It's no wonder there never seems to be enough money in the city/county coffers to give police and firemen men their needed raises, with Prosecutors wasting taxpayer money like this it now becomes understandable.

I just caught this one - if you're not done with it already, good luck. Let us know what happens or if we can do anything. I really can't believe this has actualy gotten this far. In the city, I've seen high grade drug felonies dropped to misdemeanors or violations for a plea. |

Sorry to post this update a day after the fact, I had to finish some work after court and when I got back I was so wiped out that I fell asleep at the keyboard while attempting to post this last night. My apologies for the delay. Here are some details from the hearing: First I went in at 11:00 am and found out that we had a different judge who was not familiar with my case yet, so she requested a sidebar and then we adjurned untill 2:00 pm. During the break my lawyer tried to get some kind of offer from the DA, but they flatly refused, citing past offenses as the reason, even though they were nearly ten years old. My lawyer now had all of the police files, 911 report and evidence taken from the evening in question which he got through discovery. My attorney gave me a copy of every police report including the statement from the 911 caller and he asked me to check for any discrepencies. My jaw nearly hit the floor on page one of the report made by the first LEO on the scene. As I read on, my anger was nearly uncontrollable! It was a very good thing that I read this outside the courtroom. I will ask my lawyer for my own copies so I can post them here to show you how they tried to twist things around and also to show exactly how little they know about guns and gun laws. The hearing went very good and during the intermission, my attorney along with the DA hammered out a deal that I couldn't turn down. The misdemeanor charge of criminal posession of a weapon in the fourth degree was dropped down to a mere violation that carried a maximum fine of $250. The judge only fined me $150 and the rest of the deal includes having the records of this incident sealed from the public, and my fingerprints and photos will be purged from the system and destroyed. My attorney advised me that the mapp hearing, if we went foward with it, would take at least two appearances at a cost well beyond my means as this whole incident has already cost me thousands of dollars that I didn't even have. The moral to this story is that justice is not only blind, but very expensive too. My apologies to those who feel like I let them down by taking the offer, I feel just as bad about this. I really wanted to go through with the hearing , but I will try to get some retribution in a civil suit now that the criminal charge was dropped. My sincere thanks goes out to the incredible group of people that make up AR15.com, it's ranks and staff alike. You made this insanity bearable and you gave me plenty of help as well as excellent legal advice and moral support. Thank you one and all. Awesome. I don't think anyone here can blame you for taking the offer. If they want to pay out their ass to prove a point then maybe they have the means to do it themselves. Maybe sometime you can post the details of the whole fiasco for those of us that did not catch the original posts before they were deleted. I followed as well as I could but there was a lot of info missing by then...

I'm thinking I'm not too far out of line when I ask on behalf of everyone who's been following this debacle from the outset if you wouldn't please reconsider acceping some monetary assistance from all of us to offset the legal fees you've racked up. As Ben Franklin said, "We must all hang together, or we shall surely hang separately." Don't think of it as charity, but as an opportunity to strengthen the unity of those of us in the gun culture. Glad to hear that you avoided a much harsher sentence. Didn't I read earlier that you were going to move from there once this was over? Could really suck if someone decides they have an axe to grind against you cause you "got off". Glad to hear it is over.

Glad to hear that things worked out to your satisfaction.
Make sure that the order of the court to seal and expunge the records is carried out. The NRPD has to request that the records be returned from the FBI and the NYS DCJS. Do not let this slide. It could come back to haunt you years from now. |

I am greatly relieve to hear of your victory. While it may seem a little "tainted" to have made a "deal with the Devil," you still went home that night with your family, you have your freedom (what's left of it that we all share,) and you have potentially set a precedent for those who come after. I don't think less of you for accepting - isn't a violation pretty much a non-issue after you pay the fine anyhow? It will still stand as a precedent for those "in the know" and may help someone else. Sometimes, the good guys win. Thank you for letting us be a part of your victory. Congrats. You have been an inspiration to us all. We can only hope that we would have the self control that you have shown. I for one, think you were smart for taking the offer. You fought injustice to a draw. Not bad, considering you fought by their rules, and on their turf. If you are accepting donations for a civil suit, please let us know. If it would make you more willing to accept the donations, you could pay them back later with the proceeds if successful.

Keep in mind that they are the ones playing from a position of strength and whenever they offer a deal its because they know they cant win! They offer deals to save face and make the public believe that they accomplished something. YOU DID GOOD!

As far as the deal, I would've done the same thing. You gotta make the best, most practical call. Sometimes (oftentimes?), idealism can be stupid & impractical. Better to take a small, insignificant hit & live to fight it out later. Being in jail would be a distinct disadvantage. Now you can focus on a civil suit. That's where you can force some accountability onto their shoulders. Exploit whatever deceptive, misleading/false statements that were made, & run them through the meatgrinder. The complaint was ludicrous, but the way it was handled was downright stupid. They picked a fight, so take it to them - legally. I hope they live to regeret having ever been on shift that day - "Should've called in sick, Barney!" The only other concern is whether [b]you lost your RKBA[/b]??? If not, then you'll live. [;)] |

It is difficult for me to believe that this ordeal is actually over. I paid the fine right after the judge dismissed the case, just to make sure that they had nothing more to hold over me. During the last five months I had to be very carefull to make sure that I didn't even get a parking ticket or they would have had a field day in court turning my life into that of a common criminal. For some reason I still feel a little nervous when a local police cruiser gets behind me and stays there for several blocks. Maybee I am a little paranoid, but this will go away with time. Next for me will be some trigger time when I go to PA for a few days. My wife planned on buying me a F**K YOU gun, but that will have to wait a little while. This gun will be our little way of saying that we have the right to buy/own guns even in NY, and nothing you can do will stop us from enjoying this major part of our lives. My entire family is greatfull for being part of this group of fine people. Thank you......Dominick
