THREE STRIKES, YOU’RE OUT!  THIRD SPECIAL
SESSION      GOVERNMENT SHUTDOWN IMMINENT -- MAYBE      
IMPACT ON GUN OWNERS  

The THIRD special session of the legislature started on Wednesday, 21 June.  They’re still hung up on the state operating budget.  All bills that have not been passed to date go back to their original chamber (House bills to House, Senate bills to Senate).  

This is similar to 2013 and 2015, when the legislature required multiple special sessions to pass the required operating budget by June 30^th and the governor had to sign it at the last minute to keep state agencies operating.  30 June is next Friday.  This is all about the Governor and Democrats demanding more tax revenue. 

The House and Senate convene every other day or so, them immediately shut down for a couple more days while the budget conferees continue to disagree. 

Should the budget not pass by 1 July, many state agencies will shut down or go on reduced operations.  Some, mostly those with public safety functions, (e.g police, fire, medical, etc.), will remain fully or partly functional.  How this will impact gun owners remains to be seen.  Rumors are floating around that this will shut down gun shops, or at least gun sales/transfers.  Not quite.  Background checks for long guns are sent straight to the FBI’s NICS system, so that’s transparent to the state.  But handgun checks are local.  The state operating budget has little impact on local agencies, although access to data bases such as DSHS for mental health checks is problematic. 

The problem with all of these background check systems is they rely on government living up to its obligation to allow people to exercise fundamental rights without hindrance or delay.  By inserting the government into the middle of what should be private business between two individuals, they can effectively and arbitrarily shut down a constitutional right.  In the words of Dr. Martin Luther King, “A right delayed is a right denied.”  (Under federal law, if a NICS check cannot be completed within three days, the sale/transfer may go forward.  But NICS isn’t the problem in this scenario.)

Senator Pam Roach (R), who has represented the 31st District for more than 20 years, was elected to the Pierce County Council in November.  She cannot hold two elected positions so she must resign from the Senate, halfway through her current term.  Typically, up to three replacements are nominated by the Precinct Committee Officers (PCOs) of the district, then one is appointed by the county council.

 

Because the 31st District is split between King and Pierce Counties, BOTH county councils get to choose.  The PCO’s made three nominations”, #1 recently re-elected Representative Phil Fortunato (R), #2 David Patrick and #3Cheryl Marshall.  Both Patrick and Marshall reportedly support Fortunato.  The Pierce County Council is ready to move, but the King County Council has refused to act.  Why?  Because the state Senate is now split 24-24, and any tie vote would go to newly-elected Lieutenant Governor Cyrus Habib (D).

 

The Democrats did this once before for a House appointment in 2014, and withheld approval for 60 days.  As with the temper tantrum Hillary supporters have been throwing since election day, if Republicans had done this, they’d be condemned far and wide.  But this is business-as-usual for the D side.  More as the legislature convenes next week.

 

The 65th Washington state legislature convenes Monday, January 9th for its long (105 day) session.  The principal focus of the long legislative session is supposed to be the biennial budget, but rest assured several other topics, including firearms, will receive attention.

 

Control of the legislature remains split, with Democrats in charge of the House (50 Democrats to 48 Republicans), and Republicans continuing the Majority Coalition in the Senate, with 25 Majority Coalition members (24 Republicans and one Democrat) versus 24 Democrats.  We can also count on a handful of pro-gun House Democrats siding with gun owners on legislation of interest.

 

For those new to legislative affairs, here’s how the process works:  When a bill is filed in the House or Senate (or both, simultaneously, called “companion bills”) it is assigned to a policy committee.  Most gun-related bills go to the Senate Law & Justice Committee in  the Senate.  In the House it’s a little more complicated, as it may be sent to House Judiciary or House Public Safety (most will go to Judiciary).  Public hearings may be held, after which the bill may (or may not) be voted out of committee.  If the bill has a fiscal impact (usually an expenditure of more than $50,000), it must then go to Senate Ways & Means or one of a couple of House fiscal committees.  The bill then goes to the Senate or House Rules Committee, where it must be voted on to pass out to the floor for a full vote.

 

After a bill passes the Senate or House, it then goes over to the opposite chamber (House or Senate), where the whole process starts over again.  If the bill passes the second chamber in the same form it passed the first, it goes to the governor for signature (or veto or partial veto).  If changes are made in the second chamber, it goes back to the first for concurrence.  It may also go to a conference committee from both chambers to resolve differences.  The final version must pass both chambers.

 

The bill then goes to the Governor, who may sign it into law, veto (kill) the bill, or sign a partial veto (killing just selected section(s) of the bill).  The governor may also allow a bill to become law without his signature.  Most signed bills take effect on 1 July, although bills with an “emergency clause” (considered immediately necessary for public safety) take effect upon signature by the governor.

 

One of the first items of business in each session is the adoption of the session calendar, identifying dates by which bills must clear various hurdles.  A bill that fails to clear the policy committee or chamber floor by the designated date is generally considered dead for the year, although they may be “resurrected” by parliamentary procedure.  I’ll post the cut-off dates for the 2015 session in the next issue of GOAL Post.

 

Bills from the last session are dead.  New bills must be filed for consideration by the 65th Legislature, with new bill numbers.  Most of the bills covered in GOAL Post impact either RCW 9.41 (state firearms code) or RCW 9a.16 (use of force).  At this point, three gun related bills have been pre-filed:  HB 1000, by Rep. Doglio (D-22) amending use of force, HB 1015 by Rep. Shea (R-4) opening areas to licensed concealed carry, and SB 5000, by Sen. McCoy (D-38) also addressing the use of force.  Bills have not yet been assigned to a policy committee.  The Attorney General’s new proposed “assault weapon” ban has not been filed at this time.

I am taking the liberty of forwarding this message from NRA-ILA to all GOAL listers.  It contains the best and most thorough explanation I have seen of the breadth and impact of Attorney General Ferguson’s proposed “assault weapon/large capacity magazine” ban and/or registration legislation.

