Rare Breed is trying to get the case dismissed for lack of jurisdiction. The ATF is using banking records to establish jurisdiction in the Eastern District if NY. No decision yet.

Judge Morrison wants to transfer the case out of the Eastern District of New York to one where the parties can agree on personal jurisdiction and venue. She ordered the parties to submit letters by March 29 with districts and by April 1 objecting to the other side's list.

MINUTE ENTRY and ORDER. A video status conference was held before Judge Morrison on April 4, 2023. Michael Blume, Joseph Marutollo, and Paulina Stamatelos appeared on behalf of Plaintiff. Caleb Kruckenberg and Steve Simpson appeared on behalf of Defendants. The Court inquired into Defendants' request for an evidentiary hearing in light of Plaintiff's recent submissions bearing on Defendants' motion to dismiss for lack of personal jurisdiction. The Court directed Defendants to file a letter on or before April 5, 2023 at 6:00 p.m. EST informing the Court whether they wish to withdraw their motion to dismiss for lack personal jurisdiction and instead ask the Court to consider only whether this action should be transferred to a new forum. Since issuing that directive, Defendants have so filed 44 . Defendants' motion to dismiss for lack of personal jurisdiction 23 is therefore dismissed without prejudice. The Court shall construe Defendants' responses to the Court's Order to Show Cause 36 as a motion to transfer venue to the Western District of Texas, and Plaintiff's letter briefs its response to Defendants' motion. That motion remains pending. In the meantime, the parties shall proceed to merits discovery. Motions related to discovery may be addressed to Judge Morrison in the first instance. Regarding the "is it a machine gun" question:
Although the Court reached this conclusion on a TRO posture, Defendants argue in part that the FRT-15 is in fact not a machinegun under relevant statutes and regulations, and that Defendants’ statements about their products do not constitute fraud. The Court has not reached the merits of these claims, and it has scheduled a hearing on the Government’s motion for a preliminary injunction for May 31 and June 1, 2023. In the meantime, while merits discovery and briefing are pending, Defendants have consented to an extension of this Court’s temporary restraining order until June 30, 2023, or until the Court rules on the Government’s motion for a preliminary injunction, whichever is sooner. Well, now we know why they have been door knocking.
The Government informed the Court that, after contacting USPS for its records related to packages that Defendants have sent to New York, ATF agents interviewed the packages’ addressees, several of whom reportedly stated that they purchased FRT- 15s or FRT-15 parts in New York directly from Defendants RBT and RBF. Id. ¶¶ 5- 22, 36. Some of these customers stated that it was necessary to purchase certain replacement parts for the FRT-15 because “reviews online” suggested that those parts “were susceptible to breaking.” |

May 7 2023 - In light of the Government's letter 54, all third-party discovery shall be produced to Assistant United States Attorney Philip DePaul. The Court concludes that this arrangement is less likely to lead to inadvertent production to counsel for the Government in this action than directing third-party discovery to be produced to another United States Attorney's Office. The Government shall immediately contact those parties already served with subpoenas with this order and provide those parties with the information necessary to produce discovery to Mr. DePaul. The Government attorneys and staff assigned to this case shall not have access to any aspect of these third-party production(s) until further order of the Court. Ordered by Judge Nina R. Got a similar letter today, I bought one a couple years ago off Gunbroker. My letter calls out specifically GB and I guess the seller who sold me it, but it was like 2 maybe 3 years ago I got it. I think I traded it for an Eotech over a year ago. I am going to be curious to see what happens now. I guess at some point I may get a knock on the door.

The ATF are busy around here calling for their WOT to be turned in. Heard today they are now visiting dealers for selling them. I personally know two people that have turned theirs in already. Was told the ATF said that they used shippers records to track the triggers down.
