BILL TO PROTECT TRADITIONAL AMMUNITION INTRODUCED IN HOUSE, SENATE
Following continued attacks by anti-hunting groups to ban traditional ammunition (ammunition containing lead-core components) under the Toxic Substance Control Act (TSCA) of 1976, Rep. Paul Broun (R-Ga.) has introduced legislation (H.R. 6284) to clarify the longstanding exemption of ammunition under the act. Sen. GUN-OWNER VOTE COULD DECIDE RACES
With less than a month to go, many congressional and governor's races are neck and neck. As they have in previous elections, the votes of shooters, hunters and gun owners could make a huge impact at the polls on Nov. 2. Some candidates are publicly seeking support from gun owners, as was the case in Connecticut last week. Republican Tom Foley, who is in a virtual dead heat in the race for governor, issued a letter to sportsmen, promising to "protect the individual's right to legally purchase, own, carry and use firearms." NSSF encourages all gun owners to educate themselves on where their candidates stand on the issues and determine who best will stand up for their rights. Bill Would Allow Importation of Korean Surplus M1 Garands and M1 Carbines
U.S. Rep. Cynthia Lummis (R-Wyo.) is seeking to stop the federal government from interfering with the legal importation of surplus collectible U.S.-made firearms from South Korea, the Billings Gazette reports. Lummis has joined with Rep. Joe Donnelly (D-Ind.) in introducing a bill called the Collectable Firearms Protection Act. NSSF, which called for a congressional hearing to investigate this ban, supports the bill. |

"Joe the Plumber” Lays Into HSUS
A recent blog posting by the now famous "Joe the Plumber” slams the Humane Society of the United States and says that Americans have been "blindsided” by the animal rights group. Wurzelbacher earned the nickname "Joe the Plumber” after being videotaped asking a question of then Senator Obama about tax policy during a 2008 Presidential campaign stop in Ohio. In his blog, Joe Wurzelbacher outlines how HSUS has been targeting sportsmen, dog owners and traditional farming over the last several years through various legislative and statewide referendums. Holding back no punches, Wurzelbacher states, "Their idea of utopia is a United States with NO animal ownership; NO meat to eat; NO pets; NO hunting; NO fishing; NO service animals. If chicken farmers would be forced to own no more than 50 chickens they could no longer afford to stay in business. The same will hold true with hog farmers and cattle ranchers.” "Having tangled many times with the HSUS while defending sportsmen, its great to see citizens with a following like ‘Joe the Plumber’ speaking out about HSUS’s dangerous agenda,” said Greg R. Rocky Mountain Wolf Update Series of Bills Coming to Keep Wolves Off Endangered Species List Numerous bills are being introduced in Washington D.C. attempting to exempt the Northern Rocky Mountain wolves from Endangered Species Act protection and return management of the species to the states. On September 28, both of Montana’s U.S. Senators, Max Baucus (D) and Jon Tester (D), introduced legislation that would remove wolves located in Montana and Idaho from the ESA List and would place control over the management of those wolf populations back to Montana and Idaho. Essentially, the legislation would return management in the region back to where it had been prior to an August 5 ruling by Judge Donald W. Molloy of the Federal District Court for Montana. That decision placed all of the wolves in the Northern Rocky Mountains, a region including all of Idaho, Montana and Wyoming, back on the ESA List. Earlier this month, the two Idaho Senators, Mike Crapo (R) and Jim Risch (R), introduced a similar bill while Montana’s U.S. Representative, Denny Rehberg (R) has released a draft of comparable legislation. Meanwhile, both Idaho and Montana along with Interior Secretary Ken Salazar appealed the Molloy decision. The Fish and Wildlife Service (FWS) removed protections for wolves in Idaho and Montana because the population in the region has biologically recovered. The agency did not remove federal protection for wolves in Wyoming due to what it considered inadequate state plans to protect its population. The "carve out” of Wyoming became the focal point of a lawsuit filed by a group of 13 plaintiffs, including several prominent anti-hunting organizations, against the FWS. They argued that under the Endangered Species Act either all wolves in a region can be removed from the Endangered Species List or none can be. Judge Molloy sided with the anti-hunting organizations. |

States Ballot Issues Look to Provide Sportsman Protections
Four States Have Pro-Hunting and Fishing Constitutional Amendments on the Ballot in November Sportsmen in several states will have the opportunity this November to vote on constitutional amendments to protect their right to hunt, trap, and fish, from attacks by animal rights activists. Four states will have these amendments on the ballot on November 2: Arizona, Arkansas, South Carolina and Tennessee. Each amendment is designed to provide state constitutional protection for the right to hunt and fish. They have been drafted to head off possible attacks by animal rights/anti-hunting groups that could parachute in to various states at any time with campaign aimed at curtailing traditional sportsmen’s activities. REWARDS OFFERED The USFWS is offering a reward of up to $10,000; the AGFD Operation Game Thief is offering a reward of up to $1,000; and the NMDGF is offering a reward of up to $1,000 for information leading to the conviction of the individual(s) responsible for the shooting deaths of Mexican wolves. A variety of non-governmental organizations and private individuals have pledged an additional $46,000 for a total reward amount of up to $58,000, depending on the information provided. Nullifying Unconstitutional Federal Acts
