I know that in most cases for a Delaware (or any other state) resident to purchase from an FFL is to have shipped to an FFL in the purchaser's home state.  However if one was doing a private transaction, is it kosher to do a transfer to an out of state resident?  I am going to transfer a pistol to a friend who is currently a resident of out state and just trying to figure out where we need to go to get squared away.

 

You have two legal options to do the transfer.

1.  The transfer needs to be done at a Delaware FFL.  It does not need to be shipped, you can hand carry it to Delaware.

2.  Both of you travel to northern Texas and do the transfer there.  Those provisions of the 1968 GCA have been ruled unconstitutional in areas under the jurisdiction of the US District Court for the Northern District of Texas.
