What's funny is if you read the proposed changes in this bill it wouldn't actually ban possession of 15 round magazines.

The whole lack of any sort of grandfathering is really the scariest part of these bills. The first thing you always hear from these anti-gun morons is "no one is going to take away your guns", then they introduce a bill that does exactly that. Plus the bill is written to take effect immediately without even a period of time take it out of state or modify it to be compliant, so everyone who owns a firearm banned by this law immediately becomes a felon with no way to abide by the law.

The Mrs & I will be gone in 3 - 5 from now. But on the way South we will be stopping at CDI Custom to have Sean remove the offending parts. There is definitely going to be many threaded barrels in the future as well as normal magazines.

Someone once gave me a quick and lazy explanation of that - supposedly it pretty much made a regular rifle an NFA item? |

Fuck the second, third, fourth, seventh, and ninth circuits... oh, hell... just fuck everybody Oh... wait... you wanted substance? Sorry... my mistake. Basically, this is a ruling by the Fourth Circuit Court of Appeals (covering MD, VA, WV, NC, SC) on an appeal from a lower court about the validity of MD's recent AWB. About the only thing good to come out of the ruling was the determination that the lower court erred in it's decision to apply an intermediate level of scrutiny when considering the constitutionality of the AWB. The court instead instructed the lower court to revisit the case, but apply strict scrutiny. What that means is, to be found constitutional, the law must be found to be "narrowly tailored, to accomplish the stated goal with the most minimal impact to the constitutional rights of the people". What this means is that, most likely, the AWB law will be found to be unconstitutional, as it clearly infringes on the "fundamental right of the people to possess arms, even in their own homes, where the 2A right is clearly the strongest". Should be interesting. The other two things it did, was affirm that retired police officers are a "special class", and it's not a violation of the Equal Protection clause for them to have special privileges over the common peasant... err... citizen. Meaning, it's cool to ban something from the regular citizenry, but grant privilege to one who served the state. Lastly, it found that a bullshit phrase like "substantially identical" is not unconstitutionally vague, and is therefore valid law. But... if the AWB gets overturned in count 1 for failing the strict scrutiny test, then this piece is immaterial. However... all of this means the square root of fuck-all here in NJ, as we are not subject to the whims of the fourth circuit. It is POSSIBLE, though not very likely given past performance, that this could trigger a SCOTUS challenge, as other districts have applied intermediate scrutiny to the question of AWB's. I say unlikely, because we've had other situations where circuits have disagreed with each other, and SCOTUS has basically told the plaintiffs to get bent... they weren't listening (I suspect, it's because the pro-2A folks on the court, led by Scalia, sensed that the tide had turned in the court, with Kennedy no longer having the testicles to rule with the other conservatives on 2A issues - therefore, to not risk a bad USSC decision, they decided not to grant cert on those cases, thereby at least preserving the ambiguity of the status quo). |

NJ is controlled by extreme left socialists that want to put in place a defacto ban on all firearms. They hate the very idea of freedom, liberty and self protection. The next governor will probably be Sweeney who is not a second amendment supporter. I predict that the revised AWB will probably be signed by him. The only hope is to drive this issue to the supreme court. The next president will appoint up to 5 new Supreme Court justices. If Trump or Cruz is elected then we have a chance but if Hillary or Bernie is elected we will have lost the 2nd amendment completely. Meanwhile I predict the law abiding gun owners of New Jersey will refuse to obey illegal laws and that many of our police and sheriffs can not, and will not obey confiscation orders.
There are over 800,000 gun owners in NJ. There are 50,000 law enforcement officers in this state . Point is that the state does not have the resources or the manpower to take away everyone guns. We cannot allow the votes of 50 liberal lawmakers to criminalize and punish 800,000 lawful gun owners that have done nothing wrong. Dennis LaGrua State Chapter President NJ Oath Keepers |

It was either a 6 or 12 Month Window, I forget now. about a Month into it, some Asshole from the Legislature let it slip that the plan was to go for Confiscation within 5 years. Pretty much everyone either moved their stuff out of State, Sold it, or just tucked it away, there were less than 2000 guns registered all told. Later on they decided that the number was too small to justify the expense of Confiscation, so they just didnt bother. |
