000+ counties, and thus constitutionally empowered to override certain federal legislation. This concept has obviously evolved down to state legislation as well. This will be interesting to follow. HB 2133, by Rep. Mike Steele (R-12), amends the state explosives act. The current act prohibits those convicted of violent felonies from working in the business or using explosives. This bill expands the prohibited list to include all those prohibited of owning firearms (certain misdemeanants, protective or restraining order subjects, etc). The bill continues the exemption for small arms ammunition and limited reloading supplies, so it has no practical effect unless you are an employee or major explosives user – but the expansion is simply overreach and sets a bad example. Note that almost all bills in the “support” category died last week. Don’t take any joy that the “assault weapon ban” bills died -- that issue is tied up with I-1639 in the courts – but note the magazine ban bills ARE still moving. I’ve listed the bills that died at last week’s committee cut-off as “died.” Next week I’ll leave them out entirely to reduce clutter and confusion. But keep in mind we have a two-year legislative biennium – all these bills spring back to life next January. Or in any special session between now and then. And the make-up of the legislature remains the same, with solid Democrat majorities in both the House and Senate. The process is theirs to control. SB 5954, bump stock buyback funding, passed the Senate unanimously. The bill allocates $150,000 to fund last year’s unfunded buyback program at $150 per bump stock. Nine more House bills and 13 Senate bills await a call to their respective chamber floor for a vote. Bills that pass out of their original chamber go to the second chamber tyo begin the process all over again: policy committee assignment, possible public hearing, a committee vote and then possibly a second chamber vote. We’re not quite half way through the session, with most of the serious action still ahead. Next week the floor action will be fast and furious, with several possible evening sessions on the schedule. Evening, and even weekend, session are always possible. 2019-9 Legislative Update from Olympia 8 March 2019 CHAMBER CUT-OFF NEXT WEDNESDAY SHERIFFS, FFLs WARNED BILLS PASS ORIGINAL CHAMBER BILL STATUS LIST CULLED The chamber cut-off is in five days. Bills that do not pass out of their chamber of origin by 5 p.m. are considered dead. (Always subject to extraordinary action.) Of the nearly 50 gun-related bills filed since the session began on 14 January, more than half have died. There are still just over seven weeks remaining for the 2019 regular legislative session. Both Governor Inslee and Attorney General Ferguson came out this week warning both county sheriffs and federal firearms licensees to either “enforce I-1639 or face legal jeopardy.” They’re threatening to sic the State Patrol on violators. The initiative is still tied up in federal court. Bills that have passed include HBs 1225 (firearms/domestic violence), 1739 (undetectable/untraceable firearms), 1786 (seizure of firearms/protective orders), 1934 (military CPL renewal via mail), 1949 (firearm background checks) and SBs (extreme risk protection orders under 18), 5508 (WSP background check for CPLs), 5782 (spring blade knives) and 5954 (bump stock buyback funding). I suspect votes on some of the more controversial bills (SSB 5174, HB 1465) are being held off to the Wednesday deadline. The fact that they passed out of one chamber is no guarantee that they will pass out of the second, but the bills that have passed or will pass have cleared a major hurdle. Most of the anti-gun bills passed on a straight party line vote, Democrats in favor, Republicans opposed. SB 5954, funding for the bump stock buyback, passed the Senate and was sent to the House Appropriations Committee where it was immediately pulled to Rules for a House floor vote. I’m sure there have been a few bills that moved this quickly before, but this is the first gun bill that I have seen move that fast. The state had no business banning bump stocks, but at least owners will not get stiffed without SOME compensation. No public hearings have been scheduled at this time for bills that have passed their original chamber, except the SB 5954 exception noted above. I’ve cleared the Bill Status list of those bills that have died. At least a few more will die at next Wednesday’s chamber cut-off. 2019-10 Legislative Update from Olympia 15 March 2019 SB 5954 PASSES LEGISLATURE CHAMBER CUT-OFF/TURNOVER DAY BILLS LIVE – BILLS DIE PUBLIC HEARINGS SCHEDULED In an unusual move, SB 5954 (bump stock buyback funding) passed out of the Senate on 28 February, was fast-tracked through the House on March 11th where it was amended, so it went back to the Senate, who concurred in the House amendment. It’s on its way to the Governor. Of the 23 bills that survived the original chamber policy committee cut-off, only 13 made it through the second cut by passing out of their chamber of origin. House bills moving to the Senate include HBs 1225 (firearms/DV), 1465 (handgun delivery w/CPL), 1739 (undetectable/untraceable firearms – the Senate version died), 1786 (protective orders/firearms), 1934 (military CPL renewal by mail) and 1949 (single point of contact for background checks). Senate bills moving to the House include SBs 5027 (underage extreme risk protection orders), 5181 (firearms/Mental health), 5205 (firearms/incompetent for trial), 5434 (new/expanded gun free zones), 5508 (WSP background checks for CPLs) and 5782 (spring-blade knives). I mentioned SB 5954 above. Bills that died include HB 1010 (WSP destruction of forfeited firearms), 1068 (high capacity magazine ban), 1381 (UAVs/contraband delivery), 5016 (arming animal control officers), 5061 (undetectable/untraceable firearms), 5062 (high capacity magazine ban), 5099 (target shooting on DNR land), 5143 (firearms/DV incidents). 