Just now getting word a Judge dismissed the Cabot WalMart Open Carry case.   Not sure of any particulars at this time.

And yes.    Just now rolling in.   Looks like it wasn't the Judge but the Prosecutor voluntarily dismissed the case.

Charge Dismissed in Lonoke County Open Carry Case

LONOKE COUNTY, AR - The charge was dismissed in the case of a man who was cited in 2014 after he was seen openly carrying a firearm in a Walmart in Cabot, according to the Lonoke County Prosecutor's Office.

The prosecutor's office decided not to continue the case against Derrick Brown after he appealed his citation to the Lonoke County Circuit Court, officials said.

In the summer of 2014, Brown was inside a Cabot Walmart openly carrying a firearm, police said. Another customer called 911 after seeing his gun openly displayed, and the Cabot Police Department responded, citing Brown, authorities said.

The issue of open carry has caused confusion since Act 746 became law in 2013. The law was touted as a "clean up language bill" by sponsoring lawmakers.

Act 746 was presented by former Rep. Denny Altes, now the state's Drug Director, as basically a clean up bill to define a journey in legal language concerning carrying a firearm. But the word "unlawfully" was also added to the law.

Now, the law reads that it is basically unlawful to carry a weapon if the person is carrying it with the intent to unlawfully use it against another person.

In 2015, various law enforcement agencies around Arkansas said that they won't arrest someone simply for openly carrying a firearm. This has added further confusion to the issue.

At the time of Brown's citation., law enforcement was operating under the guidance of former Arkansas Attorney General Dustin McDaniel's opinion that open carry was illegal in The Natural State.

Since Brown's citation, Attorney General Leslie Rutledge has taken office, and legislators have sought an updated opinion from her on open carry.

As of August 3, Rutledge has not yet issued an official opinion on open carry.

And for a reminder there is yet another case from Bald KNob awaiting adjudication for Open Carry.    This is NOT the Walmart OC incident with the off duty ASP.    This is a separate incident involving Bald Knob PD.

It's great for the guy that was charged, but there is going to have to be a case that gets tried in court (likely appealed all the way to the state SC) before we get some precedent case law established and get this shit cleared up.

Yeah...many do not realize this fact.   We were hoping either he would win and the PA would appeal or the individual would lose and appeal his loss.   Once it hit's District court then we're getting somewhere.    Don't think it actually has to go all the way to the state SC however.  Of course an anti-gun type may choose to pursue it higher if it went against them.

Even an AGs opinion in the positive doesn't automatically mean another court case won't happen.

The one thing case law gives us is the right to sue for false arrest.

Or, the legislature could repeal all of that stupidity and just honor our State constitution on this matter and all of this goofiness instantly evaporates.

Well, that makes too much sense, besides, lawyers got to bill the taxpayers on the deal, too.  After all, the ledge already got theirs.

You seem to be pretty in tune to the politics, so I'm curious what you think about this:

Knowing that AGs seem to always run for Gov, do you think this will affect Rutledge's opinion on the new law?  You think this is why it's taking so long?  Constructing a 'trap door' she can escape through if her opinion proves unpopular?

The thoughts as to why it's taking so long is more than likely due to the ongoing court case.  Now that it's been dropped who knows.   There is still the Bald Knob case however so not sure how that one will affect any ruling.   It is thought the AG should not be making these official opinions while current court cases are ongoing.     Apparently the Governors office has gotten a lot, A LOT, of feedback on the Searcy WalMart incident and we've been told to back off a little while the Governors officer reviews the ASP findings on the Troopers actions.  The ASP finally released their findings of the incident and didn't find anything wrong with his actions.   So the Governors office began getting calls.    This out of control ASP is directly on the shoulders of the Governor and AG.

While the AG is very pro gun I have no doubt she is getting heat from the opposing side.   It's basically politics.   AFAIK

Wishful thinking.   The ASP was allowed to make all kind of political deals during this last session to which they shouldn't be.    I am hearing of several "other" plans that were in the works but didn't happen.

I think the next session, 1 1/2 years, will get more traction with firearms.

The gun culture has slowly turned for the better.   Which is being reflected nationwide.   The LE culture was slower to adapt but is slowly coming around as well.   National elections are still important especially POTUS.
