Interesting. Without knowing all of the facts on both sides, I would think the employer has a bit of problem. If she was hurt on the job, went to their doc and then they fired her based on their docs recommendation? That is an issue. However, if there were attendance or work performance issues, that could add to her problem.
In short, I don't know a good attorney that does not represent the insurance company. Fortunately, this isn't the insurance company, it sounds like the employer. Sorry. I hope she gets better quickly. |

How did she get the injury? Was she violating any policies when it happened? Did she tear something kicking the boss in the nuts?

I am sorry for her injuries and hope she has a quick recovery. I have a couple of questions:
1. Size of company (is it walmart or mom's&papas store) 2. Type of industry (construction/grocery store/ oil rig/etc...) 3. Position of employee who was hurt 4. reason they let her go? 5. what did she hurt and what limitations did the doctor state (this is where the company should of step in and made suggestions of possible functions she may perform while injuried) Lost time is a killer for any company and my two cents is that all employees if possible should work with them to minimize amount of lost time and attempt to be back without losing 1 day of work if possible i.e. light duty/change of duty/etc... Our management personal at my company are trained to guide the doctors of alternate types of work that they may be able to perform with the their new limitation (we are required to go with them when a work place injury occurs that is not life threatening). We even have documents that provide numerous examples. We are also trained to offer suggestions of OTC drugs instead of prescription if possible. Our goal is never to have a lost day associated to any injury and so far this year we have met our goal. I even had a construction worker who fracture his leg and was back to work the next day. He was not performing his typical duties but he was on the site working to his limitation that suited his injuries. In addition, we send employees to doctors/clinics that specialize with work comp cases and understand the consequences of their actions. Your GF most likely will be paid by the insurance company during the recovery for her lost time and hope she is able to find a employer who appreciates her in the future. |

1. Big company
2. Entertainment/gaming 3. Beverage server and gaming dealer. 4. Apparently for not attending work. 5. Knee injury. Not sure of what exactly is messed up. Scheduled x rays and stuff next week. Doc told her to stay off her feet until a furher appointment could be secheduled...which was today. Doc again today told her to stay off her feet and secheduled x rays and scans and stuff for next week. Her boss told her last week to not come into work until a doc cleared her to work...doc wouldn't clear her for normal work. So today when she calls to inform them they said no problem come on in to discuss other "light work options" and when she got there they fired her. That seems extreamly fucked up to me. My wife had to have Carpel Tunnel surgery on both hands, her employer has been fighting the workmans comp claim for going on SIX YEARS! Their attorney says she had carpel tunnel because she is overweight and smokes
In addition, she slipped on a terrazzo floor that someone had spilled coffee on, this was in front of six witnesses. They are also fighting her back injury. Now they are offering a settlement of just under $10,000 after legal bills and medical expenses. Initally, she simply asked them to cover her medical expenses, they refused! |
