He didn't do the RIGHT thing. He made a foolish decision. The RIGHT thing might have been a decent price to help out a family member/BF. If the BF had been a regular Joe it would have been SLIGHTLY different, but even then sisters BF and Payments.... Never a good idea. But with a recovering Meth/Alcoholic PUHLEAZE. Hell if it was just a recovering meth head it would be one thing, It is concievable that you got hooked trying something stupid at a party or some such. But 2 drug addictions shows serious personality damage. And should be a HUGE warning sign for any type of relations. Want to help someone getting on their feet fine, but putting your self on the line to the tune of $3500 for a person who has known drug problems AND is some how attached to family is a BAD idea. Hell I gave my brother $400 bucks once, never expecting it paid back, hell told him it was a gift and one time, and he always comes around asking for money. Answer is always no. And he is NOT addicted to any drugs and is a stand up guy. Money and family DON'T mix. Money, Family, and drug addicted no matter how much recovered BF's REALLY doesn't mix Best thing for the OP is the car is titled in the douche bags name not his otherwise he would face a possible lawsuit. With that though consider $3500 cheap. ETA: Unless you get a lawyer I highly doubt that you will be able to collect. All kinds of ways that contract could get thrown out. Hey I hope you are able. But I would chalk it up to a loss and move on. Otherwise get a couple bottles of Tumms and fight for it. But I doubt the insurance company will payout especially considering he was involved in comitting a crime that lead to the accident. |

i understand your point and it is fair, but i had some family loan me money when i was a teenager and not a good candidate for paying it back. i proved them wrong but the point is we have all made bad decisons. and alot of us would not be where we are now had not someone taken a gamble on us. Chris made a gamble, and i am sorry it did not work out, but remember, someone at some point has given us the benefit of the doubt, and we have done the better for it |

There is a BIG difference between a teenager and an adult drug addict, in recovery or not. Hell OP is a decent guy and I'm sorry he got burned. Sorry to see a Mustang killed by a meth head too. A drug addict is not "someone who made a bad decision" That is the girl who gets knocked up on prom or the kid stealing a pack of gum. A drug addict is a person who is a hsitory of making REALLY bad decisions for a substantial amount of time and shows that they can not be trusted. And Hell I am TOTALLY against the War on SOME Drugs and think they should all be legal. But an addict is ALWAYS an addict. Hell watching TV for 30 years has taught me that. OP made a bad choice and is obveiously a GOOD GUY. I give him kudos for posting this. If I did such a bone headed thing I would be too ashamed to tell anyone. |

Contact the D.A.'s office, bring them a copy of the contract, and make the $3500 part of the victim's restitution that he will have to pay.

When he gets out of jail, ask him when he'll be paying you. As soon as he makes excuses, ducks you, etc. haul him into small claims court. It's worth a try. |

Talk to an attorney or your local legal aid for advice. You can probably file a lien against some property he owns since, in effect, he financed the vehicle through you (you gave him a loan per your contract). I mean, that's how it looks to me. I'm not giving any legal advice other than you should consult a lawyer. I don't think it's necessary to call you stupid. I have little doubt you don't feel that anyway.

Life lesson learned, BUT what you could have done transfer the title to him (them?), but include you as a lien holder (since it wasnt paid off)... That way the insurance would pay YOU off OR you atleast could repossess the car and try to resell it.. good luck.. but you are probably out the jack.. Brian |

Sorry to pile on, but not a good move on your part. I've never known a meth-head to leave cash lying around, so I don't know when you thought you'd be getting paid. You should have made him save up and pay cash. You just learned the lesson the hard way that there is no such thing as having faith in a meth-head IMO.

Did you record a lien on the title of the vehicle when you transfered it to him? Any check for damages (especially of the vehicle is totaled) from the insurance company would then be made payable to both the owner AND the lien holder. |

If the insurance company will recogonize your contract with him, you'll probably be OK.
You shouldn't have given him the title, though. Tim The Enchanter said it first, and I thought the same thing...Don't associate with drug users! It really is as simple as that. I've made mistakes like yours, but on a smaller scale. When the next "Have you ever dated someone that's Bi-polar?" thread comes up again, I'll share my horror story. Stop listening to any advice your mother and sister gives you. They are not looking out for your best interests. |

Very inexpensive lesson on the grand scale.Accept it at face value and move on.
IF(big if) the insurance pays off he will.... (A) use the money for lawyer to keep his ass out of jail (B) use the money to run from the law (C) buy a bunch of meth with the intention of paying lawyer and you with profit(which of course there will be none)and get arrested in the process. (D) do his 90 days in county, get out have big party with the money,get your sister pregnant, beat her up and then leave But under NO circumstances will he ever pay you. I loaned my sister and her husband $2000 once. Never got paid back. Turns out he was, and still is an alcoholic and a bit of a bs'er. My wife is STILL mad that my sister has never apologized about it to us. They had 3 kids so when they split up it wasn't easy for her. All in all a cheap lesson. At least I didn't loan them $20K for a down on a house last year or something really stupid like that.

Seriously, just walk away from the whole affair. I would not expose myself to any potential liability by trying to make a claim on the car. You can just about bet that the owners of the Tahoe are screaming mad and they are going to be looking for blood, it would probabally be best not to give their lawers another potential target.
The only thing I would do from now on would be to try to get your sister to go into a program, psychologist or something along those lines. Given her associations I would not be surprised if she doesnt have a substance abuse problem herself or at least some serious self esteem issues. |

Thanks man. Pretty sound advice and interpretation of what has happened/ I did. I generally, do not loan anything to anyone, but my mom and sister kind of talked me into this one... ultimately it was my decision and I guess I just pushed over easily... He had previously done a deal like what we had originally agreed upon, w/ my parents for another vehicle last year and had no problems what so ever. |

Yep...... That was a stupid move.
Almost as stupid as me giving key access to a recovering heroine addict. Hell. He had been clean a year. right? I had to take our company's work truck back at gun point, after his father told me where he scores. No damage.... Thank God.... He had the truck for 14 hours before I found him. It was almost out of gas. He had 2 "friends" with him. I left them on the street off of Ross and Henderson in Dallas. |
