The problem lies with SCOTUS, who is not always our friend. Their ruling in the former Virginia Governor McDonell's case pretty much legalized political corruption. The bar is so high now that I doubt the U.S. Attorney will get a conviction. Under SCOTUS, Silver was doing what was necessary to fulfil his duty as an elected official. I suspect Skelos will be the next one let off. The son, not being a politician will not be so lucky.

And it will be a waste of taxpayer money and time. The New York Post had an interesting op ed piece on this. At this point Silver is admitting that he did do the things he is accused of. Of that there is no question. The issue is does what he did rise to the level of corruption under the new bar set by SCOTUS. His legal team is arguing that had the jury been instructed on the SCOTUS ruling then he would have been found not guilty. Sadly I agree.

Quite possible. But it will be interesting to see how they might approach it. If Skelos claims his activities were part of the political process then he might get his conviction overturned. But his son cannot make the same claim, since he did not hold elected office. So I suspect an admission by Dean that he did in fact do what he is accused of would screw any appeal by the son.