5150 (college safety officers/weapons) and 5174 (CPL training). 2019-11 Legislative Update from Olympia 22 March 2019 GOV SIGNS BUMP STOCK BUYBACK FUNDING AWAITING COMMITTEE ACTION ON BILLS HEARD THIS WEEK PUBLIC HEARINGS SCHEDULED NEXT WEEK SECOND POLICY COMMITTEE CUT-OFF Starting the second half of the 201`9 legislative session. And I think it’s time for a pep talk. We dodged a major bullet last week when SSB 5174 (CPL training) failed to get a vote. That was no coincidence. They do a nose count before major votes, and if the votes aren’t there, they don’t bring it up for a vote. Should a bill as extreme as SSB 5174 become law, it would strike a major blow to the CPL program. There are just over 600,000 CPL holders in Washington. Imagine if, the next time this comes up (there WILL be a next time), imagine if we could get just 1% of CPL holders to show up in Olympia to protest the bill (and other gun control bills). That would be more than 6,000 protestors. Guaranteed that would get their attention. But the other side is relying on gun owner apathy, whether it’s in Olympia or on election day. As a 20-year registered lobbyist, I can assure you – lobbyists can’t carry all the load. Lobbyists are there to speak for you, but they need to be backed up. By vocal gun owners. I’ve seen it first hand in my time in Olympia. Hopefully many of you sent letters to your legislators two weeks ago, after the GOAL Alert on 5174 was published. And NRA and other gun rights group members sent communications. That’s what influences legislators. It’s called “grassroots lobbying.” And it works. Washington has historically been a pro-gun state – provided the large number of gun owners (and their family members) speak out – and vote. Our shall-issue CPL program passed in 1961 was a model for the country. As was the landmark “state firearms reemption” law we passed more than 30 years ago. It’s up to each of you – individually. Pep talk over. On 14 March, Governor Inslee signed into law SB 5954, the bill that funds the bump stock buyback program. I believe SB 5954 is both unconstitutional and unnecessary. But it’s the law. At least those who choose to turn in their previously legal bump stocks will receive some compensation -- $150. Limit of five per customer and sufficient funds allocated for 1,000 bump stocks buybacks. Better hurry! The funding is available immediately (or when the WSP is ready to cut checks). Public hearings held on four bills this past week, HB 1949 (firearm background checks), and SBs 5508 (WSP background check for CPL), 5181 firearm possession/mental health) 5782 (assisted knives)… Awaiting executive action (committee vote, most votes scheduled for next week) HB 1949 (firearm background checks) passed out of the Senate Law & Justice Committee and sits in Senate Rules awaiting a pull to the floor for a final/floor vote. Five public hearings are scheduled for next week, most in Senate Law & Justice. HBs 1465 (delivery of handgun with CPL) and 1786 (firearms/protective orders) will be heard in Senate Law & Justice at 10:00 a.m. on 25 March. HB 1739 (untraceable/undetectable firearms) at 10:00 a.m. on 26 March. And HB 1934 (CPL renewal for deployed military members) at 10:00 a.m. on 28 March. House Civil Rights & Judiciary will hear SB 5027 (under age 18 extreme risk protective orders) at 10:00 a.m. on March 26th. At this time no action has been scheduled on SHB 1225 (firearms/domestic violence) and SSB 5434 (gun free zones) but there is plenty of time in the 12 days before the next cut-off. The next cut-off facing us is the second chamber policy committee cut-off on April 3rd. It appears Washington and Oregon are in a race to see who can pass the most restrictive gun control laws this year. 2,000 is by no means perfect, or even fully representative of Oregon gun owners, but it was a respectable turn-out. Several bills moved out of committee to House or Senate Rules this week. HBs 1465 (pistol delivery), 1739 (undetectable/untraceable firearms), 1786 (firearms/protective orders) and SB 5508 (WSP CPL background checks). A few bills are still awaiting policy committee votes, before end of business on 3 April. They are HB 1934 (military mail-in CPL renewal), SSB 5027 (extreme risk protection orders under 18), SB 5205 (firearms/incompetence) and SB 5782 (assisted opening knives). Only one public hearing is scheduled for next week: HB 1225 (firearms/domestic violence), in Senate Law & Justice on committee cut-off day! 2019-13 Legislative Update from Olympia 5 April 2019 POLICY COMMITTEE CUT-OFF; BILLS MOVE, BILLS DIE ACTION SHIFTS ONCE AGAIN TO CHAMBER FLOORS 17 