Yes on the wins,

Marlins current gun lever guns have shallow Ballard rifling, and you end up having to size casted bullet about .01~.003" larger than normal to shoot well in them.

The only really draw back between a Win and Marlin 1894, is on the Win, lot harder to pull the bolt/lever to get the rifle down for a detail cleaning, while on the Marlin, you just remove the lever screw with the lever about half way unclocked, the lever will pull out, and the bolt pulls back out of the action.  So when cleaning the marlin since the bolt will pull straight back out of the receiver via just removing the lever bolt, allows you to use clean the chamber and barrel from the chamber side of the action.

So unless you are planning on shooting BP loads through the rig, which you will need to detail strip and clean the rifle right afterwards to prevent the rifle from rusting from the inside out, will be much happier with the Win.

Don't get me wrong, since the marlin rifle's can be made nice, have a shorter/smoother lever stroke then the Wins, it just out of the box without a major action job, will be happier with the Win isntead.

Also, since Remington just went into bankruptcy, will be on the auction block soon since it major debit credit holders are moving away from firearm producer companies (Citigroup and JP Morgan).
