Judge: Wisconsin clerks can't fill in missing info on absentee envelopes MADISON (AP) — A Wisconsin judge on Wednesday ruled that state law does not allow election clerks to fill in missing information on witness certification envelopes that contain absentee ballots, delivering a victory to Republicans nine weeks before the election in the battleground state. The lawsuit, backed by the GOP-controlled Legislature, is the latest move by Republicans to tighten restrictions on absentee voting in the swing state where Democratic Gov. Tony Evers and Republican Sen. Ron Johnson are on the ballot in November. Waukesha County Circuit Judge Michael Aprahamian on Wednesday granted GOP motions to immediately block the practice, known as ballot curing. The case is expected to ultimately go to the conservative-controlled Wisconsin Supreme Court, which in July ruled that absentee ballot drop boxes located outside of clerk offices are illegal. Local election officials do not have the authority under the law to modify absentee ballot certificates, nor does the state elections commission have the right to order that they take that action, the judge said. He accused the elections commission of “stubborn and unjustified adherence to its guidance” that was contrary to state law. An attorney for Democrats said he planned to file a motion to stay the ruling pending appeal. A hearing was set for Tuesday. The judge agreed with Republicans that 2016 Wisconsin Elections Commission guidance issued to the state’s 1,800-plus local election clerks saying that they can cure ballot certificates without contacting the voter is illegal. Clerks only address problems on the witness certificate, which doubles as an envelope, and not the ballot itself. Republicans did not contest the practice until after Donald Trump’s narrow loss in 2020, when nearly 1.4 million voters cast absentee ballots and COVID-19 vaccines weren't available yet. “This isn’t a case about counting votes,” said George Burnett, attorney for the Republican Party of Waukesha County, which brought the lawsuit. “This is a case about stopping the issuance of guidance that violates Wisconsin law.” The Waukesha County Democratic Party, which is defending the practice, argues that Republicans are trying to create confusion and uncertainty just weeks before early voting begins. All absentee ballots in Wisconsin must be sent to voters by Sept. 22. The guidance has been in effect for more than 20 statewide elections, and Democrats argue it is lawful and necessary to comply with the federal Civil Rights Act. The issue was previously raised by Trump after he narrowly lost the 2020 election. The Wisconsin Supreme Court did not directly address it in upholding Trump’s loss, but four of the seven justices suggested that the guidance allowing clerks to cure absentee ballot certificates was reasonable. Republicans have been trying for months to undo the guidance from the elections commission. In January, a GOP-led legislative committee told the commission to suspend its guidance or submit a proposed rule to clarify it. When the commission submitted its emergency rule, Republican lawmakers blocked it. The commission’s position was that the underlying guidance remains in effect, but that judge declared it invalid and ordered the commission to notify clerks that it can't be followed. The lawsuit was filed by the Republican Party of Waukesha County and three voters, and the Republican-led Legislature intervened. The Waukesha County Democratic Party and the League of Women Voters of Wisconsin joined the commission in defending the guidance. Both sides made their arguments in court before the judge ruled Wednesday. Wisconsin law requires absentee ballots to be submitted in an envelope that contains a witness signature and the address of that person and the voter. The Legislative Audit Bureau last year reviewed nearly 15,000 absentee ballot envelopes from the 2020 election across 29 municipalities and found that 1,022, or about 7%, were missing parts of witness addresses. Only 15 ballots, or 0.1%, had no witness address. Auditors found that clerks had corrected addresses on 66 envelopes, or 0.4% of the sample. |

According to this manual, the persons who may return an absentee ballot are limited to: the voter a member of the voter’s immediate family who has been asked to return the ballot a person residing in the voter’s household who has been asked to return the ballot a person whose job normally includes the handling of mail (but only during the course of his or employment) an authorized election official MCL 168.764a Ballot traffickers generally do not deposit a large number of ballots per drop box. With video surveillance, they are aware that this would be too obvious to those looking for violation of election laws. There were exceptions to this in what was noted at the Detroit drop boxes in 2020. What follows is a sample list of the various multiple ballot drops which was observed by Michigan Citizens for Election Integrity (MC4EI.com), the team which reviewed and analyzed thousands of hours of surveillance videos of the Detroit drop boxes from the November 2020 general election. This list corresponds to various clips you will see in the ensuing video below. Of note is that when MC4EI investigators initially started watching these videos, they realized they were underestimating the number of multiple ballots a person might be holding. What they assumed might be 3 ballots often turned into many more as they saw a person deposit them incrementally into a drop box. Also, it was observed that the surveillance cameras were sometimes placed at angles which precluded being able to clearly see how many ballots were deposited as the dropbox itself obstructed what was being dropped. Or, the surveillance camera was too far away to clearly see what was being deposited. For those legislators or individuals who think that surveillance cameras are sufficient to provide drop box security, MC4EI would disagree. Our experience proves otherwise. It was also observed that individuals often wore masks as they approached the drop boxes and took them off when they got back into their cars. Even when there were no people around to worry about viral transmission. Here is the list of clips of drop boxes you will be viewing in the video below: Clip #1- Heilmann Recreation Center. A woman deposits a stack of about 50 ballots while another woman appears to be videotaping her. Both are wearing face masks. Clip #2- Horatio Williams Foundation. A person in a vehicle has a stack of ballots which he takes a phone picture of and then hands it off to another man, who does not appear to be an election official, outside his car who holds the stack up next to the drop box and then carries the ballots off. Sound secure to you? Clip #3- Liberty Temple (a stand alone drop box, not associated with a satellite voting center ie SVC). A woman wearing a Mickey Mouse t-shirt deposits what initially appeared to be 3 ballots, but actually turned out to be about 6. Clip #4- Liberty Temple. A person made 11 motions in dropping ballots into the drop box with what appeared to be multiple ballots with each motion. The estimated amount