IF the bill text is identical to the Senate (which I believe it is) and IF it passes the House floor without being amended, then there are some procedural steps but for all practical purposes it is going to the Governor's desk. Right now I'd put the chances of HB910 passing very high - better than 98%.

The problem is its companion bill in the Senate (SB476) has just been scheduled for public hearings in committee (this is not very far along in the Senate side of the process). At this stage, it doesn't look good for HB1179/SB476 to make it through this session. To do so, it needs a really strong "kick in the butt" to speed it up. |

If things follow the normal course of business though, OC will get a second reading and floor vote on April 14th, and a third reading on April 15th. That is more than enough time that deadlines are not an issue for OC. I know TSRA and NRA are working on HB1179 and it got off to a good start, so I wouldn't write it off yet; but realistically, it is a short session and I'll be shocked if we get open carry, campus carry, shall sign and defense to prosecution on top of a constitutional amendment protecting hunting and fishing. |

UPDATE: A point of order on HB 910 (open carry bill) was just sustained on a technical violation concerning a witness affirmation form. HB 40 (fracking ban) would have met the same fate so it was recommitted to the committee. HB 910 will also go back to committee cure any defects on the witness affirmation forms. So, we will all have to wait and debate this again in a few days.

Seems there was a known glitch in the witness tracking forms online and they waited till this bill to bring it out. I'm sure this will have a domino effect on all pending legislation.

Before debate could begin on open carry, Rep. Trey Martinez Fischer, D-San Antonio, raised a successful point of order arguing that there were mistakes in a listing of how witnesses testified during an earlier public hearing on House Bill 910. Martinez Fischer later said he was philosophically opposed to the bill and was taking every opportunity possible to delay or stop it. Someone else made the comment that as he raised this computer glitch, he offered to withdraw it if his ammendment was accepted that blocks out of state CHL be disqualified from OC in Texas. This "deal" was rejected. What an ass. Sure am glad I left San Antonio 15 years ago. SA is getting as bad as Austin. Fortunately the glitch has been fixed, and HB910 is back in Calendars for a reschedule to the full floor. ETA: one should note that this glitch was not unique to HB910, but rather affected many bills. |
