Will he be there on your court date? From what I gather, the ADA will put me off until the Trooper that issued the ticket can make whatever date he can make. Sorry, NCSHP, but this is BS. Much Love, Heywood Both the state and the defendant have a right to a continuance (minimum 1 each, the judge can allow more of he wants to). So, if you want to confront your accuser (which you have the right to), then the state gets a continuance and subpoenas the officer to be there. That is how the system works. The huge majority of traffic offenses are plead out in North Carolina, it is expensive (tax money) to pay officers to sit in court for hours so all their cases can be plead out without them needing to be there. I'm not sure why you are blaming the NCSHP, the courts are run by court personnel, the NCSHP doesn't set court policies. FWIW, all traffic citation fines and costs go to the state, school systems, and/or courts. Municipalities in North Carolina do not get a dime of the money. Generally speaking it costs local police departments money to issue citations and make arrests. Think about that next time someone complains that "X" town is a "speed trap" and they are only writing tickets to make revenue. |

If you want to face your accuser,The Officer, don't take the plea to the lesser included offense ( Improper equipment) that carries no insurance or license points.
Tell the DA in district court that you want to wave to Superior court. Then everyone gets subpoenaed. Or plead not guilty in district court, and if found guilty appeal to superior court. Nothing to it. NOI |

Usually police will be there no matter what unless there on duty if they are and you want them present some places will call them in from patrol. Take the lesser plea pay a bigger fine and don't get ooo re on your license and your insurance won't go up.

Just got off the phone with a lawyer's office. "$100 attorney fee, $188 court cost, $50 fine for Improper Equipment, $75 fine for 60 in a 45, total $413, just send us a check and your ticket. We'll take care of it."
Wait, wat? You're going to get it knocked down from Speeding to Improper Equipment, and I pay the fine for that and speeding? ETA: Spoke to another lawyer. He also quoted me $413 to get it knocked down to Improper Equipment, but his price structure is different. $150 attorney fee, $263 fines/court costs. Price fixing? Any NC attorneys care to chime in on this?
$413. That's a little over half of what I sold an extremely filthy pistol for yesterday morning. When I got up last night, I had a nasty voicemail from the buyer. "Remind me to kick your ass next time I see you. I've got to clean that (Sorry, VAGunnut ) pistol you sold me before I can clean it."
Truth be told, the 1911 was filthy. I shot probably 1k of Bullseye laden reloads through it since its last cleaning, then sold it to jmzd4 for what he offered. I even threw in a couple CMC Shooting Star mags. ETA2: Just got off the phone with another lawyer, this one out of Chapel Hill. Ticket was in Asheboro. $385 to take care of it. |

In my case it was my Daughter's ticket in Boone, we live in Johnston County, so 4 hour drive there and 4 hour drive back, plus wasting one of my vacation days. It was cheaper/easier to pay a Lawyer $75 + fine and court costs to do it for us. |
