NASHVILLE, Tenn. (May 10, 2017) – Yesterday, Tennessee Gov. Bill Haslam signed a bill into law decriminalizing the manufacture and possession of firearm suppressors in the state. The new law not only removes a layer of state regulation, it will help foster an environment hostile to federal gun control in Tennessee.


Sen. Steve Southerland (R-Morristown) introduced Senate Bill 921 (SB921) earlier this year. Titled the “Tennessee Hearing Protection Act,” the new law repeals current Tennessee statutes prohibiting the possession, manufacture, transport, repair, or sale of firearm “silencers,” more appropriately referred to as “suppressors.”

Too late here in TX to get that done. Maybe next session someone can introduce something similar if the one in the US Congress dies.

Seems to me this won't be like states legalizing pot and having the national government play hands off.

Another state tried that and .gov prosecuted the dealer and one of their customers. This was under the previous administration, but still.

Less regulation is always better, and in this case it means only .fed can hassle you over a silencer. Local popo no longer has a play.

This is similar to Kansas's second amendment protection act. (among other States with similar other nullification provisions)

A couple folks in Kansas have rolled the dice on the State law shielding them only to crap out and be prosecuted, convicted, and are now felons.

The odds are certainly better that you can manufacture or possess a Federally unregistered suppressor now that the local and Tennessee State level enforcement agencies should theoretically not attempt to arrest or prosecute you.  

However,  ignoring the Federal requirements certainly still bears a risk of prosecution with sizable Federal penalties if you are caught.

The only real positive outcome of this story is that these folks were not sentenced to any prison time based off their claims they thought they were protected by the State law.

I see your point and it is a good one.  I wonder how many people are prosecuted by the feds and by their state for NFA violations?

Eventually, this may lead to good things, but there will probably be plenty of prosecutions along the way.
