The same reason an officer can knock down a rioter trying to stab him with a piece of sharpened 1/2" rebar and get charged with aggravated assault.   Leftists.

The usual answer is “intent” and what the DA thinks they can win with a jury.  Not watching the video though so I don’t know…


I have long thought that just because a criminal was a bad aim was no reason for the charge to be at a lower level.  Crazy idea, I know- punish them based on their intent and ability, not the outcome…

In Texas, aggravated assault with a deadly weapon on a peace officer is a first degree felony. Attempted capital murder of a peace officer is also a first degree felony.

However, the culpable mental state for agg. assault is only reckless whereas it’s knowingly for attempted murder. The DA usually charges agg. assault because it’s easier to secure a conviction for the same level of offense. The DA will only need to prove the defendant recklessly caused the officer to be in fear of imminent bodily injury while the defendant exhibited a deadly weapon vs. trying to prove the defendant knowingly tried to kill but ultimately failed to do so.

It's much easier to prove what a suspect did than it is to prove what a suspect intended.

It’s a first degree felony. It doesn’t get any higher than that. As stated, Agg. Assault against a P.O. w/firearm spec is a no brained here. You cannot prove his intent was to kill anyone (nowadays), but you can prove he injured an LEO with a firearm.
