With the flurry of activity surrounding the news of machine guns being legal in Michigan, I figured I would throw together a quick info guide for you.
The following info assumes you are buying a gun from out of state and using a local dealer. You find that Bob has the gun of your dreams in Texas. You make the deal for the gun and send Bob your money. In addition to the cost of your gun, Bob is probably going to want $200 to cover the cost of the transfer to your local dealer. Bob then files the paperwork (form 3 I believe) with the ATF as well as the $200 tax payment. Now you wait. And you wait. And you wait some more. Once the paperwork clears, Bob can send your gun to your local dealer Joe. Now Joe will start his part of the form 4 and send it to you when he is finished with it. Once you have the form 4, you fill out your portion of it. You now need 2 sets of fingerprints on FBI cards as well as 2 recent passport photos of yourself. Now the fun part. You will need the Chief Law Enforcement Officer (CLEO) to sign your forms. Pray that you have a decent chief in your neck of the woods because they are not required to sign the forms. They can refuse to sign for no other reason than they don't like the color of your eyes. Assuming you do get the signiture, the hard part is done. Now you either mail everything to the ATF, along with another $200 tax payment or you return it to your dealer and he mails it in for you. This will depend on how your dealer chooses to handle it. Now you wait. And wait. And wait untill you are going nuts. Finally one day the phone will ring and Joe will tell you he got your form 4 back and you can come get your gun. Somewhere along the line you will also most likely have to pay Joe his fee for handling the transfer for you. How long a process is this? Figure on at least a 6 month wait for both tranfers to take place. If it happens faster than that, consider yourself blessed. If I have any of this wrong, I am sure someone will beat me over the head for it soon enough. |

If I may ask, who is the CLEO? The chief of the PD of the city in which you live? Chief of the county Sheriff department?

Correct, Chief of Police, if not in a city with a PD then it is the Sheriff. I have been contacted by many interested people and want to remind everyone of a couple things.... Fist is Sales Tax.....OUCH! $10,000 gun is $600 tax. The other thing is the CLEO signoff. This is typically the wrench in the whole works. Make sure you can get this before you commit to any deals. It would suck to have to back out and possibily loose a deposit because you cannot get a CLEO signature. Carry on. |

Since the ATF has moved from Georgia to Virginia paperwork has been processed in record times, I've read that guys are getting their paper work approved in weeks and not months anymore, we shall see what happens.

My dealer paperwork that used ot take 60-90 days has been under 5 weeks, some as fast as 3 weeks. |

The sheriff dept has been out four times this year for shooting on our property. Because of zoning laws there's nothing the neighbors or Sheriff dept can do about it.
Here's a chance for the county to solve the problem for everyone. |

I should try convincing my dad what an amazing investment an M-16 registered lower receiver will be. Especially if one snatched one up before all of Michigan realized they can now own one. This state alone will probably account for a boost in prices by at least 5%.

Not to pick nits, but you're wrong on both counts. NFA branch was (and partially still is) located in Washington DC. They moved the examiners to West Virginia. |

Does anyone use an escrow service during these deals. The amount of money moving around is large and it seems some protection might be in order. Thanx, Jeff

An escrow service would probably have zero business involving machine guns. The reason for this is that most sellers want their money up front before starting the paperwork.
A buyer who would attempt to use an escrow service might have a hard time buying a machine gun because there are probably 10 other buyers out there willing to go cash up front. Demand for machine guns is ever growing and will only get worse. Unfortunately, the availability of transferable machine guns is slowly shrinking. Think about it this way....Assume you had a machine gun that you were selling for several thousand dollars. Dick wants your gun providing you are willing to let an escrow service hold the cash for up to 3 months while the paperwork clears. On the other hand you have Joe, who wants your gun and is willing to send you the cash up front to start the paperwork. Most folks are going to sell to Joe, I know I would. |

Lumpy223- Thanx for the response, as I understand it, at least for an out of state transfer, the weapons is paid for and then transferred to the the out state dealer and then the out statel dealer does the form 3, then they send it to the local dealer who does the form 4, then you wait and wait and then get the weapon upon approval. I was only thinking of using an escrow for the intial payment for when the weapon is transferred to the out state dealer. Also, when buying from a private person out of state would there be a wait for the weapon to treansfer to the out state FFL that will transfer it to local FFL in MI? I truly see your point tho, but 10 or 15K to an individual is what I worry about, once the dealers have the weapon I'd be less concerned. Thanx, Jeff |