Don’t look to the past and recall the 1994 Clinton/Feinstein federal gun ban.  That was a joke – a “ban” that banned nothing already in existence, and was so poorly worded that it opened the door to widespread and easy evasion.  This one is for real.  It not only eviscerates the 2nd Amendment, it does a fair job on the 4th and 5th Amendments as well.

As we look at the elevation of Donald Trump to the presidency and the commitments that he made on the campaign trail to protect the 2nd Amendment, let us remember that almost all gun control laws on the books come at the state level.  And as my mother would have said, “this one is a doozy.”

If you have never been politically active before, THIS is the time to start.  This is the time to communicate with your elected officials – by e-mail, by telephone (remember the toll-free legislative hotline (800-562-6000 and TDD 800-635-9993), by old-fashioned snail mail – and let them know in polite but firm terms that these bills (HB 1134, SB 5050 and HB 1387 (no Senate version bill number yet) SB are totally unacceptable and infringe on and impair the US and state constitutional protections of the right to keep and bear arms.

This is the time, too, to plan a day to visit the Capitol Campus and speak directly with the people YOU sent to Olympia to represent you.  In all likelihood, in the next two weeks a day will be scheduled when multiple gun bills are heard – a great opportunity to put grassroots lobbying (YOU) to work.  Yes, most os us have to work for a living, and have to take time off to visit Olympia.  How much are your 2nd Amendment rights worth to you?  The other side rents buses and cleans out downtown Seattle to  give freeloaders a free ride.  Are they more committed that we are?  I’ll try and get another alert out when “gun bill day” is scheduled.

Inspired, perhaps, by Oscar Wilde (“Moderation is a fatal thing. Nothing succeeds like excess”), Washington State Attorney General Bob Ferguson has announced two new sweeping gun control bills, with Sen. David Frockt (D-Seattle) and Rep. Strom Peterson (D-Edmonds) as the bill’s prime sponsors.

 

Despite being described as “assault weapon reform,” the proposed legislation is nothing short of a ban of many common, legal firearms and “large-capacity magazines” currently possessed by millions of law-abiding Americans for self-defense, hunting, and recreational shooting.

 

Both bills use the same extensive definitions of “assault weapon” and “large-capacity magazine” (LCM). “Assault weapon” would include:

 

    a semiautomatic rifle using a detachable magazine and with one or more of the listed six features (e.g., folding or telescoping stock, thumbhole stock),

    a semiautomatic handgun or a semiautomatic, centerfire, or rimfire rifle with a fixed magazine that can hold more than ten rounds,

    a semiautomatic, centerfire, or rimfire rifle with overall length of less than 30 inches,

    a semiautomatic handgun using a detachable magazine and with one of the listed four features, and

    a shotgun with a revolving cylinder or certain semiautomatic shotguns.

 

The bills exclude “any firearm that is manually operated by bolt, pump, lever, or slide action,” “antique” firearms, and any gun that has been made permanently inoperable.

 

An LCM is defined as “any ammunition feeding device with the capacity to accept more than ten rounds,” or “any conversion kit, part, or combination of parts, from which such a device can be assembled” if the parts are in the possession or control of the same person, but excludes a tubular magazine contained in a lever-action firearm and a .22 caliber tube ammunition feeding device.

 

The first bill prohibits all possession, purchase, sale or transfer of an “assault weapon” or LCM, except as permitted. (“Transfer” already has a special definition in Washington law, and means any “intended delivery of a firearm to another person without consideration of payment or promise of payment including, but not limited to, gifts and loans.”) The exceptions for other than law enforcement personnel or licensed dealers include persons who legally possess such items when the law takeseffect, and persons who become owners through inheritance or other operation of law, provided these owners can “establish such provenance.” Once grandfathered, owners are themselves prohibited from selling or transferring the item, other than to a licensed dealer or by way of permanent relinquishment to law enforcement. Guns and magazines relinquished to law enforcement “must be destroyed.”  These bills have less to do with “meaningful reforms” for public safety and reducing crime (other than the newly defined crimes of being gun owners) than they do with moving the incremental process of stigmatizing guns and eliminating firearm possession by law-abiding citizens another giant step forward in Washington State.

 

The bill also imposes a storage requirement on grandfathered owners as a condition of continued lawful possession. The “assault weapon” or LCM must be kept in a safe, gun safe, lock box or other device that can be locked and constructed of workmanship and material such “that it cannot be pried open or easily removed or defeated.”

 

The second bill proposes a marginally less extreme alternative. First, it would impose a registration-licensing system for “assault weapons” and LCMs. Every person who possesses, transports, manufactures, purchases or sells an “assault weapon” or LCM must have an annual state-issued license, with an updated license required every time there is a change in possession of the gun or LCM. The licensing requirement has a delay period (until 2020) before it applies to persons who currently possess such items, but these persons would be prohibited from selling or transferring the gun or LCM to anyone other than a licensed dealer, a gunsmith, or to law enforcement for permanent relinquishment. Like the first bill, this bill mandates that relinquished guns and LCMs “must be destroyed.”

 

Licenses would not be available to persons under 21 years of age. Applicants would have to show proof of completing the specific kind of comprehensive training, and provide a statement that he or she will only use the gun or LCM for the specified “lawful” purposes and will always use “safe gun storage” when the "assault weapon" or LCM is not in the person’s “immediate possession.” The license applicant must provide a “full description” of both the lawful purpose for which the assault weapon or LCM is sought and the “safe gun storage” the applicant will use. The application also requires a minimum $50 fee, detailed personal information, detailed information about the weapon or LCM, fingerprinting, and a state database/NICS check. The bill also imposes a “great care” standard for licensees, in which the licensee must keep the assault weapon unloaded, within “secure gun storage,” when it is not in the licensee’s immediate possession.

 

Licensed dealers would be prohibited from selling or delivering an "assault weapon" or LCM to any person who does not have a state-issued license. Even with licensees, the bill would require the dealer to keep records of every transaction, to be submitted to local law enforcement. Further, because Washington State has a private background check requirement that applies to sales and “transfers” of firearms, the dealer performing a background check on a non-sale private “transfer” of an "assault weapon" is prohibited from “facilitating the transfer” if the parties lack the necessary licenses. Residents of other states would be prohibited from purchasing rifles and shotguns in Washington if the firearm comes within the definition of “assault weapon.”