dropped would be 30 to 40 ballots. Clip #5- Coleman A. Young Municipal Center. A person had about 5 unsealed ballots which were deposited all at once after sealing them. Clip #6- Farwell Recreation Center. A minimum of 7 or 8 ballots was deposited. Clip #7- Palmer Community House. A woman who appeared to be a health care worker deposited at least 6 or more ballots. Clip #8- Farwell Recreation Center. A woman deposited about 6 ballots. Clip #9- Heilmann Recreation Center. A man deposited at least 5 ballots. Clip #10-Kemeny Recreation Center. A woman had a stack of multiple ballots which she deposited all at once. Clip #11- Farwell Recreation Center. A man deposits 6 ballots from a vehicle. Clip #12- Liberty Temple. A woman deposits a stack of ballots. Clip #13- Pistons Performance Center. A man with a phone deposits 5 ballots. Clip #14- North Rosedale Park. A woman with a mask deposits 6 ballots. Clip #15- Balduck Park. A person on the passenger side of a red truck takes a pic of the drop box and center. A vehicle then drives up with what appears to be a female health care worker who deposits 8 ballots. Clip #16- Balduck Park. A woman appearing to be a health care worker deposits a minimum of 10 ballots. Clip #17- Balduck Park. The same woman as noted in Clip#16 deposited 12 ballots. Clip #18- Liberty Temple. A female postal worker drops a few ballots. Clip #19- Liberty Temple. The same female postal person as in Clip #18 deposits multiple ballots. Clip #20- Liberty Temple. The same female postal worker as in Clip #18 arrives in a private vehicle and deposits at least 10 ballots. Clip #21- Male postal worker deposits about 10 ballots. Clip #22 -Liberty Temple. Same male postal worker as seen in Clip#21 deposits multiple ballots. If someone other than the voter is delivering their absentee ballot, it must be delivered to the clerk of the respective city or township office. Not to a drop box. There are no specific rules in Michigan regarding nursing home absentee voting. Michigan does not have special voting deputies for nursing homes as does Wisconsin. Therefore, the general rules apply as noted above. As seen in the video, postal workers made visits to the drop boxes. MC4EI discussed this with postal service employees in the metro-Detroit area. None of them has ever delivered absentee ballots to drop boxes, but only to clerks offices. Multiple ballots being deposited raises the question- is this from residents of one household? Potentially 10 to 50 voters from one household? Or does it represent something which is illegal? Multiple ballot drops have been seen in other states as well, such as Pennsylvania in which a woman was seen dumping a stack of ballots in the off year 2021 election in Montgomery County. In Pennsylvania, if a voter designates another person to submit their ballot, they are not permitted to be dropped off at a drop box but only at the clerks office. In fact, hundreds of people were seen on surveillance videos as stuffing multiple ballots into drop boxes during the Pennsylvania 2021 election. How can elections be considered secure with such questionable and potentially illegal behavior occurring at drop boxes, even despite surveillance cameras being present? And with no accountability or follow-up by law enforcement for investigation or prosecution? The only sane conclusion one can come to is that drop boxes should be eliminated. |

Clinton-Appointed Federal Judge Bars Arizona Officials From Enforcing New Law To Remove Dead Voters, Nonresidents, And Non-Citizens From Voter Rolls A Clinton-appointed federal Judge blocked a new Arizona election integrity law from being enforced in the upcoming 2022 General Election. HB2247 is meant to clean the voter rolls and remove registrants who are registered in another state and no longer live in Arizona. The new law would add a statement on voter registration forms, specifying that if a registrant permanently moves to another state after registering in this state, their registration will be canceled. It would also direct the county recorder to cancel a voter registration when they confirm that the registered person is dead, that the person is not an Arizona resident or resident of that County, or that they are not a citizen of the United States. The Gateway Pundit previously discovered during our investigation into the Electronic Registration Information Center (ERIC) that the largest U.S. Counties removed only ZERO to TWO ineligible voters from their voter rolls in the last four years. ERIC, initially funded by the Soros Open Society Foundation, is essentially a left-wing voter registration drive disguised as a voter roll clean-up system and is used in Arizona and 30 other states. State Rep. Jake Hoffman, the bill’s main sponsor, told The Gateway Pundit, “Democrats have stooped to a new level of shamefulness and depravity with their latest round of lies about Arizona’s common sense laws to ensure that our elections are accessible, secure, and trustworthy.” Epoch Times reported, Arizona officials cannot enforce a new election bill in the upcoming midterm elections, according to a federal judge. Arizona Secretary of State Katie Hobbs and other officials shall not “take any action to implement or enforce H.B. 2243 in a manner that would remove any voter’s eligibility to vote in the 2022 general election or disqualify any otherwise-valid ballot on the basis of H.B. 2243,” U.S. District Judge Susan Bolton, a Clinton appointee, said in the Sept. 8 order. The officials and the coalition, which sued over the bill in August, agreed that “the provisions of H.B. 2243 should not operate in a manner that would prevent any voter from (1) voting in the upcoming November 2022 general election or (2) having their vote be counted.” Hobbs and Brnovich also decided that the changes to the state election code shouldn’t take effect until Jan. 1, 2023, because one of the laws the bill is amending is not effective itself until then. Last month’s filing from Arizona Asian American Native Hawaiian and Pacific Islander for Equity claims that this bill targets “only certain groups… naturalized voters and voters of color,” which is completely untrue. This law will affect all invalid or illegal voter registrations regardless of the person’s race or naturalization status. “Democrats’ cries of racism are laughable on their face and serve only to shine a spotlight on the Democrat Party’s long history of institutionalized racism and repeated attempts to disenfranchise millions of Americans throughout the last century and a half,” added Hoffman. He continued, “make no mistake about it, ensuring clean voter rolls and protecting the sanctity of Arizonans’ votes by prohibiting non-citizens and non-residents from casting illegal ballots benefits every single legal voter regardless of race, gender, income, and party.” A similar attempt by Democrats to radically change election law by expanding drop boxes, mail-in voting, automatic voter registration, giving voter registration to all regardless of their citizenship status, and banning post-election audits was recently shot down by the Arizona Supreme Court. 