So, I had a guy contact me off armslist and wanted me to ship a high capacity magazine to new York state. I'm pretty sure high capacity magazines are illegal there. Trap?? AFT trolling?

I sent a high cap to California, disassembled at a "magazine repair kit". I may have sent the internals separate from the body.

It was legal to do it like that at the time.

I won't suggest breaking the law. But if you did it's not like they will get an extradition on you...

What a great day to be alive, sipping a cool beverage and NOT thinking about shipping ANYTHING to NYC.

Peace and tranquility.

I don't think NY law states anything about an out of state seller. You live in OK so NY couldn't do anything to you. Everything would fall on the buyer. Not your problem.

Came for the poop tranny, left with the ATF.

@Fullautoguy Why, exactly?
NY law only prohibits possession (265.36 & 265.37), which is still only a misdemeanor. Exactly how are they going to charge or prosecute someone, who lives in another state, for something which isn't written into law as being illegal?

Have some common sense man. It's most likely ATF seeing if anyone is stupid enough to do it. A quick Google search would show you anything above 10 rounds has been banned.

Seems like state law, not  federal..

Why would ATF care?

@10mmManiac
You're completely missing the part where there's a ton of exempt persons. How does the OP know the buyer isn't one of them? Nothing in NY state law prohibits someone from out of state mailing the mag to a NY resident. The law only bans possession. The OP wouldn't be violating any State or Fed laws by mailing the mags.

It may not be a criminal act, but the state of NY could possibly civilly sue.  Im not a lawyer so ...

You could always reply with it's illegal in ny to have more than 10round mags but will gladly block the mag before shipping, if they pay for the block.

Doubt it's the ATF, since it's a state law and the state isn't going to try to bait someone out of state.

I hate to say it but I wouldn’t bother.

At best it is dumb on his part to purchase something prohibited over the internet, at worst they are baiting you into something.

Tell him you don't ship High Caps or anything to NY...

Its not worth the risk or trouble.