 

And if all this wasn’t enough, the penalties for violations of these bills are staggering. Under the first bill, any violations are Class C felonies, as are violations of the licensing or the “great care” requirements in the second bill. Class C felonies are punishable by five years’ imprisonment, a fine of $10,000, or both the imprisonment and the fine.

 

According to a news report, the goal is to pass the “assault weapons” ban, with the second bill being the fall-back or alternative. Predictably, these measures are being characterized as “common-sense solutions” to prevent "gun violence".

 

As we’ve pointed out before, bans of “assault weapons” tend to be an arbitrary categorization of certain firearms based on the presence of designated features. These bans are unrelated to the likelihood of such guns being used in crime or in a mass shooting event. A study that Congress required on the impact of the federal assault weapons and LCM ban, which expired in 2004, “concluded that ‘the banned weapons and magazines were never used in more than a modest fraction of all gun murders’ even before the ban, and that the law’s 10-round limit on new ammunition magazines wasn’t a factor in multiple-victim or multiple-wound crimes.” Similarly, state-level data suggests there is no indication that "assault weapon" and LCM bans reduce violent crime. Despite being described as “assault weapon reform,” the proposed legislation is nothing short of a ban of many common, legal firearms and “large-capacity magazines” currently possessed by millions of law-abiding Americans for self-defense, hunting, and recreational shooting.

 

 

Moreover, based on a survey released a few days ago by the Pew Research Center, restrictions on "assault weapons" are not supported by the law enforcement community. The survey found that even though almost all (86%) of the officers describe their job as more difficult now than previously and that their department lacked enough officers to adequately patrol their community, only about a third of officers (32%) expressed support for a ban on "assault weapons" (and an overwhelming majority of the police officers, 74%, agreed that it was more important to protect the rights of Americans to own guns than it was to control gun ownership).

 

Sadly, these bills follow the recent tradition of Washington State’s poorly drafted gun control initiatives and misinformation in how these are portrayed to the public. The 2014 background check initiative, I-594, was peddled as one that required background checks “on all gun sales,” to prohibit “dangerous people” from buying guns. In reality, the legislation went far beyond regulating sales and covers almost all gifts, loans, and other “transfers” of a firearm, meaning that any situation in which a firearm temporarily changes hands is a potential violation of the law. Another Washington initiative, I-1491, on “extreme risk protection orders,” was described as a “temporary” suspension of a person’s access to firearms if there was “documented evidence” that the person may be dangerous. The actual text of the measure, however, authorizes court orders that ban possession or access to guns for a minimum of one year – which orders are renewable indefinitely – without any requirement for evidence by an expert or medical practitioner regarding the person’s mental health or propensity towards violence. Oddly, given the stated goal of the legislation, it does nothing to require a mental health follow-up or treatment for a person who is placed under such an order. And while the professed justification for passing such gun laws has been the need to save lives by keeping firearms out of the hands of criminals and other dangerous people, there’s little to show that there’s been any appreciable impact on public safety because of these restrictions.

 

Consistent with this pattern, though, we expect to see the drastic regulatory scope and reach of the new bills downplayed, with correspondingly big claims about their value in reducing gun violence.  Already, Attorney General Bob Ferguson’s press release states, about the first bill, that “[t]he legislation covers only sales, thereby grandfathering current gun ownership,” adding that the “ban on the sale of high-capacity magazines applies to magazines capable of holding more than 10 rounds of ammunition.” In fact, the plain language of the bill clearly prohibits, besides sales, the possession and “transfers” (gifts and loans) of guns and LCMs. Likewise, the licensing and registration regime is entirely omitted in the description of the second bill, which is referred to as “enhancing background checks and raising the minimum age required to buy” assault weapons and LCMs.  Nowhere is there a mention of the dire penalties.

 

These bills have less to do with “meaningful reforms” for public safety and reducing crime (other than the newly defined crimes of being gun owners) than they do with moving the incremental process of stigmatizing guns and eliminating firearm possession by law-abiding citizens another giant step forward in Washington State.

The following cut-off dates were adopted for bills under consideration in the 2017 regular legislative session.  As a general rule, if a bill fails to pass a hurdle, it is considered dead for the session.  Exceptions can be made.

 

17 February     Bills must pass out of policy committee

24 February     Bills must pass out of chamber fiscal committee (only bills with major fiscal impact)

08 March         Bills must pass out of house of origin (House bills out of House, Senate bills out of Senate)

29 March         Bills must pass out of policy committee in second chamber

04 April           Bills with major fiscal impact must pass out of second chamber fiscal committee

12 April           Bills must pass out of second chamber (House bills out of Senate, Senate bills out of House), except for bills in a conference committee to iron out differences in House/Senate versions,  budget bills and initiatives.

23 April           Sine die – close of regular legislative session.

 

Several new gun bills were filed this week, as usual good and bad.  HB 1380, by Rep. Shea (R-4), repeals I-594.  HB 1381, by Rep. Blake (D-19), amends current CPL reciprocity law into one recognizing all licenses issued nationwide to anyone 18 and over.  Hb 1397, by Rep. Jinkins (D-27) is AG Ferguson’s “assault weapon & high capacity magazine” registration and licensing bill.  HB 1388, by Rep. Cody (D-34), is a major health care rewrite, but adds shops that sell cannabis to those areas prohibited for firearm possession.  HB 1483, by Rep. John Lovick (D-44), allows the state to destroy forfeited firearms.  HB 1501, by Rep. Hansen (D-23), tracks denials of attempts to purchase firearms via an FFL, creates a data base of denials, and may allow referral for prosecution.  SB 5216, by Sen. O’Ban (R-28) mandates availability of an elective firearms safety and/or hunter ed course in secondary schools.  SB 5259, by Sen. Rivers (R-18), is the counterpart to HB 1388 that bans possession of firearms in shops that sell cannabis.  SB 5268, by Sen. Takko (D-19), is the Senate version  of the CPL renewal notice requirement.

