Maybe you should read the article.  The defendent had two appeals, one that said the death penalty was racist, another saying it was cruel and unusual.  The Court already rejected the racism argument before Alito was even put on the bench.  They only did the stay for the cruel and unusual argument, not the racism.

Has a convicted black criminal EVER not cited race?  It is the ace in the hole to get liberal democrats and the black community fired up.  MO will ultimately rule that lethal injection is not cruel and unusual punishment, and he will die...but not before he buys himself a little more time and spends a few million dollars more of the racists' money.  The real fucking travesty here is not Alito's non-decision, it is that this animal committed this crime SEVENTEEN YEARS AGO and he's still alive.  After a ruling, an appeal, a second ruling, and yet another appeal, he will then die.  This animal will have lived for 25 years at our expense with a higher quality of life than he would have had.
