The Des Moines city council explored the idea of banning "high capacity" magazines and "trigger activators" such as bump stocks within city limits.

"We can act, and we should," city Councilman Josh Mandelbaum said. "The only reason people have high capacity clips or trigger activators is to do as much damage as they can as quickly as possible. There's no reason for them to have high cap magazines or bump stocks."

Just had a customer in my store fucking livid about them trying this. I'm on mobile smoking a cigarette, but I'm going to look that part of the code law up to send him.

He was saying theres a hearing or something on the 14th, which is shockingly my day off, so we plan to go to that.

Eta: looked up 724.28. It specifically specifies firearms, no mention of accessories like magazines.

I was discussing this with another member. It is going to take charged cases to prove preemption is a thing. For example, several businesses in Cresco have signs posted against carry, with a line saying "violating this sign is trespassing". They say the sign is them asking you to leave, and the sheriff has said he will arrest those who violate the signs.

Another, I recently noticed at Treasure Chest in New Hampton(a thrift store). Their sign says "Violators are subject to arrest and forfeiture".

Maybe another way to push back is the money aspect? Thousands upon thousands of voters have hundreds and thousands of dollars of perfectly legal magazines that they want to make illegal. Force them to discuss a buyback, and I imagine the cost of that would make this "common sense" thing suddenly unappealing to them.

sorry mr sheriff but a sign, not matter what it says, isn't capable of covering the statute... i'd actually dare that sheriff to arrest somebody for that. operating a business in public is not the same as a putting up a 'no trespass' sign on private property you aren't inviting anyone into or onto. a 1st year law student could drive a truck through that gap. i'm sorry this sheriff misunderstands such a thing. that's troubling.

IFC has organized a group of locals to go forth and represent at the council meeting. I'm supposed to be on the airwaves along with others in our org talking about this as well. I think some may have already been on 99.3FM and more to come on 1040AM.

If we stick together on this, and make some noise, we stand a really fair chance of convincing them violating 724.28 is unwise. Then, we all need to hammer our legislators with "Pass the Family Defense Act" since it could have taken care of portions of this. ...And don't settle for the "I would have voted for it, if it had made it to the floor" bullshit. Lean on them to see what they're doing to get it to the floor. That's a key question.

you can make a very simple argument that the original design in a weapon is the magazine, of and in itself, is integral to the design. thus a G19 was designed to hold a 15rd mag, not a 10. although 10s are made subsequently. a magazine is not an accessory, as the weapon doesn't function by design without the magazine. a weapon light? that's an accessory. big difference.