2000Mules Texas Style: Newly Discovered Police Body Cam Footage Implicates Top Tarrant Co. Texas Democrat Officials in Ballot Harvesting Newly discovered police body cam footage in Forth worth, TX obtained by The Gateway Pundit shows that the claims made in True the Vote and Dinesh D’Souza’s 2000Mules were not exclusive to the “swing states”. Or the 2020 election. This footage implicates two top Democrat leaders in the county’s party: former Tarrant Co. Democratic Party (TCDP) chairwoman and now candidate for Tarrant Co Judge Deborah Peoples and the director at The Peoples Group, Stuart Clegg. Clegg was also the executive director for the TCDP and Peoples was a member of the Tarrant County election board and commission responsible for overseeing the integrity of county elections. You may remember Tarrant County from the 2020 election: it was a red county for 56 years until the COVID lockdowns and a massive push for the fraud-ridden universal mail-in ballot system. The Gateway Pundit reported on this back in November 2020. Tarrant County hired Heider Garcia, who obtained his engineering degree in Venezuela and worked for Smartmatic for 12 years, where he was an executive level employee. In 2010, Garcia was called “a son of a bitch” by Philippine Congressman Teodoro Locsin after “unforeseen” circumstances led to huge election discrepancies in the country. But this story isn’t about him, however, it is about an accusation of a long time fraud perpetrated on the people in the jurisdiction he supervises. In October 2018, four women were arrested in a voter fraud ring in Fort Worth. According to the Star-Telegram: “Members of an organized voter fraud ring have been arrested and indicted on charges they targeted and, in one case stole, the votes of elderly voters on Fort Worth’s north side… These people allegedly were paid to target older voters on the north side ‘in a scheme to generate a large number of mail ballots and then harvest those ballots for specific candidates in 2016,’ the statement read.” The Star-Telegram published a story about the man, Charles Jackson, in our footage back in 2018. He was arrested and indicted for “providing false information on a voting application.” As it turns out, he did a lot more than that, and according to his own admissions, it was at the behest of Stuart Clegg and Deborah Peoples. The following footage was obtained through open records request in Fort Worth. It shows a conversation between Jackson and the officer that he had a conversation with previously in 2016. This engagement on January 3, 2020 was not an interrogation and Jackson was not being accused of a crime or detained for a crime. In fact, Jackson himself brings up their previous interaction and begins to tell him about the ballot harvesting. This is about as casual a conversation one could have with a police officer, so there is no concern that he was potentially trying to avoid any possible negative actions taken against him. Two years prior to the above engagement, Jackson was originally arrested for one count of “providing false information on a voting application” in Tarrant County. He was brought to an “investigation room” with “so many people in there.” He said he was “scared as hell”. Apparently, Clegg was also there and when he saw the Star-Telegram showed up, Clegg bonded Jackson out “real quick”. Why is a campaign manager for the former county democratic party chair and candidate for Tarrant Co Judge bailing out a homeless man that was indicted on “a single charge of providing false information on a voting application”? Jackson took a plea deal in April 2019 and was sentenced to 10 days time served despite facing 10 years with “enhancement” due to previous felonies. It is unclear if his listed attorney, Gerard Kardonsky, was a public defender at the time or, if not, who funded his attorney. According to the Ft Worth Star-Telegram, attorneys in the case could not comment after the hearing due to a gag issue previously issued by State District Judge Scott Wisch. Jackson mentions a gag order as well in the footage: Stuart told me not to talk to them (Star-Telegram) and bonded me out and I got put on a gag order.” During his conversation with the officer, Jackson claims that Peoples’ office “hasn’t lost a vote in 11 years…Every time somebody campaigns [with them] they win. 11 years.” For the first time in 56 years, Tarrant County, Texas went “blue” in the 2020 election, the “safest, most secure election ever” as touted by the mockingbird media. While Peoples was serving as the TCDP Chairwoman, she was also one of the individuals who would have been tasked with ensuring these elections were “secure”. Now she is running for the highest elected office in Tarrant County: Tarrant County Judge. |

Pro-Trump Arizona SecState nominee rips deal to delay cleaning voter rolls until after election Pro-Trump Arizona state Rep. Mark Finchem, the GOP nominee for secretary of state, the top statewide elections official, is blasting a court-approved deal to postpone removing nonresidents from state voter rolls until after the high-stakes midterm elections in November. "This is a usurpation of the authority of the legislative branch of government," said Finchem. In a move reminiscent of the 2020 Georgia consent decree before the presidential election, incumbent Democrat Secretary of State Katie Hobbs and Republican Attorney General Mark Brnovich reached an agreement on Monday with a left-leaning nonprofit to put off cleaning the state’s voter rolls until 2023. In 2020, Georgia Republican Secretary of State Brad Raffensperger agreed with state and national Democrats to a consent decree that changed state election rules on signature matching and ballot curing. Former President Donald Trump has repeatedly criticized the Georgia consent decree, claiming it was unconstitutional and, thus, invalidated the 2020 presidential election and the subsequent Senate runoff elections in the state. In the lead-up to the agreement in Arizona, Brnovich, Hobbs, and all the county recorders in the state were sued by the Arizona Asian American Native Hawaiian and Pacific Islander for Equity Coalition on Aug. 16 over state House election integrity bills 2492 and 2243. HB 2492 requires voters to provide proof of citizenship to vote in the state, but it doesn't take effect until Jan. 1, 2023. HB 2243, which is set to take effect on Sept. 24, would amend a voter registration law by canceling the registration of voters who move to another state or don't prove that they are state residents. The nonprofit group filed a preliminary injunction against the latter law on Aug. 25. Last week, a federal judge accepted a joint agreement and proposed order that the coalition had reached with Brnovich, Hobbs, and the county recorders to postpone the enforcement of the voter registration amendment until Jan. 1, 2023. "HB 2243 is a voter purge bill that targets voters of color and naturalized voters in Arizona, which could have had sweeping effects on the upcoming November election," the coalition argued. In its preliminary injunction motion, the coalition group said the secretary of state's position was that the portion of the law canceling voter registration can't be enforced until Jan. 1, 2023, since it amends a portion