I don't know why this is constantly being discussed and argued. Without question, the law is poorly written.

Since the question is about high capacity AR & AK mags in Hawaii, I don't know why people who are not subject to the law constantly give their "definitive" answers. Just about every gun related forum out there has this topic and in every one there is always a post from someone who claims to know the law saying "NO! It's illegal because..." Well the way I see it, the topic has nothing to do with a individuals opinion or interpretation of the law.

My personal experience:
I was born and raised in Hawaii, left when I joined the Army, and returned a few years ago. At that time, I registered my collection with HPD. I walked in with 2 trunks full of rifles and pistols that included 2 AR's and an AK with all my magazines (ALL hi-caps). Aside from the "special" treatment of being allowed behind the glass to go through everything with the police Lt. in charge, the process went without a hitch. All of my pistol mags with a capacity of 10+ were put in a box, sealed, and I was given a property receipt for them. My pile of 30 & 40 rounders and 2 Beta mags were untouched. Were the laws being overlooked? Was I getting the VIP treatment? NO! The officers and clerks working in Firearms registration know the laws better than the "regular" officer. If high capacity AR and AK mags were a problem they'd have been stored like the pistol mags.

Perhaps it was an isolated incident or a different set of rules for the military? Again...NO. Military assigned to Hawaii are required to register all firearms both on post and with HPD. They are given a packet with everything they need to get it done, including a list of instructions that clearly states they need to bring the magazines when registering. To my knowledge, no one has ever had a high capacity AR magazine taken away.

So are high capacity AR & AK magazines legal in Hawaii? I can only speak of my experience and what I know. You can interpret the law for yourself. Just keep in mind...HRS is written and revised by law makers, and enforced (along with all firearms requirements) by HPD. If the firearms registration division does not consider a 100rd Beta mag illegal what does that say about the law? Also, 30 round magazines are sold in just about every local gun shop...the same shops many law enforcement officers frequent. Think about it.

What about opinion from the AG? I've called both the Department of Public Safety - Sheriff's Division (got as high as the Deputy Director’s office) and the AG's office several times inquiring about it. No one can find anything regarding the matter and several have stated it does not exist. Maybe it was an email communication between a deputy and someone in the AG's office giving their opinion? It doesn’t matter…if it wasn’t a public opinion it has no bearing on policy. On the Sheriff’s department end, every deputy I spoke to and the Deputy Director’s office have stated that, "Firearms enforcement is handled by HPD".

Man arrested for ammunition violation after police respond to domestic abuse case

Police arrested a 42-year-old Honolulu man who allegedly abused his 41-year-old wife yesterday afternoon and was found to have illegal ammunition in the home.

Police said the couple had gotten into a fight and the woman received minor injuries at about 4:15 p.m. yesterday.

The man fled their home, police said. Meanwhile, the woman reported the alleged abuse and turned over firearms registered to her husband to police.

Police discovered among the firearms a prohibited ammunition magazine.

The husband surrendered to police, who arrested him on suspicion of misdemeanor abuse of a family member and possession of prohibited detachable ammunition magazine.

Doesn't say wether it was a rifle or pistol mag.

I wondered the same thing when I read the article Thursday morning...It was a single 9mm handgun mag.

30 rnd AK mags are legal in hawaii beacause they are not on the ban list along with 30 rounders for a mini 30 so you dont have to worry about what you gonna do when they come for you

You can buy all the 30 round "RIFLE" magazines your wallet can handle at OGC Tactical for the lowest prices in town WITH HPD officers shopping there at the same time!!! There is a nice wall of PMAGs in various colors.
