We used to do "Tax Free" Days, then we got our first VA Sales Tax audit ever, presumably to ensure we were paying sales tax on our sales.
We passed the sales tax audit with flying colors, then ~three weeks later we received a letter from the Commonwealth of VA stating that advertising "Tax Free" days, even if we pay the sales tax is illegal.  |

There is an exemption in the law for "State Sanctioned" tax-free days.
If you read the law, it actually states that the reasoning behind it is to prevent merchants from "capitalizing on anti-tax sentiment of the tax-payers".