of H.B. 2492, which doesn't take effect until that date. The agreement approved by the judge is not "an admission of any wrongdoing or liability," nor is it an admission to "any allegations or the validity of any claim asserted in this case," according to the court order. However, the agreement prevents the enforcement of "H.B. 2243 in a manner that would remove any voter's eligibility to vote in the 2022 general election or disqualify any otherwise-valid ballot on the basis of H.B. 2243." It also states that the voter registration amendment won't be enforced until Jan. 1, 2023. Decrying the deal as a "usurpation" of legislative authority, Finchem, a vocal advocate of state election integrity reforms, told Just the News: "This is yet another example of a consent decree that never should've happened, they are substituting executive and judicial branch action for the clear Authority of the legislative branch. "The legislation was implemented to protect the election process, this does nothing but serve to undermine that work on public policy and the legislative authority over election law making pertaining to elections security and fairness." On Monday, Arizona GOP Chairwoman Dr. Kelli Ward retweeted a post about the agreement by Asian Americans Advancing Justice, which is representing the coalition group. "Where is @GeneralBrnovich?" Ward asked. Brnovich was defeated in the Republican U.S. Senate primary last month by the Trump-backed Blake Masters. Arizona state Rep. Delaware Court Strikes Down State’s Voting-by-Mail Law

Barring further judicial or legislative action, the ruling means mail-in voting will not be available in upcoming general elections in Delaware on Nov. 8. Republicans were critical of mail-in voting measures enacted at the height of the pandemic and accused election officials across the country of ignoring the U.S. Constitution and state constitutions by allowing it and promoting it heavily to the public. They claim this departure from the usual election procedures allowed Democrats to cheat. The Democratic-controlled Delaware General Assembly hurriedly passed the voting-by-mail law in June after failing to secure enough Republican support to amend the state constitution to enshrine the policy. Lawmakers previously approved a separate voting-by-mail law during the pandemic in 2020, invoking emergency powers that allowed the statute to escape the usual constitutional scrutiny. But lawmakers did not reference any emergency authority when passing the new law, which allowed the state judge to rule it was unconstitutional. Former U.S. Department of Justice civil rights attorney J. Christian Adams, whose organization launched the legal challenge, hailed the court’s decision. ‘Election Officials Must Follow the Law’ “This ruling upheld the rule of law in Delaware when not long-ago election officials across the country were ignoring the law,” said Adams, president of the Public Interest Legal Foundation (PILF). “This law violated the election protections in Delaware’s Constitution. Election officials must follow the law. When laws are followed, even losers of elections can agree with the outcomes. Consent of the governed increases when the election rules are followed,” Adams said in a statement obtained by The Epoch Times. PILF describes itself as “the nation’s only public interest law firm dedicated wholly to election integrity.” The nonprofit organization “exists to assist states and others to aid the cause of election integrity, and fight against lawlessness in American elections.” The Epoch Times reached out for comment to Delaware Attorney General Kathy Jennings, a Democrat whose office defended the 2022 law in court, but did not immediately receive a reply. PILF filed a lawsuit earlier this year against the vote-by-mail law. The complaint alleged that Delaware’s mail-in voting and same-day registration statutes ran afoul of Delaware’s Constitution. One of the plaintiffs was whistleblower Michael Mennella, who has served as an inspector of elections for the Delaware Department of Elections. In Higgin v. Albence, court file 2022-0641, Vice Chancellor Nathan Cook of the Court of Chancery of the State of Delaware ruled (pdf) that “Article V, Section 4A of the Delaware Constitution … provides for absentee voting in certain enumerated circumstances.” State courts “have consistently stated that those circumstances are exhaustive.” As a trial judge, “I am compelled by precedent to conclude that the Vote-by-Mail Statute’s attempt to expand absentee voting to Delawareans who do not align with any of Section 4A’s categories must be rejected.” Cook turned down the challenge to the state’s same-day registration statute but said the vote-by-mail statute “presents a much thornier issue.” ‘They Abdicated Their Responsibility’ In 2020 as pandemic-era measures curtailing individual liberties took effect, the Delaware Legislature enacted “a very similar vote-by-mail law under its emergency powers, which was upheld by this Court.” But the current statute was not justified as an emergency measure, he wrote, suggesting it did not deserve the same judicial deference. Although the plaintiffs would probably not have standing under federal rules to challenge the mail-in voting law, they do have standing under Delaware law because they “represent various parts of the election process” and “have a substantial interest in this court reaching a decision on the merits, particularly given the fundamental nature of voting,” he wrote. Cook wrote that in light of his ruling on the merits, “there would be irreparable harm in the absence of injunctive relief and that the balance of the equities favors entry of an injunction.” Attorney Jane Brady, who served as co-counsel on the case, told The Associated Press that voting by mail “does not comport with the constitution.” “I believe that the Legislature has known from day one that they needed a constitutional amendment to do this,” she said. “In my view, they abdicated their responsibility.” Brady, a Republican, was attorney general of Delaware from 1995 to 2005. |

Fulton County, Pennsylvania Sues Dominion Voting