 

A public hearing was conducted on HB 1100, the house version of the CPL renewal notice bill.  The only person to testify was the bill’s sponsor, Rep. Blake (D-19).  A committee vote may be taken in House Judiciary on Jan. 26th.   

 

A public hearing is scheduled in Senate Law & Justice on January 24th at 10:00 a.m. on SB 5268, the Senate version of the bill to mandate a CPL renewal notice be mailed 90 days prior to expiration.

 

Public hearings on bills are conducted at the discretion of the relevant committee chair, as is scheduling for a vote out of committee.  The committee chair is thus one of the most powerful people in the legislature, although there is provision to “relieve a committee of responsibility for a bill” to bring it straight to the House or Senate floor.  This provision is rarely used.

 

I’ll be in Jacksonville, FL, next weekend for the annual meeting of the Florida Sport Shooting Association, so GOAL Post may be a little late coming out.,.. again.  (Funny, how when you volunteer for positions without pay, how many people want to hire you.  But volunteer work and grassroots lobbying is the lifeblood of the gun rights movement.  It’s a vocation.  Just an observation!)

While I was working the annual Shooting, Hunting, Outdoor Trades (SHOT) show in Las Vegas last week, then on my way to Jacksonville, FL, for the annual meeting of the Florida Sport Shooting Association, they slipped one in on us.  HB 1384, by Rep. Roger Goodman D-45) and SB 5256, by Sen. Joe Fain (R-47) carry the innocuous-sounding title “Sexual Force Restraining Order.”  The law – and the order – already exist.  What this bill does is allow extension of a maximum two year restraining order to a LIFETIME ORDER.  In effect, this becomes a lifetime ban on the possession of firearms for anyone subject to such an order.  In no way do we condone sexual force or violence, but we also recognize that such orders are frequently based on “he said, she said” so-called “evidence” and are frequently used to punish a partner in a divorce or separation proceeding.

 

HB 1100, mandating mailing of a renewal notice for CPLs, passed out of House Judiciary and sits in House Rules awaiting a pull to the floor.

 

HB 1384 was heard in House Judiciary last week, and is slated for a vote out of committee this coming Thursday.  No action is slated in the Senate at this time.  I urge you to contact your Representatives to warn them of the severe impact of the bills and ask them to note “no” if they have the opportunity.

 

More new gun bills filed.  HB 1529 by Rep. Cindy Ryu (D-32) would limit law enforcement (and those citizens aiding law enforcement) use of force.  HB 1725, by Rep. John Koster (R-44), exempts CPL holders from the background check requirements of I-594.HB 1739, by Rep. Laurie Jinkins (D-27) allows certain exemptions to the firearms background check in certain cases, such as for pyrotechnic devices (flare guns), some loans, transfer within the family, etc.

 

SB 5441, by Sen. Patty Kuderer (D-48) would place a six-month freeze on firearm possession for anyone detained for temporarily a period of mental health evaluation, even if no cause was found for the detention.  SB 5444, by Sen. David Frockt (D-46) is the Senate counterpart to HB 1387, mandating registration and licensing for “assault weapon:” and “large capacity magazine” possession.  SB 5363, by Sen. Guy Palumbo (D-1) is the counterpart to HB 1122, mandating “safe” storage of firearms, under potential felony penalty.  This is basically the same bill they have been trying to pass since 1997.  Finally, SB 5506, by Sen. Han\s Zeiger (R-25) would allow transfers of firearms at non-profit events such as Ducks Unlimited or Friends of NRA gatherings.  SB 5552, by Sen. Jaime Pedersen (D-43), is the counterpart to HB 1731 that makes certain exemptions to I-594.   SB 5553, By Sen. Jaime Pedersen (D-43) allows a suicidal person to waive his or her right to possess a firearm for a minimum period of seven days,  The waiver is voluntary, as is lifting the waiver.  .

 

A dozen or so public hearings are scheduled next week.  See schedule below.  Note multiple bills of interest may be heard at one hearing.  There’s a schedule conflict in the Senate.  See note below.

 

Just FYI., my temporary travels are over – at least until the NRA convention at the end of April, by which time the regular session will be over.  Let’s not talk about special sessions… yet.  GP 2017-5 should come out next Friday evening.

A few new gun bills were introduced this week.  HB 1592, by Rep. Klippert (R-8) waives the handgun delivery waiting period for active commissioned police officers as currently exists for CPL holders.  Long overdue. HB 1900, by Rep. Griffey (R-35) authorizes issue of a special “NRA” license plate to help fund hunter education programs.  HB 1933, by Rep. Rep. Walsh (R-19) waives the I-594 background check requirement for firearms transferred via a not-for-profit activity such a Friends of NRA or Ducks Unlimited.

 

(Note on HB 1900:  The current listed position on HB 1900 is “neutral.” Not because I oppose funding hunter ed or have a problem with the NRA – I have been a life member of that organization for several decades – but that I believe we would be better served by a plate that recognizes the Second Amendment to the bill of Rights as broader and more inclusive.  I would also add that we have two national gun rights organizations based right here in Washington – why single out just the NRA?  Disclosure:  I have worked for both SAF and CCRKBA, and I have been an NRA election volunteer coordinator and certified firearms safety instructor.)

 

Correction:  HB 1100 (renewal notice for CPL) now sits in House Appropriations awaiting a determination of fiscal impact and a committee vote.

 

Public hearings were held on several bills last week.  Of particular interest was the hearing in House Judiciary conducted on February 2nd.  Historically, pro-gun individuals out number anti-gunners at these events.  It appears the other side has noticed this and went out of their way to make a strong showing on Thursday.  They wore orange and filled the room early, effectively hogging the camera coverage.  We need to do better, gang.  I was also told that there were a couple of buses, including one school bus, parked outside that may have carried these individuals to Olympia, also not a new tactic of the left.  A similar incident occurred in Tallahassee, Florida, last week, when dozens of women wearing “Everytown for Gun Safety” orange t-shirts crammed a gun bill hearing.  Funny thing, when the hearing ended, the women were seen turning their t-shirts over to a few League of Women Voters “volunteers.”  “Everytown” is a Michael Bloomberg front group and LWV never met a gun control bill they did not support.

