If its anything like untaxed cigarettes, possession beyond a given quantity is considered intent to distribute. They don't need to do anything but weigh it.
A pound of pot is a shitload |

There's no "intent to sell" in the New York marihuana statutes (penal law section 221). Just possession levels based on weight and actual sales. Also, as an aside, for regular drugs in New York the offenses are classified by weight but intent to sell can up the punishment above the weight punishment. The intent is proven by packaging, multiple drug types present, large quantities of money, etc.
In general guys that get caught with things that Il Duce doesn't want you to have are bad drivers, do drugs or aren't very nice to their girlfriends/wives. Just sayin. |
