THE IMAGE ABOVE IS A PAID ADVERTISEMENT — Police on May 24 charged a Virginia man with possessing hollow-point ammunition and having a handgun without a permit. The 36-year-old from Richmond allegedly had a .40 caliber Ruger when he was pulled over on Center Square Road. The man was processed and released on his own recognizance, pending a court date. http://www.nj.com/gloucester-county/index.ssf/2012/06/logan_township_crimelog_-_va_m.html So, they left most of the story out, but we know it was a .40 caliber Ruger. Oh boy. I guess by "having" they mean carrying, and by permit they mean carry permit. I wonder what he was pulled over for and how the gun came up. Interesting to see the hollow-point ban being applied. |

I was under the impression hollowpoint ammo was legal in NJ except when used in the commission of a crime. Please correct me if I'm wrong. |

And as currently stands in case law (the Brian Aitken appeals court ruling) you may not transport hollow points from one residence to another residence when you move.

With me so far? Possess a hollow nose bullet, you're guilty of a 4th degree crime. As with most blanket NJ firearms laws, there are exceptions. The first exception is listed in the law itself... "engaged in activities pursuant to 2C:39-6f". Without posting the whole statute, that includes such activities as going to/from a registered rifle or pistol club, going to/from any target range, hunting or fishing, or going to/from a sponsored exhibition. Further exceptions are proscribed in 2C:39-3g: members of the armed forces, members of LE, possession of HP ammo in the home, transporting HP ammo from place of purchase to home. Clear as mud now? It's no different than our laws for handguns: possession of a handgun without a permit to carry is illegal. (2C:39-5b). But, that law against general possession is exempted by various circumstances proscribed in 2C:39-6e and -6f. So, let's try it this way, and maybe avoid some of the ... "Possession of HP ammo is legal in NJ if it is being transported home from a place of purchase, being transported to/from a target range or rifle/pistol club, or possessed in the home. All other possession of HP ammo is illegal".

Why would anyone from another state want to come here, let alone come here with a gun and prohibited ammunition? If I lived in Virginia and had to drive to Long Island, I'd drive through PA and go cometely around this toilet, even if it took me twice as long.
Theres more to this story I'm sure because it's no friggen secret how retarded the gun laws are in NJ. Seriously, can you think of any of your gun owning friends that live out of state that DON'T know how bad it is here? Why would you take the chance of coming into NJ with a pistol and prohibited ammunition? There are a handful of states that I would never travel through while armed before I checked into the laws of the land; NJ would absolutely be one of them if I didn't live here. I have to believe that the guy either knew he was F'ing up and just took the chance anyway or he just doesn't care what local and state laws say and carries everywhere. Right wrong or indifferent, it's the law here and it's completely irresponsible to travel with a gun in ignorance of the laws where you intend to travel. We can only hope as state residents that cases like this don't hurt our chances of reforming these laws; rather they somehow open the courts eyes to the ridiculousness of our laws. |

One would have to be foolish to state what they would do here in NJ. It goes to "mens rea" - stating it IN writing, of what you would do, clearly states intent and premeditation. I am no lawyer, but I would think that, in a public forum, one would never show their hand.
