NYS, does not have a 2nd Amendment listed in its state constitution; wouldn't the Federal Bill of Rights supersede it with the Supremacy Clause?

What happens if a justice like Ruth Bader Ginsberg dies and the Republican Senate refuses to approve Obama's appointment? Would the court refuse to take a case until the vacancy was filled, or rule with only 8 justices?

Yeah, I'm sure the GOP will block obama's appointment.  Just like they are de-funding obamacare, fighting amnesty, etc. etc. etc....