 

Public hearings are scheduled next week on HB 1100 (CPL renewal notice) and HB 1731 (exceptions to I-594).  Details below.

 

HB 1384 (Sexual force protection order) was amended in committee to allow for a rehearing to end or limit the court order.  It passed out of committee on a 12-1 vote and moves to House Rules, the “holding pattern” for a full floor vote.  The bill is still offensive in that it puts the burden of proof on the accused to show he/she poses no threat.

 

SB 5260 (CPL renewal notice) passed out of Senate Law & Justice and now awaits a call to the Senate floor out of Rules.

 

Note that just as which bills are heard by a committee is solely at the discretion of the committee chair, so is the decision to call a bill up for a committee vote.  With two weeks left until the first (policy committee) cut-off, most bills have not been scheduled for a hearing.  We may see a last-week rush, we may not.  This is where your contact with legislators is important – to push to hear a bill or block it – grassroots lobbying at its best.

GOAL Post 2017-6 was published last Friday, but apparently did not receive complete distribution.

 

I’ve been publishing GOAL Post since 2000, primarily in direct e-mail format through my home ISP.  As the subscriber list grew, I broke it up into segments of about 200 names each.  Every Friday night during session, no problem.  Compose message, hit “send” button, and it magically goes out of my mailbox into yours.   Try wagoal.org or on Facebook its Gun Owners Action League of Washington.

 

Until last Friday, when all of the batches were kicked back, theoretically as spam  I will continue to try e-mail, but I’m working on alternatives, among them, posting GOAL Post on the web pages of the Washington Arms Collectors and the Washington State Rifle & Pistol Association.  About 18 months ago, a friend and co-worker created a “GOAL” web site which I never paid much attention to, as he merely posted the current GOAL Post during session.  Unfortunately he passed away last year, and at this point I cannot access the site.  

 

Two more bills I should have been tracking deal with firearms in the broader sense, but do not come under RCW 9.41, our state’s firearms code.  HB 1270, by Rep. Harmsworth (R-43) encourages voluntary use of firearm locking devices by offering a tax saving.  A similar law waiving the sales tax on gun safes was passed nearly 20 years ago.  HB 1612, by Rep. Orwall (D-33) expands on the suicide prevention program initiated last year, and supported by gun rights organizations.  Both bills are still alive.

 

Tonight is the first major cut-off day, when all bills must pass out of their policy committee.  Those that are not moving forward are most likely dead for the session.  That’s about 2/3 of them, good or bad.   The “Bill Status” column below shows the current status for each bill we’re tracking.   Basically, if it doesn’t have a position in Rules or a fiscal committee, it’s dead for the session.

 

Remember, nothing is really “dead” until the fat lady sings, on April 23rd.  While rare, extraordinary action may be taken to revive a bill, or even file a new one.

 

The good news is that Attorney General Bob Ferguson’s flagship bills banning and/or registering so-called “assault weapons” all died in committee.  They tried to salvage the registration bill in the House by watering it down, narrowing the defionition of “assault weapon,”deleting magazines, eliminating the annual licensing, etc, but even that couldn’t get the required votes to get out.  Stand by for an initiative.  The House version of the safe storage bill DID pass, but in amended and watered down form.  It’s still a bad bill, as well as totally unnecessary – current reckless endangerment law already covers the topic.  Unfortunately almost all  pro-gun bills died as well.

 

Bills that have a significant fiscal impact have an additional week to pass out of one of the fiscal committees.  That cut-off is next Friday.  Keep in mind this is the biennial budget year, and if they fail to pass a budget, we could be looking at one or more special sessions, as happened a couple of years ago.

  

The next critical cut-off is March 8th, when bills must pass out of their original chamber (House bills out of the House, Senate bills out of the Senate).  If they don’t make the cut, they’re nominally dead.  Most action will be on the chamber (House or Senate) floor, where bills will be debated and passed… or not.  After March 8th, those bills that passed out of their original chamber will go through the same process – on the other side:  committee hearing and possible action, fiscal committee action if required, then into the Rules committees while awaiting a full chamber (floor) vote.

 

All bills considered on the floor are subject to a roll call vote.  Because of their numbers (98 members), the House does it by machine – a quick red-green machine vote, called the Christmas tree (probably the only politically correct Christmas tree in the capitol).  The Senate, with only 49 members, does it the old fashioned way – a roll call voice vote.

 

 (To give you an idea of the magnitude of a legislative session, nearly 2,300 bills have been filed so far in this session.  As stated before, many are filed, few receive action.)

In a week or two I’m going to trim the list of bills under consideration, deleting those that did not survive the committee or chamber.  That will give us a more manageable list to follow.  At the end of the session I’ll publish a session recap with the complete bill list.

 

The fiscal committee cut-off  is tonight.  All bills that needed fiscal approval and did not get it died.  At this time it appears that HB 1270 and SB 5073 likely died in their respective fiscal committees.  I’ll correct any changes next week. HBs 1501 and 1612 passed out to House Rules.  At this point there are nine bills still left alive out of 34 originally filed.

 

The next major cut-off is in twelve days, March 8th, when all bills must pass out of their original chamber (House or Senate).  We’ll likely see a handful of the remaining bills die at that point.

 

Two gun bills have successfully passed out of the Senate, to be taken up by the House after the 8 March chamber cut-off date.  SB 2268 (CPL renewal notice) and SB5552 (expanded exceptions to I-594) both cleared the Senate on a 49-0 vote.  Neither was controversial!

 

For the next ten days, all of the action will be on the chamber floors as bills are called up, debated, possibly amended, and then an up or down vote.  Floor sessions are televised on TVWashington for the masochists on the GOAL list.  And there should be a link on the legislative web site (leg.wa.gov).