The November elections are roughly a month away, and they couldn’t come soon enough. More Americans are seeing every day how out-of-control federal officials have become. As Angelo Codevilla aptly put it, they have become The Ruling Class, and a very corrupt one at that. Patriotic Americans are hoping that the November 2 elections will bring this growing soft tyranny to a halt, but it remains to be seen if congressional Republicans will have the gumption to reverse what they themselves contributed to when they controlled the federal government. If the Senate in 2011 includes Senators Sharron Angle (NV), Marco Rubio (FL), Joe Miller (AK), Ken Buck (CO), Christine O’Donnell (DE), Mike Lee (UT), and a few others, then the GOP caucus may well be forced to cut programs and agencies rather than continuing to bloat them. But the states, happily, have not been waiting for the federal cavalry to come over the hill. States have rediscovered their powers of nullification rooted in the Tenth Amendment. That wonderful amendment reads that, "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.” Historically, the most widespread use of nullification was in the North in the years shortly before the War Between the States. They passed laws nullifying the Fugitive Slave Law in spite of a Supreme Court decision upholding it. That point needs to be stressed. The Supreme Court is not the last word in determining what is constitutional. The voters of each state are. If they re-elect politicians who will nullify Supreme Court opinions and unconstitutional laws or regulations, then so be it. The states have now nullified the REAL ID Act, which would have converted state driver’s licenses into a national ID card filled (electronically) with all kinds of personal information. Years past the deadline, that unconstitutional act has never been implemented. In addition, many states are nullifying Obama’s efforts to socialize American medicine (or have already done so). And of particular interest to gun owners, eight states have recently enacted a Firearms Freedom Act. These Acts provide for a nullification of all federal gun laws in cases involving guns made in a state, and which remain in the state. Wyoming’s law has one extra provision that is almost perfect. The Wyoming statute provides for a penalty of up to 365 days in jail for a federal official who attempts to impose a federal gun law in contravention of the state’s Freedom Act. Perfection would require amending the law to provide for up to 366 days in jail. That extra day – even if the sentence were suspended following conviction – would trigger the federal law which would revoke the offending agents’ civil rights, including their right to keep and bear arms. I personally do not think that revoking a person’s Second Amendment freedoms for non-violent crimes is constitutional, but for the time being this penalty provides a handy tool for removing the federal boot from our necks. A 366-day provision inspired by the Wyoming law not only needs to be inserted into all states’ Firearms Freedom Acts, it needs to be part of any state law nullifying all unconstitutional federal laws and regulations. Firearms Industry Matches ATF Reward in Bedford Heights Firearms Theft
NEWTOWN, Conn. — The National Shooting Sports Foundation (NSSF) –– the trade association for the firearms industry ––announced a $2,500 reward for information leading to the arrest and conviction of the persons(s) responsible for the theft of firearms from Atlantic Gun and Tackle, 5425 Northfield Road, Bedford Heights, Ohio. This reward offer matches a $2,500 reward offer by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). Most Congressmen in monthly survey fail on Second Amendment
"I HAVE GIVEN the significance of the Second Amendment much thought, and will continue to do so," Rep. James Roosevelt of California's 26th Congressional District wrote in response to a question asking for his on-the-record opinion on the right to keep and bear arms. "Frankly, however, I do not feel, as yet, sufficiently clear in my own mind as to what the position should be. I could not, therefore, make a public statement. Your views will be very helpful to me as I consider the matter." Just how much effort Rep. Roosevelt could have actually put into those ponderings might be a fair question, but it's a moot one. Should you have a legal duty to retreat from an intruder or attacker? Pennsylvania's "Castle Doctrine" bill, H.B. 40, has cleared an important hurdle. From The Bulletin: The state House of Representatives voted last Tuesday for a bill to expand the legal use of deadly force in self-defense of individuals and their property... What, someone presumes to tell them they're not allowed to do that now? And here's another outrage: Current law also requires an individual to retreat from the threat before using deadly force if the individual is in a public place. Really? These people realize such encounters can be over in mere seconds? Or is it they just don't care? The anti-defense crowd is crying foul. Several developments have occurred in recent days that indicate something as innocuous as visiting pro-gun rights websites that are critical of government Constitutional compliance, and especially participating in comments and forums, can results in heightened law enforcement scrutiny and even as a supporting criteria for "legal" intervention. On Friday, I told WarOnGuns readers I was aware of a child welfare case in New Hampshire where one of the criterion for removing a child from its parents was an ostensible membership of the father in what protective services was characterizing as "a militia known as the Oath Keepers." Long-time readers know we've discussed Oath Keepers––specifically not a militia group––many times, including attempts by the Department of Homeland Security, the Southern Poverty Law Center, opportunistic politicians, and certain media outlets to conflate them with violent haters. For this, and other reasons, I told WoG readers I was deferring to Rhodes to take the lead on this, and maintaining contact with him behind the scenes. ATF: Surplus Korean firearms imports 'pose a threat to public safety in the U.S. In August, I asked "Why is Obama Administration blocking import of surplus rifles?," citing "problems" that were described as "ambiguous" being the reason a sale previously approved by the State Department had been halted. NSSF Supports Boy Scouts with $100,000 Grant NEWTOWN, Conn. — The National Shooting Sports Foundation will award for the fourth consecutive year a $100,000 grant to Boy Scouts of America in support of sport shooting opportunities at councils nationwide. The funding allows the BSA Shooting Sports Grant program to provide assistance to Scout councils that have shooting programs or want to develop one. Learning about firearm safety and marksmanship has been part of Scouting for decades, and increasingly it's an activity that no longer ends when summer camp is over.
