It's even more difficult to prosecute than that...
The state would have to prove
you assembled it.
It doesn't matter if something is possessed without regard to 922(r) rules unless you're the individual who assembled it that way.
Also if you're the government (including LE) and you assembled (or had it assembled) for official use, it's exempted from 922(r) by
925.
The burden of proof is on the government to prove otherwise. It's so difficult, they rarely attempt it.
I don't actually know of a prosecution that was argued in court, so I assume most were plea deals (as an add-on charge).
