The Nebraska Supreme Court a few months back voted unanimously for the outrageous knife length limit law - whereby if you are carrying any knife with a blade over 3.5 inches you are carrying a dangerous weapon concealed.

In Friday’s unanimous opinion, the Supreme Court acknowledged the limitations of using blade size alone to determine the legality of a knife. But they agreed with the lower court interpretations of the amended state law on knives.

That is maddening.   So are any of the culprits up for removal?   Or is the SC a lifetime appointment gig?

Sorry I am lost here.... Is that just the list of those who are on the ballot this year or a list of ones who are worthy of retention?    Lack of sleep probably isn't helping me any right now.

The Nebraska Supreme Court voted unanimously for that knife law.  They all need to go.  If you see their names on the ballot (first link shows that three of them are on the ballot and second link shows all of those on the ballot) they need to be voted out.

That vote was in order to force Legislature to fix the wording of law. Which will most likely happen next session. They didn't do it out of spite, they did it because the original governing wording was laid out so poorly.

So a man gets 1-3 years in prison because the wording sucked?  That is hilariously against every principle this country is supposed to stand for, including the 2A.

That guy was going to jail wether he had the knife or not, the meth in his car sealed his fate. Long of the short is this; The Leg. will have to redefine thier choice of terminology.

Excerpt from the OWH article linked below:

In an opinion written by Judge John Wright, the court seemed to suggest that the Legislature should once again consider revisiting the language defining a knife as a dangerous weapon.

“We decline to comment on the rationale for the legislative amendment that defines all knives with blades longer than 3½ inches as a deadly weapon per se for purposes of the offense of carrying a concealed weapon,” Wright wrote for the court. “That is the province of the Legislature.”

I think it is a reasonable expectation of the Judiciary to overturn laws that are too vague or too restrictively written.  Hello Washington DC and the McDonald case anyone??