On or after November 2020, Fulton County became aware of certain factors and aspects of the Dominion Voting Systems that did not meet the “conditions” for certification set forth in the January 2019 / February 2019 certification report 49. In addition, Fulton County was informed of additional anomalies and problems in Dominion’s “voting” systems via an expert report written by J. Alex Halderman in July 2021. (EXHIBIT C, the Halderman Declaration, September 21, 2021). 50. In his declaration, Halderman described numerous security vulnerabilities in Dominion’s ICX software, including flaws that would allow attackers to install malicious software on the ICX, either with temporary or physical access (such as that of voters in polling places) or remotely from election management systems. EXHIBIT C 52. At the time of that report, the author described that these vulnerabilities still existed, and could be mitigated, but that such mitigation would “take months for Dominion to assess the problems, develop responsive software updates, test them, obtain any necessary approvals from the EAC and state-level certification authorities, and distribute the new software….” 54. The report also notes that the ICX is set to be used in 2022 in at least parts of 16 states, including Pennsylvania, with these vulnerabilities and faults still in place 57. c. There were non-certified database tools installed on the Dominion Voting System; d. There were changes made to EMS three weeks before the 2020 election; and e. There was a lack of commonwealth L&A inspections of the Dominion Voting Systems. 66. …on September 15, 2022, a commissioned report revealed several deficiencies and the absence of information and data that directly implicated and contradicted the contractual terms, conditions, promises, and warranties provided to Fulton County by Dominion in the Agreement and the conditions required for certification in the Dominion Certification Report. 69. The September Report showed that external USB hard drives had been inserted in the machines on several occasions, and that there is no known list of approved external drives that could have been or were used or inserted into the machines. In this regard, the report concluded that there was no way to determine whether and to what extent these unauthorized drives compromised the data or the system. 70. The September Report further concluded that there had been “substantial changes” to the drives as seen with the inclusion of over 900 .dll files and links created since the date of installation of the Dominion software and these pathways constituted a security breach due to the introduction of an unauthorized “script” into the Dominion voting systems used in Fulton County. 71. The September Report found that a “python script” had been installed after the certification date of the system” and not only should such a script not have been added to the system, but “[t]his python script can exploit and create any number of vulnerabilities including, external access to the system, data export of the tabulations, or introduction of other metrics not part of or allowed by the certification process.” Id., ¶ 5. Among other findings, this constituted a direct violation of and failure of the conditions required for certification in the Dominion Certification Report, 72. Each of the drives are “interconnected in a system to one another” and that this would be required to share data and counts between devices. Id., ¶ 6. However, “[b]ecause of this networking, unauthorized access [to] any one device, allowed unauthorized access to any device connected to the network of devices.” Id. Among other findings, this constituted a direct violation of and failure of the conditions required for certification in the Dominion Certification Report 73. The September Report further determined that “[a]n external IP address that is associated with Canada is found on the Adjudication01 [workstation]” and “[t]his shows that at least one of the network devices has connected to an external device on an external network” and that this was the same device that the post-certification python script was found on. Id., ¶ 7. Among other findings, this constituted a direct violation of and failure of the conditions required for certification in the Dominion Certification Report, see EXHIBIT B, pp. 40-50, ¶ C. 74. The log files for the Adjudication device showed an IP address of 172.102.16.22, which derives from a location in Quebec, Canada and that this revealed a serious issue to be connected remotely to a Canadian system 75. The machines and devices only had Windows Defender dating to July 2016 and that no other updates had been made. The report concluded that “viruses or malicious software” created after that date would not be combated by the systems without proper updates. 76. The September Report findings confirmed that many of the “conditions” in the certification report which were required to be met for certification were not met and were not present before, during and after the November 2020 election and up to the present. He was the only Republican poll watcher at an important precinct. Jenkin’s wife, prescient, pre-made lunch for her husband, who then arrived at the polls to begin his 15-hour shift—from 5:30 a.m. to about 9 p.m.—just in time. As a volunteer poll watcher in Virginia, Jenkins would run back and forth between the outdoor ballot box and the in-door voting place, observe the conduct of the election, and report irregularities and violations of the Election Code, if any, to election officials. For his entire life, Jenkins has been somewhat of a model American man: he served in the army, built houses, and loves spending his weekends at church and with family and friends—and wasn’t into politics, at all. But as the battleground blaze simmered at the conclusion of the 2020 election lawsuits, Jenkins still had in his mind the lingering silhouette of Zuckerbucks (private funding in election administration that was allowed in 2020 and now banned in some states), whispers of faulty mail-in ballots, and alleged—later court-confirmed—election law-flaunting. He then thought he could do more for the country as an American. “With the Trump-Biden election, there was so much press on the dishonesty in the election. I thought I would see for myself,” Jenkins told The Epoch Times. “I’m retired now—and I thought, it was time to roll up my sleeves and to go out and to help out.” “I felt like being a poll watcher—even though we didn’t get paid—was an important role,” Jenkins said. “I didn’t really care about the money.” Jenkins is one of many who saw themselves as a part of a movement to defend the integrity of America’s elections, concerned that the 2020 election was not conducted well. Some offered explanations for what went wrong in 2020—some had substantial proof—but none seemed to be able to convince the courts to rule in favor of what they were proposing, which often consisted of flipping the election results for a district, or the Biden presidency altogether. Many realized this, so they pivoted forward. They formed a movement, driven by the belief that citizens should participate in the election process to give rise to transparency, and that accompanying the right to vote is the right to have every legal vote counted—and faulty vote trashed. Ground-up Movement Jenkin’s resolve to act proved fortuitous, because just as Republicans like him across the country decided to become more involved in elections, roads were built to help them do exactly that. Cleta Mitchell, who fought alongside former President Donald Trump in one of the 2020 election lawsuits disputing the election results in Georgia, was getting a lot of calls—and a lot of ideas—following the 2020 election. “What has happened in 2020 was that many people across the country realized that things were not right, and that the election was not conducted according to law in many cases,” Mitchell told The Epoch Times. “And so a lot of people have said, ‘What can I do to help? What can we do to make sure this doesn’t ever happen again?’” “As somebody who spent a lot of time in a lot of different aspects of the election, I’ve tried to say, here are things you can do: You can go to rallies and have somebody