Yesterday, a bill recognizing South Dakota's freedom to legally carry a concealed firearm without the burdensome requirement of acquiring a concealed pistol permit was introduced in the House of Representatives.  Authored by Representative Jim Stalzer (R-11), House Bill 1116 is an important reform to current South Dakota law.

HB 1116 is a necessary update to concealed carry statutes in South Dakota, allowing law-abiding gun owners the ability to protect themselves and their loved ones.  In South Dakota, it is already legal to carry a firearm openly, as long as the individual is not prohibited by law from possessing a firearm.  However, under current law, if a firearm becomes covered by a coat or if a woman prefers to carry a firearm for self-protection in her purse, one would need to possess a concealed pistol permit.

South Dakota's permit is hardly what I'd call burdensome, but I'll be contacting my representatives to urge them to support this. Thanks for posting this. I hadn't even heard about it.

I have mixed feelings about constitutional carry in SD. While on one hand, that's just the way it's supposed to be. On the other hand, it makes traveling out of state a pain in the ass. You have to spend a good bit more time & money getting a non-res permit from another state to carry while traveling.

No they are still going to issue permits just so you can get one for travel.

This is what I'm really hoping gets passed:

HB 1096

Pending BATFE approval if it passes, it would allow SD CCW permit holders to bypass NICS checks when purchasing a firearm.

I am one of those guys that gets "delayed" 100% of the time and it's extremely annoying. Sometimes I get approved after a couple of days, sometimes they don't ever respond.

Alright so explain this to me, I've never been good at understanding legislature. Unsure if anything has or hasn't passed.

They are trying to make it legal so ANYONE can carry a firearm without going to the courthouse and getting a permit?

If you pass the background check to buy a firearm the first time, the next time you don't need a do the background check? Or you no longer have to do a background check at all?

sorry for being a little on the slow side haha.

I've looked HB 1096 over a couple of times and I'm not sure that's what it will do.  The language that I assume your referring to, I think, simply approves the use of NICS as a means to perform the background check, rather than using the Interstate Identification Index.  I don't know though.  It seems that HB 1116 will make the permit issue irrelevant, unless there are going to be some continued benefits to obtaining one.

The continued issue of permits would give you a permit to carry in other states.  WY passed constutitional carry but still issue permits so their citizens can carry in SD for example.

No kidding. Both that and the campus carry bill, although it's not illegal to carry a concealed weapon on a college campus in SD.

SDSU. I'm not a student so I carry sometimes, but don't spend much time on campus.

Sure, if you're an employee you COULD get fired, and if a student you COULD get expelled, but you'd have to get caught first and it still wouldn't be illegal.