Buying an NFA weapon is certainly not for everyone. It takes a leap of faith to send off that much cash to a stranger. All you can do is ask for references and hope for the best.
As far as waiting........... Any time a transfer is involved, yes, you will be waiting. It's almost enough to make a guy want to stick to buying C&R guns...................almost. |

I agree! So does an out of state of transfer have to go dealer to dealer, or does the out of state person send it to the local dealer? Sorry for all the questions, but I appreciate your time to answer them. Regards, Jeff |

OK, First of all you CANNOT buy a Colt M4 becasue they did not exist in 1986 or before. What you can buy is a M16 of some sort set up as an M4 and it will run you between $9500 and $14,000 depending on if you can live with a non-Colt gun. A real Colt M16 is about $14k right now give or take $1k. Non-Colt guns like Sendra (Bushmaster) and Olympic are right around $10k
Converted Colt SP1 or AR15's are a wee more in most cases...about $10.5k to $11k If you decided you wanted THE first commericial select fire variant out, then it will run you between $16,000 and $18,000 That gun is the Colt AR15 model 601, it is C&R elegible and was the only M16 type you could have in MI until Dec 27 happened, then all that changed. If I may also add please keep in mind that with the huge amount of interest this is generating your local LE offices are sure to be inundated with requests. I can say with certainty this may "color" the attitude of your CLEO and thus become percieved a burden. I thankfully am on the cooperative side of the Sherriff even though many local dealers told me I would never get a signature just be patient polite and above all professional.

So let me get this straight. If I want to buy a $400 suppressor, the manufactuer has to pay a $200 transfer tax to the Class3 dealer (which I'll end up paying I assume) and then I have to pay a $200 transfer from the dealer to me? Now, that $400 suppressor will cost me $800?? Am I figuring this right??

Incorrect.
The manufacturer pays his SOT annually so he does not pay TRANSFER tax on each item manufactured. Each item does have excise tax but that is already baked in the cost of the item. They manufacture and register the item on a form 2 and then transfer it to a dealer on a form 3. When it goes from a dealer to you on a form 4 is when $200 tax is due. |

So all I pay is $200 + the cost of the suppressor or are there also FFL Dealer transfer fees involved? 2-Questions: 1.) When is this official? 2.) Anyone locally stock the AAC M4-2000? |

Cost of suppressor + Sate Sales Tax + Fed $200 Tax + Dealer Transfer Fee ($50 is what I charge.)
As for "Official"....well, it is official right now but ATF/NFA is reviewing it and needs to verify with the state AG so it will be any day. They have had the opinion letter since mid last week and you know how lawyers move. I would think within a week it will be all set at NFA branch. As far as this state, it is a done deal and I already have dealer friends with transfers in the works for individuals here in the state. Normal transfer time from a dealer to an individual is at least 6 weeks but usually closer to 10 or 12 so about mid-end Feb we might see our first transferable NFA to a state resident barring any snags. Probably not many stocking dealers here....YET! I do have a used Gemtech M4-96D in stock. It is like new with one bi-lock flash hider threaded 1/2-28. Threads are intended for an M16 or AR15 barrel but any 1/2-28 threaded barrel will work. The M4-96D is very compairable with the M4-2000, constructed from the same materials and full auto rated as well. The M4-2000 has a standard finish of bead blasted stainless. Black moly resin is another $50. Gemtech comes black from the factory. I am placing an order with AAC on Monday so if you are interested I can order you a M4-2000 then. Suggested Retail is $650 + $50 for balck finish. I spoke with them on Thursday and their prices are going up Feb 1 so if you want to beat a price increase email me and I can get one ordered for you. Don't know, I have limited experience with suppressors.
I know the big names and it has been my experience to stick with the big names as they have the $$ for R&D for cutting edge baffle design and the $$ for state of the art machines for manufacture of the cans. Lots of science goes into an effective suppressor, it is mostly all done with calculations and on some form of CAD. Doubt someone will contrive the next great suppressor while working in a garage with some PVC and steel wool. |
