The executive director, Todd Rathner, of NFAFA says he has a bill sponsor to repeal and replace Texas NFA “defense to prosecution” law with an affirmative right to possess NFA items, as long as they are registered pursuant to the NFA. Wish we could a CLEO "Shall Certify" bill as well. I hear the BATFE is going to pass something in 2015 to where at least one member under a trust has to get CLEO sign off. This is coming from an interview that James Yeager (yes I understand that name is not well received around ARFcom) had with Rathner.

I exchanged emails with the Legislation person at TSRA about this and they are getting a bill to simply make it not an offense. Get your State Reps & Senators to support it, you know Gregg Abbott will sign it.

I would think this would gain traction since silencers/sound suppressors are now allowed to be used by hunters.

Nothing really.... it's just that this subject has been front and center and beat to death over the last year or so.


There is no one-stop resource guide that is up-to-date except for active laws.  Bad and outdated information is constantly posted all over the internet, as is conjecture.  It would be nice to have a single place where one could be referred.

This is exactly the correct approach. In the event that through some miracle the NFA gets done away with or some current NFA items get moved off the list (suppressors and SBR's I'm looking at you) at the federal level, we would still have to fight to change the state laws as they would still need to be registered to be legal in TX. You would have something that was legal if you registered it but if the federal govt was no longer registering such things you would have no way to make it legal in TX.

It should be real easy to get rid of with the argument that it makes no sense as unregistered NFA items are already a federal offense and the only people the law truly affects are law abiding persons, who could be arrested and tried for an offense they have a "defense to prosecution" for.