get yelled at,” Mitchell said. “Or, we can train you. We can tell you what you need to do to make sure it never happens again. And there’s plenty to do.” Mitchell, a seasoned lawyer with a swath of experience in all corners of election issues (and a Democrat-turned-Republican), leads the Election Integrity Network, a project of the Conservative Partnership Institute, a Washington-based non-profit. Since its launch, the network developed into a nationwide mobilization base and knowledge-sharing platform that operates at national, state, and local levels to work on election integrity initiatives, such as pushing legislation for voting security, hiring more poll watchers and election officials, and examining potential loopholes in election administration processes. Through training and discussion “summits,” the network has kicked off state-level “coalitions” across the country, and these state coalitions would then become the headquarters of mobilizing precinct-level task forces in that state to work on election integrity projects. “Ultimately, all elections take place at the local level,” Mitchell said when asked about her vision for launching the network. “We are asking people to become involved in apparatus at their local level, because that’s where the elections take place. And that’s where many of the problems occur, because that’s where the voting takes place.” Getting to Work The Election Integrity Network started humbly with weekly telephone calls, during which state coalition leaders in various battleground states would bounce ideas off of each other on how to improve election security and share the issues they spot. But things quickly picked up speed when Lynn Taylor, a regular on these calls who leads Virginia Fair Elections, a state-level coalition in Virginia, saw that time is cutting short for her state. “Virginia is one of two states that have statewide elections every year, Virginia and New Jersey,” Taylor said in an interview with The Epoch Times, sharing how she was concerned about the way the 2020 election was run and wanted to help improve the security of the 2021 election—the question now is how. “The idea came from Cleta when she and I were on the phone together, and she said, ‘you really need a summit,’” Taylor said, recounting her conversation with Mitchell. “I said, ‘I don’t have the budget for that,’ and she said, ‘I do.’ Two and a half weeks later, we had a summit.” “This was very different from the way that things had been done,” Taylor said. “You know, people have been having summits for ages, but this is the first one in my years that we actually use it for training purposes.” With the help of Mitchell and the Election Integrity Network, Taylor organized the network’s first “Election Integrity Summit” in August 2021 in Virginia. The two-day event featured election integrity training and information for grassroots who wanted to help improve election security. These included poll observers’ recruitment, scheduling, training, and administration; a project to document potential illegal voter registrations; and a discussion on the alleged influence of private funding in the 2020 election. During the summit, people who had already been working on related initiatives—improving security around the ballot box, analyzing election data for potential anomalies, or pushing for election integrity legislation, for example—found others scattered across Virginia working on similar things, and quickly fused into local work groups called “Election Integrity Task Forces” and began collaborating on projects on a county basis. “The coalition was how you get involved. You work on a county basis. Then you come up to the state coalition to bring your questions … to see if other counties are running into the same things,” Taylor said, recounting how there were a little more than a dozen task forces in the state during the time of the summit, a number that quadrupled to more than 50 in a few months. “I’ve been doing this for 26 years, and I’ve never seen people come together where they all left their logos at the door,” Taylor said. “They are more interested in the election integrity issue—and making sure that there are free and fair elections—than they are in promoting their own agenda. It is the first time I have ever seen this—in the 26 years that I’ve been working in the nonprofit arena.” Shelley Oberlander, a Republican Precinct Captain for ten years, was leading a local election integrity task force in the Virginia coalition. After learning from the summit about the election integrity projects that she could start in her county, Oberlander started to expand her team. After the summit, Oberlander connected with other county-level task forces and had weekly conference calls to share their experiences. Within a year, Oberlander’s team grew from a few members to six work groups, each specializing in areas of election integrity including legislation, education, data analysis, election technology, and voter administration. “We brought it home, we put it in practice, and we got it going,” Oberlander said in an interview with The Epoch Times. A Helpful Hand The backstory to Oberlander’s involvement in this grassroots election integrity movement is illustrative of the other driving force behind the movement: the Republican National Committee (RNC). As a member of a county-level GOP, Oberlander started the local election integrity team in the Loudoun County GOP at the calling of the state-level GOP, the Virginia GOP, which operates joint forces with the RNC earlier this year and started an election integrity program. Earlier this year, the Virginia GOP sent out a marching order to county-level Republican units in the state asking them to start election integrity teams. “The RNC and Virginia GOP are encouraging unit chairs to hone in on local election integrity efforts,” Emma Vaughn, an RNC spokesperson, told The Epoch Times in a statement. In other words, Oberlander, as a part of the Republican Party, was able to utilize resources within the GOP establishment, as well as the Election Integrity Network to expand her task force and knowledge base. But the RNC wasn’t always able to do this, as its hands were only recently freed. The RNC, the powerhouse and teller machine of Republican initiatives, was legally barred from organizing and sponsoring ballot security operations like poll watching from 1982 to 2018, due to a 1982 consent decree (pdf) issued by Dickinson R. Debevoise, a judge appointed by former U.S. President Jimmy Carter. This has been consequential. The consent decree meant that for nearly 40 years, the Democratic National Committee had a structural advantage over the RNC in strategizing and developing election administration infrastructure in accordance with its vision of how voting should be done. “Because of the DNC v. RNC Consent Decree, the RNC had been shut out of most election integrity efforts for nearly four decades, which led to a lack of institutional knowledge to conduct election integrity operations,” the RNC’s 2021 election integrity report reads (pdf). After the consent decree expired in 2018, the RNC began building infrastructure around election integrity projects. This