Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. SHORT TITLE. This Act may be cited as the `Secure Access to Firearms Enhancement (SAFE) Act of 2005'. SEC. 2. RECIPROCITY FOR THE CARRYING OF CERTAIN CONCEALED FIREARMS. (a) In General- Chapter 44 of title 18, United States Code, is amended by inserting after section 926A the following: `Sec. 926D. Reciprocity for the carrying of certain concealed firearms `Notwithstanding any provision of the law of any State or political subdivision thereof, a person who is not prohibited by Federal law from possessing, transporting, shipping, or receiving a firearm , and is-- `(1) carrying a valid license or permit which is issued pursuant to the law of any State and which permits the person to carry a concealed firearm ; or `(2) otherwise entitled to carry a concealed firearm in and pursuant to the law of the State of the person's residence, may carry in any State a concealed firearm in accordance with the terms of the license or with the laws of the State of the person's residence, subject to the laws of the State in which the firearm is carried concerning specific types of locations in which firearms may not be carried.'. (b) Clerical Amendment- The table of sections for chapter 44 of title 18 is amended by inserting after the item relating to section 926C the following: `926D. Reciprocity for the carrying of certain concealed firearms.'. SEC. 3. EFFECTIVE DATE. The provisions of this Act and the amendments made by this Act shall take effect 180 days after the date of enactment of this Act. |

National Reciprocity shouldn't even be a question...... just like a driver's license.

So if I am understanding this our permits regardless of state of orgin would be good in every state that has CCW?????

Actually, it would. You would just need to get a non-resident license from another state. Those are quite easy to obtain. |

You are the incorrect one. You can qualify through EITHER clause (1) or (2). (1) states: "carrying a valid license or permit which is issued pursuant to the law of any State and which permits the person to carry a concealed firearm ; or" Clause (2) is for states like Alaska and Vermont which require no permit. |

Yep, you don't have to have a permit in your home state. The only really bad situation (highly unlikely) is if every state stopped issuing non-resident permits. Then the CA, IL, etc guys would be screwed. |

I feel for ya, brother. I had to live in Illinois for 5 years. (The Illinois National Guard paid for my school after my active duty). Jeez, was I shocked when I moved there and found out I had to have a state issued Firearm Owner ID card just to buy bullets. Come on over to Indiana!!!!! |

might bother to get a ccw....they are not needed here, but to carry cross country would be nice.

You would not have to get one. Since you are legally permitted to carry in your home state, you would be legally able to do so in every state if this law passed. The only issue would be the hassle of having your ability to carry verified absent a permit. I am sure it would be far easier to just have the permit to show police in other states if the need ever arose. |

Now before I go calling my Rep, what's happening to this bill on the 8th? I assume by reading "House Committee on the Judiciary" that it's not going to an open vote on the floor just yet. PLease clarify for those of us who reeeeeeeally need this to happen! |

This bill if signed into law would be unconstitutional, it requires a permit for what is already guaranteed by the second amendment.

I called every one of my pro-gun family members and friends to tell them to call their Congressmen/women, and told them to do the same with all of their family and friends.

States may respond by rewriting statutes regarding justified use of deadly force. Thereafter, it is legal to carry presuming the bill passed but the states would make it practically illegal to draw or fire a concealed pistol in all but the most narrow and contrived situations making the defendent open to the DA for a good reaming. |

What impact will this statement have? I think the intent is schools/casinos/bars and such, but could it be manipulated to cover the whole state?
