I know that in most cases for a Delaware (or any other state) resident to purchase from an FFL is to have shipped to an FFL in the purchaser's home state.  However if one was doing a private transaction, is it kosher to do a transfer to an out of state resident?  I am going to transfer a pistol to a friend who is currently a resident of out state and just trying to figure out where we need to go to get squared away.

Pennsylvania handgun transfers must take place through an FFL, even if both buyer and seller are PA residents... unless the exchange is between family members such as parent and child, grandparent and grandchild, or spouses.  There are no private handgun transfers in PA without going through PICS.  (some states are different)





Since your friend is a DE resident and you are a PA resident, now Federal law comes into play and you must go through an FFL - there's no "private transfer" between residents of different states.

You have two legal options to do the transfer.

1.  The transfer needs to be done at a Delaware FFL.  It does not need to be shipped, you can hand carry it to Delaware.

2.  Both of you travel to northern Texas and do the transfer there.  Those provisions of the 1968 GCA have been ruled unconstitutional in areas under the jurisdiction of the US District Court for the Northern District of Texas.
