Alabama Attorney General Luther Strange has instructed the city of Huntsville to remove a sign prohibiting guns at the Huntsville-Madison County Library but city officials are not eager to comply.

City attorney Trey Riley told AL.com that he believes the city is standing on firm legal ground in not allowing firearms at the downtown library on Monroe Street.

In a letter dated Jan. 11, Strange informed the city it had 60 days to remove the sign before the attorney general's office would pursue legal action.

"We do feel strongly that folks ought to be able to go to the library and not be concerned about firearms being wielded about the facility other than by authorized personnel," Riley said.

The prohibition of guns at the library has been a long-standing policy, Riley said.


Riley said he believed the issue arose when "gun enthusiasts" noticed the firearm prohibition sign at the library.

"It is my understanding that there are folks that are going around to various public buildings and when they observe the presence of the sign prohibiting firearms, they're seeking to determine whether those signs meet the criteria in this legislation," Riley said. "If it doesn't clearly meet it, they are submitting a complaint to the attorney general's office.

"The attorney general then investigates it and asks for a response from the person responsible for the building and then makes the determination to whether we fit within the criteria to continue posting the signs."

I thought the law was clear that every citizen that can legally own a firearm is authorized.

The city of Huntsville has complied with orders from Attorney General Steve Marshall that firearms be permitted at the Huntsville/Madison County Public Library.

The city had previously fought to keep guns prohibited at the library.

The city succeeded in maintaining a ban on firearms at the Von Braun Center because the police bike patrol is headquartered at the facility, Marshall said.

Marshall announced Tuesday that Huntsville had complied with state law in removing the sign at the library prohibiting the presence of firearms.

The sign prohibiting guns at the library were removed in late April.

The removal of gun prohibition signs in Huntsville follows a statewide trend of the AGs office mandating that city's adhere to state law after complaints were filed with the AGs office.