From a gun bill perspective, this has been a slow week.  HB 1100 (CPL renewal notices) passed out of the House, but in amended form (the Senate version, SB 5268) passed clean last week).  That means the two versions will have to be reconciled, either by one chamber accepting the other’s language, or by a conference committee later in the session.  HB 1501 (reporting of NICS denials) and HB 1612 also passed the House.  All are headed for Senate Law & Justice.

 

At week’s end, one other gun bill is on the House floor calendar: HB 1731 (I-594 tweaks).  Three others, HBs 1122 and 1483, and SB 5506, have yet to be placed on their respective (House or Senate) floor calendar.  The cut-off is next Wednesday, 8 March.  Note that, historically, non-controversial bills are generally moved first to “clear the deck” for those with major disagreement.

 

As it sits right now, HB 1731, like SB 5222,  makes some minor tweaks to ease some of the background check burden imposed by I-594 by adding a few more small exceptions to the requirement.  An amendment to HB 1731, proposed by retread (he previously served in the House from 1995-2001) Representative John Koster (R-39) would make a significant change by allowing transfers without background checks if both parties to the transaction were Washington CPL holders.

 

The ATF has already acknowledged our CPL meets the highest federal standard by designating Washington a “NICS Alternative state” for federal checks (blocked by I-594), in addition to which it has passed by an internal Washington state criminal history check plus a Dept of Social and Health Services check.  Plus CPL holders have a track record of good behavior, something someone walking off the street into a gun shop may not have.  This is about the most common sense rationale you could use for a 594-waiver.  If pre-cleared individuals are not granted a waiver, this clearly demonstrates that I-594 was not about background checks but about gun registration via FFL recordkeeping (something “background check” supporters continue to deny, admitted in public testimony in the Senate back in 1997 – “we want the audit trail”).

5 p.m. on Wednesday was chamber cut-off: House bills that had not passed out of the House, and Senate bills that had not passed out of the Senate, died for the session.  We are now down to a very manageable list of five bills to follow.  34 gun bills were filed this year, nowhere near the 60+ filed in the last two year biennium.  And as is typical, most never passed the half-way mark.



As the 5 o’clock bell rang in Olympia on Wednesday, the House still hadn’t  reached HBs 1122, 1483 and 1731.  The Senate stopped short of SB 5506.  So those bills should be considered dead for the session, but the Senate version of HB 1731, SB 5552, is still running in the House.  Keep in mind, too, that this is the first year of a biennium, meaning all the bills filed this year that did not make it can be called back next year.  Or during any special session.



And now there are five.  HB 1100, HB 1501, HB 1612, SB 5268 and   SB 5552   Two of the bills are essentially duplicates: HB 1100 and SB 5268 both mandate mailing a renewal notice 90 days before a CPL expires, a long overdue fix.  The HB 1100 was amended in the House, so it will have to be reconciled with SB 5268 in the next four weeks.   HB 1501 requires FFLs to notify the State Patrol of NICS denials, who are then directed to initiate an investigation (many/most of which will go nowhere because of misidentifications).  HB 1612 promotes suicide awareness education.  And SB 5552 is the Senate version of the minor tweaks to I-594 background checks (e.g. no check required for in-laws, or for loans at the range where the owner stays with the firearm).



Not much of a positive outcome midway through, but if you look at all the anti-gun bills filed, it’s encouraging to see none got traction.  We’re not going to see pro-gun bills sail through until a pro-gun House is put in place to match a pro-gun Senate.



Public hearings will be conducted on HB 1612 and SB 5268.  SB 5552 will be subject to an executive session (committee vote).  Details below.



We’re halfway through the session, and already the bill list is down to five.  But it’s not over yet.  And should a shooting incident occur that “fits” one of these bills, you can expect them to try and revive it.  The fat lady doesn’t sing until midnight on 23 April!

The committee hearing/vote/floor session cycle has started all over again, after the 8 March original chamber cut-off.  As House bills move through the Senate and vice versa, the next critical cut-off date is Wednesday, 29 March -- nearly two weeks off.  The second half of the long session is off to a slow start.  Of the five gun bills we are tracking, two had public hearings (1612 and 5268) and one passed out of committee (5552).

 

Senate Bill 5552, relaxing SOME of the background checks under I-594, passed out of 5552 amended and out of the House Judiciary Committee on what appeared to be a unanimous a voice vote on Wednesday.  The bill was amended in committee to add firearms loaned to veterans color guards to the list of background check exemptions.

 

Recall this is the bill that COULD be amended to add CPL holders to the exemption list.  That would change it from minor tweaks to a major pro-gun bill.  But that’s going to take pressure from constituents.  The bill can be further amended on the House floor at the end of March/early April..

 

At this point, two bills (1100, 1501) are scheduled for public hearings and an executive session for 5268.  Details below.

There’s been a little motion on our five bills of interest after a week of public hearings.  HB 1100 passed out of Senate Law & Justice to Senate Ways & Means.  HB 1612 passed out of Senate Human Services to Senate Ways & Means.  Both of these will have to clear that fiscal committee before moving on.

 

Senate Bill 5268 passed out of House Judiciary to House Appropriations, more fiscal action. SB 5552 still sits in House Rules awaiting a floor vote (not likely until next month).  A public hearing was held on HB 1501, so we can expect it to be subjected to a Senate Law & Justice committee vote next week.

 

The second chamber (House bills in Senate, etc) policy committee cut-off is next Wednesday, 29 March.  We’re past that with the five bills we’re following.  The fiscal committee cut-off is the following Tuesday, 4 April.  HBs 1100, 1612 and SB 5268 are awaiting that hurdle.

The second chamber policy committee cut-off passed Wednesday.  The only bill remaining in a policy committee, HB 1501 in Senate Law & Justice, was amended in committee and sent to Senate Ways & Means.

 

HB 1100 was passed out of Senate Ways & Means and sent to Senate Rules awaiting a floor vote.  An attempt by committee Democrats to limit the CPL renewal notification to e-mail only, vice e-mail and snail mail (postcard) was defeated.

 

All bills currently being tracked (HB 1100, HB 1501, HB 1612, SB 5268) are sitting in their appropriate fiscal committee awaiting action before Tuesday’s fiscal cut-off.  SB 5552 is in House Rules awaiting a floor vote.