APRIL CHAMBER CUT-OFF, 28 APRIL SINE DIE The legislature is moving into the final leg of its 105 day/15 week regular session. Just over three weeks left. The primary focus of the long session in odd-numbered years is supposed to be development and adoption of the biennial budget, Whether a budget agreement will be reached or a special session will be called is hard to say right now. Both the House and Senate have passed budget bills, but the bills are $750 MILLION apart – in new spending only! The overall biennial budget runs over $52 BILLION. Now to guns… The second chamber policy committee cut-off occurred two days ago. A few more gun bills died, others moved forward. Unless there is a dispute between the House and Senate versions of a bill, it must clear the legislature with a floor vote by April 17th. Bills in dispute have until the last day, 28 April. SB 5434 (expanded gun free zones) died in House Civil Right & Judiciary. SBs 5027 (extreme risk protection order, under 18) and 5508 (WSP background checks for CPLs) both passed the Senate with amendments. Both now go to a concurrence vote or a conference committee. 2019-14 Legislative Update from Olympia 12April 2019 BILLS PASS SECOND CHAMBER CONFERERNCE COMMITTEE FOR MOST CHAMBER CUT-OFF NEXT WEDNESDAY, 17 APRIL The House passed SBs 5181 (firearms/mental health) and 5205 (firearms/incompetence, both with amendments. The Senate passed HB 1225 (firearms/domestic violence) with amendments. All three bills await a concurrence vote (for the amendment) or go to a conference committee to iron out differences, where SB 5508 CPL background checks) still sits.. HB 1949 (firearm background checks) is on its way to the Governor. 2019-15 Legislative Update from Olympia 19 April 2019 RALLY FOR YOUR RIGHTS BILLS PASS, ONE DIES CONCURRENCE VOTES ONE MORE WEEK SPECIAL SESSION LOOMS BUMP STOCK WARNING LATE DISSEMINATION ON THE ROAD A pro-gun “Rally for your Rights” will be held on the Capitol Campus on Saturday, 27 APRIL at12 noon. A little late in the session, but still an opportunity to show your support. It IS on a Saturday. Try to make it and show them the gun lobby is not a paper tiger.. Several bills passed by the end of the second chamber cut-off on Wednesday evening. House Bills 1465 (handgun delivery), 1739 (undetectable/untraceable firearms), 1786 (firearms/protective orders) and 1934 (military online/mail CPL renewal) all passed out of the Senate. HB 1934 was rushed off to Governor Inslee for his signature. The remainder await a concurrence vote or conference committee action because they were amended in the second chamber. It’s not over yet! Senate Bill 5782 (assisted-opening knives) died on the House floor without a vote. What a surprise! The Senate has concurred in House amendments to HBs 5027 (Extreme risk protection orders, under 18), 5181 (firearms/mental health) and 5205 (firearms/incompetence for trial). All three are on their way to the governor. There is one week left for the House and Senate to review difference between passed versions of the bills and kick them to the governor – or they die for the session. That doesn’t mean they won’t be back next year… or in a week or two in a special session. The regular legislative session ends at midnight on Sunday, 28 April.It appears the Democrats who control the House and the Democrats who control the Senate can’t agree on how much to raise taxes for the biennium. This means it is likely we will enter one or more 30-day special sessions until they get it sorted out. Apparently there is no honor among thieves. As the saying goes, neither you life nor your wallet are safe as long as the legislature is in session. An individual with what appears to be a fictitious name, “Yati Arguna,” has sent a Public Records Act request to the State Patrol asking for the names and addresses of everyone who turned in a bump stock for cash compensation. That’s about 1,000 individuals. Unless a judge blocks the release (reasonable as a public safety measure), state law requires the names be released. Who is behind this and where or how the information will be used remains to be seen. Should one assume that anyone who turned in a bump stock has a Modern Sporting Rifle in their home? I will likely hold off on posting next week’s GOAL Post until Sunday night (when I’ll be flying back from the NRA annual meeting in Indianapolis) or Monday, when we know for sure what passed and what died. Recognize that in the event of a special session ALL BILLS from the previous regular session come alive again and may be considered, voted on, and passed. The week after I’m off for Europe – allegedly. I’ll be flying on an airline family pass, so it’s “space available” and any movement will depend on empty seats available AND my (very low) seniority number. I sent my wife to visit family ten days ago, and now I have to go bring her back. This living alone (not entirely alone, I have a Lab, but she doesn’t talk) isn’t all it’s cracked up to be when you’ve had a wife to spoil you for 50+ years now! Should a special session be called, it is my intention to continue GOAL Post… all dependent on information being available to me wherever I am. Historically they don’t use special sessions to drag back gun bills, so unless there’s a major gun incident, we should be safe.
