Agreed.

Plus with the Republicans controlling the Senate and House, Obungo can nominate all kinds of liberals but they won't be confirmed.


Don't ever put anything past the Republicans. Also, the House has nothing to do with confirming appointments.

The best thing that could happen for us, if she dies or retires, would be for Obama to appoint Holder. Holder is so toxic the Republicans might actually block his nomination.

Can't do a recess appointment if the senate never goes into recess.  Supreme Court already decided against Obama on that with the FLRB appointments.  Senate kept in session is up to the senate to decide whether they are in recess.

Both George Washington and Eisenhower made recess appointments to the Supreme Court.

But the Senate can block recess appointments by never recessing and simply adjourning.

There have been 4-4 votes based on recusals.  That means an affirmamce of the lower court ruling.