     SPECIAL SESSION?

 

 

Two bills passed out of their respective chamber this week.  HB 1100 passed out of the Senate.  We’re waiting to see if the counterpart bill (duplicate) passes out of the House.  One way or another, unless the governor vetoes either bill, you can expect a postcard or e-mail renewal notice 90 days before your CPL expires.

 

SB 5552 passed out of the House but must go back to the Senate to have them concur (or non-concur) in the House amendment.  The bill slightly relaxes a few of the I-594 background check requirements.  We tried to amend the bill to authorize direct transfers between CPL holders, both of whom have passed a more stringent background check than that required by I-594.  The amendment was blocked in the Democrat House.

 

HBs 1501 (NICS denial reporting) and 1612 (suicide prevention) and SB 5268 sit in their respective Rules Committees awaiting a floor vote.  They must pass by next Wednesday, 12 April.

 

After next Wednesday,  the focus shift to bills that approve and implement the budget.  The only non-budget bills that may be voted on are those that were amended in the second chamber and need to be sent to a conference committee (both House and Senate members) to reconcile and then get an up-or-down vote.

 

The long session years (odd-numbered years) are general budget adoption years.  If a budget has not been adopted by the constitutional end of the session (midnight, 23 April this cycle), a special session of up to 30 days must be called.  While the principal focus of the special session may be the budget, ALL bills not passed during the regular session may be reconsidered.  So special sessions can be sneaky and dangerous.

 

And, as we have seen in the last two budget years (2013, 2015), with split control of the legislature, it may take more than one special session to agree on a budget.  Two special sessions may be necessary, possibly three.  The whole idea with the Inslee administration is to squeeze as much tax money blood out of the productive population base rock as they can to fund their pet  projects (like sanctuary state support of illegal aliens).

For most bills, the legislative session effectively ended Wednesday at 5 p.m.  The remaining nine days focus  on budgets and reconciliation between differences in bills as passed by each chamber (e.g. House bill amended in the Senate or vice versa).  

 

HB 1612 passed out of the Senate and SB 5268 passed the House.

 

And then there is HB 1501, reporting of NICS denials.  The bill died in the Senate on Wednesday, but apparently the plan is to amend it into one of the budget bills, which are still open to amendment.  Under Washington law, bills must be limited to a single subject and amendments outside the scope of the bill cannot be made.  This is the excuse they used to block the CPL transfer amendment to SB 5552.  So I don’t see how HB 1501 fits a budget bill.  We’ll know in a week or so.

 

(Let me throw in here what happened to the Koster Amendments to SB 5552, that would have added CPL holders to the exemptions in I-594..  The amendments were offered on the floor, but ruled out of order by House Democrat leadership.  In no way were the amendments out of order.  But “leadership” makes the final decision.  The House Democrat leaders weren’t about to allow us to make a mediocre bill into a solid pro-gun bill.)

 

We are essentially down to four bills at this point:  HB 1100 or SB 5268, the CPL renewal notice bills.  Both bills were amended in the second chamber so one of the two must gain concurrence vote) in its original chamber before it goes to the Governor.

 

HB 1612, suicide prevention, was amended in the Senate, so we’re awaiting a House concurrence vote.

 

SB 5552 was amended in the House, so must pass a concurrence vote in the Senate.

The reason for the long (105 day) session is to give legislators time to develop an operating budget for the state.  Since 2010, they have not been able to finish this work on time and have had to go into special sessions of 30 days (maximum) each.  The major problem here is split control of the legislature – Majority Coalition Senate and Democrat House.  One presents a balanced budget, the other wants major tax increases – I’ll let you guess which.  (Interesting to note that back in the late 1990s, the Republican Congress and President Bill Clinton worked together to pass balanced budgets.  That’s when you had a pragmatic chief executive that was willing to work with Republicans. )

 

Whether the legislature drags it out until Sunday night (Day 105) or shuts down earlier is irrelevant as far as the gun issue is concerned.  The governor says he will call a special session to start Monday, 24 April to resolve the budget impasse.  Let’s hope they can solve it in 30 days.

 

HB 1100 (CPL renewal notice) was signed by the Governor on 19 April – Patriot’s Day.  If a bill reaches the governor’s desk more than five days before the end of the session, he has five days to sign it.  It it reaches him with five days or less, he has 20 days after the end of the session to sign.

 

SB 5268 was rendered moot as HB 1100, it’s House duplicate bill, went to the Governor.  HBs 1612, 1501 and SB 5552 await the governor’s signature.

     NO ACTION ON BILLS

 

 

I was at the annual NRA convention and meetings in Atlanta last Friday, but nothing happened anyway!

 

Governor Inslee signed HB 1100 (CPL renewal postcard) a week before the session ended.  The first postcards should go out in late summer (they have to set up the system first).

 

Still awaiting the governor’s signature are HB 1501 (NICS denial police notification), HB 1612 (suicide prevention), SB 5268 (CPL renewal e-mail notification) and SB 5552 (limited I-594 background check exemptions.  (Correction, SB 5268 did squeak out just before the regular session ended.)

 

The governor has 20 days to act on bills after the session ends.  That means he has until 13 May to take action on the four bills listed above.  Governor Inslee has three options available: he can sign a bill into law; he can veto an entire bill or part of a bill, in which case the legislature has the opportunity to override on the next session; or he can take no action, in which case the bill becomes law anyway.  Why decline to take action?  Maybe the governor doesn’t like it, but doesn’t feel it is important enough to veto.  This is the guy who wants $8 billion in new taxes, despite the fact that the Republican-controlled Senate passed a balanced operating budget.

 

At this point, 12 days into the up-to-30 day special session, no gun bills have been pulled back out, nor have new bills been filed.

 

As next Saturday is the last day the governor can act on bills, I’ll likely get the next GOAL Post out over next weekend.

I reported last week that Governor Inslee signed HB 1100.  That means that starting in late summer or early fall (it takes time to set up the system), CPL holders will receive a postcard renewal notice 90 days before their CPL expires.