includes spending more than 30 million on election protection efforts in battleground states across the country during the 2021 cycle, and continued building election security infrastructure for the 2022 cycle, Vaughn told The Epoch Times. “The RNC has made a multi-million-dollar investment for the 2022 cycle, including 17 state Election Integrity directors, 35 in-state election integrity counsels, and in recruiting over 43,000 poll workers and poll watchers in battleground states across the country,” Vaughn wrote in a statement. “The RNC works with other groups who have an interest in promoting election integrity but the party’s efforts are independent from any outside organization,” Vaughn wrote. The Movement Ripples The Election Integrity Network’s success in Virginia, which Mitchell calls the “Virginia model,” was promptly replicated in other states. By mid-2022, the Election Integrity Network held summits in eight battleground states—Virginia, Georgia, Arizona, Florida, Pennsylvania, Michigan, Wisconsin, and North Carolina—and mobilized thousands to start election integrity projects at the local level, according to Mitchell. “What we are focused on is building out the infrastructure—creating state coalitions and local election integrity task forces,” Mitchell said. “We really are measuring our success by the number of states who are up and running with statewide election integrity coalitions. “We measure that by helping them bring together the various groups to have weekly calls, then getting their local task forces going and then getting a framework for recruiting and training poll workers, election officials and starting the working groups within each state,” Mitchell said. According to Marshall Yates, Executive Director of the network, the network’s state-level conference calls in North Carolina, Michigan, and Georgia had over 75 in attendance, and Arizona and Pennsylvania had about 40 in attendance. The attendees are like Oberlander: they mostly consist of task force leaders who would put what they learned in the calls into practice at their local counties. Even Congress hopped on. “She’s a lawyer and has a lot of experience and knowledge, and she’s dogged on this,” Rep. Claudia Tenney (R-N.Y.), who heads the Election Integrity Caucus with more than 70 Republican members, said of Mitchell in an interview with The Epoch Times. Tenney participates in the Election Integrity Network’s conference calls when she has time and has passed around some of the network’s materials around Congress. “We go through with a very methodical legal analysis, and that’s what she does, which I really appreciate,” Tenney said. “We’re trying to set the record straight, and come up with solutions. We just want to make sure that people feel confident and trust their vote.” The Bigger Picture: Uneven Playing Field An important pretext for the project, according to Mitchell, is that the left has been building infrastructure around election administration and attempting to influence election outcomes with more effort and conviction than those of the right. “We need conservatives to become involved and engage in the process—because the left has been systematically building their own infrastructure,” Mitchell told The Epoch Times. Underlying this infrastructure-building Mitchell was referring to are two competing ideologies, one held by the right and another by the left, on how voting rights should be protected in a democratic society. As articulated by J. Kenneth Blackwell and Kenneth A. Klukowski in a paper (pdf) in the Yale Law & Policy Review, improving access to voting (making voting more convenient) and improving ballot security (placing more burden on the individual voter but prioritizing the integrity of the voting process) often come into tension. The left leans toward the access approach, and the right leans toward the security approach. “The voting system, by necessity, requires a balancing of these somewhat countervailing interests,” the paper reads. As evidence that this balance is tilted disproportionately towards the left’s agenda, Mitchell pointed to reports by Capital Research Center (CRC), which allege a “coordinated effort” by the left to influence elections via private donations and dark money networks, such as the Arabella Advisors, the Rockefeller Foundation, and Facebook CEO Mark Zuckerberg’s left-leaning non-profit, the Center for Tech and Civic Life (CTCL). The Epoch Times has reached out to the Arabella Advisors, the Rockefeller Foundation, and the Center for Tech and Civic Life for comments. Notably, Zuckerberg and his wife, Priscilla Chan, funneled via the CTCL $400 million to a network of nonprofits that sent advisers to local election offices across the country to become directly involved in election administration in 2020. Critics of the CTCL like Mitchell say its maneuvers are outright election manipulation. The CRC wrote in an analysis that CTCL “consistently gave bigger grants and more money per capita to counties that voted for Biden.” The CTCL’s advisory services to local election offices were often provided in conjunction with left-leaning organizations, such as the Brennan Center for Justice. The CRC reported in August that this kind of private funding in election administration had been banned in 24 states. But the tilted balance goes beyond Zuckerbucks. Open Secrets, a non-profit research group tracking political financing, estimated in a March 2021 report that $447 million of “dark money”—political donations with undisclosed sources—supported liberal groups at the federal level during the 2020 election cycle, while only $190 million supported conservative groups. ‘Something They Will Never Have’ According to Mitchell, however, notwithstanding the uneven playing field in favor of the left, conservatives have “something they will never have.” “Conservatives and patriots who believe in election integrity and the rule of law—the many volunteers who form the Election Integrity Network—will never have the money the left-wing billionaires have dedicated to building their sprawling election disruption enterprise,” Mitchell said. “We will never have the sheer number of entities as the left has built over the past decade.” “But we have something they will never have: an army of citizen patriots who love America, and are tirelessly dedicated to becoming an integral part of the election process at every local election office in the nation—who are intent upon saving and preserving our Constitutional Republic—that is the mission of the Election Integrity Network and the thousands of volunteers across the country who are part of this mission,” Mitchell added. “That’s why Conservative Partnership Institute is proud to have launched the Election Integrity Network and why we continue to support and grow it.” |

