Does anyone here have any experience or recommendations on how to handle an auto insurance claim that is violating the Insurance Fair Conduct Act (IFCA)? https://www.insurance.wa.gov/insurance-fair-conduct-act-ifca-laws-and-rules

I found that part of the IFCA is WAC 284-30-380 http://apps.leg.wa.gov/wac/default.aspx?cite=284-30-380

(1) Within fifteen working days after receipt by the insurer of fully completed and executed proofs of loss, the insurer must notify the first party claimant whether the claim has been accepted or denied.

I was rear-ended on 3/2 and I filed a claim with the other driver's insurance (USAA) and there has been zero communication from them since 3/6 when they had me take my car to a shop to get a repair estimate.  The adjuster never returns me calls and never answers his call and I still have no idea what is going on.  This is clearly past the 15 day limit.

Maybe try the insurance commissioner?

I've called them about health insurance stuff and they have been helpful.

I didn't feel like paying my $500 deductible and waiting 8 years to maybe get it back when it was obvious 100% the fault of the other person.

Funnily enough, soon after I posted this I got a hold of a manager at USAA and magically they accepted liability and sent payment to the shop while I was on the phone.

Reminded yet again why I dropped all my banking and insurance from them several years ago.