 

On May 10th, the governor signed the remaining four gun-related bills awaiting action.  He signed HB 1501, HB 1612, SB 5268 and SB 5552.

 

HB 1501 requires licensed dealers to notify the Washington Association of Sheriffs and Police Chiefs (WASPC) within five days if an individual pops negative (denial) on a NICS test.  Denials may then be reported to the county prosecutor for his/her action, if appropriate.  And if a person has a protection or no contact court order against the attempted buyer, the protected person must be notified that the individual attempted to acquire a firearm.  Three things here: first, false “denials” are common, either because of mistaken identity or incorrect court documents (especially true of decades-old misdemeanor convictions).  Second, an appeal may be filed to correct the record, thus preventing prosecution.  Third, prosecution for what?  An intentional false answer on an ATF Form 4443 is a false official statement, which is a violation of FEDERAL law.  Whether it’s prosecutable as a state offense remains to be seen.

 

HB 1612 is a continuation of last year’s suicide prevention education bill.  Among other measures, the program attempts to educated dealers on the outward signs of suicidal intent by some individuals.  (I don’t recall the state, but many, many moons ago an eastern state prohibited sale of a handgun with either one round of ammunition or one magazine/cylinder load of ammunition.  The former as a suicide preventive measure, the latter to supposedly restrict workplace violence.

 

SB 5268 adds e-mail notification of CPL expiration/renewal date provided an e-mail address was provided.

 

SB 5552 is the bone Democrats threw to gun owners this session, after they killed several solidly pro-gun bills.  SB 5552 adds a few exceptions to the background check requirement of I-594, most dealing with close family members (in-laws).   It also adds language exempting individuals with federal Curio & Relic licenses from background checks (on C&R-eligible firearms only), taking firearms away from suicidal individuals, and exempting background checks on temporary transfer of firearms to armed security guards by their employer, and transfer of firearms to military honor guards for funeral ceremonies.

 

The bills take effect on 1 July.  That should close out the 2017 regular legislative session.

 

There are 10 days left in the 30-day Special Session as I write this, ten more days for the House and Senate to agree on a biennial operating budget.  As reported before, the Republican-controlled Senate passed a balanced budget, funding all required programs, while the House passed a budget asking for $8 BILLION in tax increases.  It’s hard to imagine how the two can be reconciled.  2/3 of the way through the session it does not appear there are any breakthroughs.

     PROCEDURAL NOTE

 

     CRITICAL SPECIAL ELECTION AHEAD

 

 

The first special session ended earlier this week without budget resolution.  Therefore the governor called them back immediately into a second special session.  We’re now four days into the second 30-day special session.

 

As I have reported in the past, those bills that did not pass the legislature during the previous session – bills that died in committee or awaiting a floor vote -- are still alive for legislative purposes.  They can be called back and acted on in any subsequent session during the biennium (2017-2018).  As a general rule, his does not happen, but it is something we need to be alert to.  Those bills (more than 2,000 of them) are effectively frozen in place, and the bills are annotated “BY RESOLUTION, REINTRODUCED AND RETAINED IN PRESENT STATUS.”  This is NOT a reintroduction of the bill, nor is it an indication that any action is intended… at this time.   

 

A critical special session will be held later this year.  As a result of vacancies that occurred just after the general election last November, several seats are up for what is called “confirmation” to elect the temporary appointees.  There will be special elections this year for five vacated Senate seats and three vacated House seats.

 

Control of the Senate rests on the Senate elections.  If the Majority Coalition (24 Republicans and one conservative Democrat) lose a single seat (of the three currently held by Republicans), the Democrats take control of the Senate.  At that time it’ll be a race to see what happens first:  more gun control bills or higher taxes (the race will likely result in a tie, with both passing).

 

The three districts with Republican incumbents that need to hold their seats are in the 7th (northeast Washington), 31st (south King/north Pierce counties) and the 45th (north King/south Snohomish counties).  The biggest fight will be in the 45th, and probably also the 31st.  The 7th is a safe Republican district.

 

A Primary Election will be held on Tuesday, 1 August.  The General Election is on Tuesday, 7 November.

As the budget impasse continues, some progress is being made.  While it does not impact the gun issue, I’m including a link here to a Seattle Times article from last weekend explaining exactly where the opposing sides stand.  It looks like the principal question is not whether Washingtonians will pay more in taxes, but which taxes will be raised.

THREE STRIKES, YOU’RE OUT!  THIRD SPECIAL 
SESSION      GOVERNMENT SHUTDOWN IMMINENT -- MAYBE      
IMPACT ON GUN OWNERS  

The THIRD special session of the legislature started on Wednesday, 21 June.  They’re still hung up on the state operating budget.  All bills that have not been passed to date go back to their original chamber (House bills to House, Senate bills to Senate).  

This is similar to 2013 and 2015, when the legislature required multiple special sessions to pass the required operating budget by June 30th and the governor had to sign it at the last minute to keep state agencies operating.  30 June is next Friday.  This is all about the Governor and Democrats demanding more tax revenue. 

The House and Senate convene every other day or so, them immediately shut down for a couple more days while the budget conferees continue to disagree. 

Should the budget not pass by 1 July, many state agencies will shut down or go on reduced operations.  Some, mostly those with public safety functions, (e.g police, fire, medical, etc.), will remain fully or partly functional.  How this will impact gun owners remains to be seen.  Rumors are floating around that this will shut down gun shops, or at least gun sales/transfers.  Not quite.  Background checks for long guns are sent straight to the FBI’s NICS system, so that’s transparent to the state.  But handgun checks are local.  The state operating budget has little impact on local agencies, although access to data bases such as DSHS for mental health checks is problematic. 

The problem with all of these background check systems is they rely on government living up to its obligation to allow people to exercise fundamental rights without hindrance or delay.  By inserting the government into the middle of what should be private business between two individuals, they can effectively and arbitrarily shut down a constitutional right.  In the words of Dr. Martin Luther King, “A right delayed is a right denied.”  (Under federal law, if a NICS check cannot be completed within three days, the sale/transfer may go forward.  But NICS isn’t the problem in this scenario.)