But at Wednesday night’s city council meeting, Brown announced she would be stepping down at the end of the month.” On Sept. 6, two days before giving her three-week notice, the clerk and a who’s-who list of Flint officials received a demand letter. Either balance the city’s skewed number of election inspectors from 92% Democrat and 6% Republican to 50-50 or brace for legal filings stated the letter from Pure Integrity Michigan Elections and Attorney Erick Kaardal, Special Counsel for the Thomas More Society. So, was the 25-year-veteran clerk’s resignation coincidence? “I think not,” said Patrice Johnson, chair of PIME. “This is a huge win.” Still, the clerk’s resignation raises questions as to how Flint will fill the vacancy. According to the NPR article, Flint has asked the Secretary of State to help with the approaching November elections. “How is it that Flint could have such a weak bench that no underlings can fill a departing clerk’s shoes?” Johnson asked. According to Michigan law, the conduct of the elections falls under the purview of county, township, or municipal clerks. The City of Flint is part of Flint Township, so asking for the township’s assistance is the next logical step. If not the township, then why not have Genesee County lend a hand? Johnson, who hails from the corporate business world, explained that when a CEO departs in a rush, companies typically elevate an employee or contract outside leadership on a temporary basis. Turning the city’s elections over to the state seems too great a leap. “It’s equivalent to a large corporation handing the reins over to the Federal Trade Commission.” If a person is running for office, the law states that person is prohibited from serving as an election inspector in the precinct in which he or she is running. It seems the same concept should apply for a secretary of state running for re-election. The PIME/Thomas More Society Demand Letter stated in no uncertain terms, that “the City of Flint cease and desist spending taxpayer funds on its election inspector operations for the November 8, 2022, mid-term elections until it comes into legal compliance with the legally-required party balance for election inspectors in Flint. Michigan Compiled Laws § 168.674(2)” “Flint for the August primary had approximately 481 election inspectors: 442 Democratic election inspectors, only 27 Republican election inspectors, and 12 other/unidentified party affiliation inspectors. The following pie chart demonstrates the stark differences in party affiliation (92% Democrat to 6% Republican).” Now the question becomes whether Secretary of State Benson, who is up for re-election, can impartially administer an election. Johnson suggested the Flint City Council consider hiring a new clerk who possessed the following qualifications: A commitment to achieving and maintaining a 50-50 party balance for election inspectors An unbiased, nonpartisan position and a willingness to do what it takes to facilitate fair and honest elections A functional understanding of Michigan and Federal election law and know how to access the laws as needed for reference. Upgrading election management system approved WASHINGTON COUNTY — The Washington County Executive Committee voted to upgrade the county’s election management system, and to do a full recount of select state and federal elections, during their meeting on Wednesday. “What we’re looking at doing is beginning to program all of our elections here, in-house, rather than contracting with [Dominion Voting Systems] as we have in the past,” said Washington County Clerk Ashley Reichert. According to Reichert, her predecessor had previously programmed the election machines used by the county in-house, until April of 2016 when they had decided to switch to Dominion voting machines and contract the work out through Dominion. Currently, the county has the “lite” version of the software used for the voting machines, and would need to pay for upgrading to the full version so they can start programming the machines in-house again. The county will be able to use the same voting machines with the full version of the program. “It’s the same software, it’s just a program that gives me the capability of inputting all of the data that I compile already,” said Reichert. “Then I’m able to actually put it all together and finalize it all rather than having Dominion do so.” The cost of upgrading the software and training staff is estimated to be up to $75,000, according to the committee report. Reichert said this will also lead to ongoing expenses for the county for increased fees, but they will be included in her budget moving forward and would go through a budget amendment in the future. According to Reichert, one of the fee increases is $11,000 more than the county currently pays. The other is for $20,000 for training and support in programming as they switch to doing it in-house, but it will only be for a year or so. “I think this is something that Ashley should be commended for. I think anything we can do to pull things away from Dominion and have more control, and Ashley, who I think does a phenomenal job, to be able to have her hands on it, is a positive,” said County Executive Josh Schoemann. “I’d like to also echo those same comments. I think we need to make our public aware that we’re bringing so much more of this control in-house, inside the county,” said County Supervisor Caroll Merry. The committee voted unanimously to approve the use of up to $75,000 in strategic priority funds to upgrade the county’s election system management software. The committee then voted on doing a full recount by hand of the governor, lieutenant governor and U.S. senator elections in the general election on Nov. 8. According to Reichert, the county audits every election held, by choice. Normally, the county will randomly select two reporting units in the county and then hand-count the ballots in two of the races in the election and compare the results with the voting machine tabulations. “What we are suggesting doing for the 2022 general election is hand-counting the entire county as a part of an audit doing the top state race and the top federal race, which would be governor, lieutenant governor and then the U.S. Senate race, and hand-counting all of those,” said Reichert. According to Reichert, the expense of the recount is up to $50,000, and would be paid for by the county and not the individual municipalities. The funding would come out of the strategic priority fund. She added that she doesn’t believe the recount would cost the full $50,000, as in 2016 the full recount cost roughly $36,000. “Here again, I think we need to commend the clerk’s office for taking a step forward on this,” said Merry. “Just another effort to reassure the voters of Washington County that we’re trying to stay ahead of any potential fraud.” He added that it is important to show that Washington County is doing everything they can to ensure voter integrity. “We take voter integrity, election integrity, seriously,” added County Supervisor Jodi Schulteis. The committee voted unanimously to approve the use of up to $50,000 in strategic priority funds to be used for a full recount of the governor, lieutenant governor and U.S. Senate races by hand. County Supervisor Chris Bossert recused himself from discussion and voting on the hand recount matter, because he is a poll worker for West Bend. The Executive Committee’s next meeting will be held at 4 p.m. on Oct. 19 in the Herbert J. Tennies Government Center, and it will be live streamed on the county’s YouTube channel. |
