Apparently I am late to the party to hear about this.
If you shoulder an AR pistol without the brace -- just using the buffer tube , does that make it an SBR in the eyes of the ATF?

No. There are a million threads on this.

You can shoulder the buffer tube. You can have a Sig Brace on, so long as it's used as a brace. Once you shoulder the brace it becomes a stock.

Yes, it's ridiculous, but that's what it is.

"technically".. its "is your INTENT" to use it as a stock... = bad


but if you dont INTEND to shoulder it, it just "happens", then the letter of the law is still correct..
 






remember, shooting you pistol with 2 hands would be a AOW, by the "current" ATF "rules"




The term "Pistol” means a weapon originally designed, made, and intended to fire a projectile (bullet) from one or more barrels when held in one hand,

There's this letter floating around the AR pistol forum, originally asked about those CAA cheek weld "enhancers", but the ATF makes the statement:

However, if a pistol assembled with an AR-type buffer tube or similar component; which
in turn redesigns the subject AR-type pistol to be designed or redesigned and
consequently intended to be fired from the shoulder; an NFA weapon as defined in 26
U.S.C. $ 58a5(a)(3); has been made.


The slippery slope is still "intent".
