I contacted a seller about an item he has for sale, asking if they were still available. He replied that they were. I offered him an amount lower than what he had listed and he declined. I then sent a response saying I'd take it for his listed price. He has yet to respond (over 24 hours).
I ask, "deal or no deal" based on rule #17, specifically the bold portion below.
Sellers must not post items for sale that you do not have in their possession. Also, do not list items for sale unless you are 100% positive that you wish to sell them. No "testing the waters" to gauge buyer interest or taking pre-orders. This includes no sales for third parties. If your "friend" wishes to sell here, he must take the time to open a separate account. Refrain from posting personal info in ads, such as phone numbers and email addresses.
He posted an item for sale and I said I'd take it, in PM and in his ad. Is that a deal? Is the seller obligated to check back every now and then to see if they have PMs or posts in their ad claiming the items they're selling? I guess in reality there's no way to make a seller check back on their ads, but could they be banned from the EE?
