Prop. 47's effect on jail time, drug rehabilitation is mixed so far

The legislature has intriduced a couple fixes. One making theft of a firearm a felony again. Another dealing with DNA collection at time of booking or conviction.

Nothing yet addressing the worst parts. which was making commercial burglary and possession of stolen property simple citations.

Yep, that is pretty much what I'm seeing in my city.  (First three months - first quarter)

The only interesting part is those who are sentenced to a year in jail are now actually serving their sentence.

There has been just enough space saved that the constant early releases are not happening.   The rest of it sucks bad, how it takes 950 dollars or more of value to make a felony is the worst damn idea anyone has ever had.

State law give good time and work time credits. You cant serve a year of a year if you wanted to.

What I am talking about is a jail being at max capacity with a bunch of inmates serving time.   A new guy with a year comes in and there is no room so one of the people with time + good and worked gets kicked despite not having enough credits to count as a complete sentence.   In other words people kicked after serving maybe 1/4 of their time...

Not talking about good and worked credits allowing a person to get out in 6 months if they have 180 days in custody plus 180 days good and worked.

Talking about a guy with a year to do getting booted in 2 months because of jail overcrowding and essentially getting a 1/3 time kick.

That is the kind of shit that has stopped.   Also probation violators are absolutely getting to go back for full time.   I have personally seen people on probation violation cases complaining about prop 47 because they know if they admit to the violation there is a damn good chance of them doing the rest of the remaining time without getting a kick.

Taft knows what I am talking about, we are both in the same county and know how the local Jail and courts operate.

Inmates/defendants became math wizards at being able to figure out how much actual time they would do for various crimes by being able to count on the 1/3 time kicks.   Now, not so much.

Uglygun is right on the money.

Our county, as is some other California counties, are experiencing population shifts (down sizing) due to Prop 47.

For the first time in 20 years our jail no longer has a "Fed Cap"  which is a capacity setting identifying how many inmates a jail can have.   If exceeded, then the sheriff must release to get below that magic number.   Instead of felony and misdemeanor inmates leaving in 1/10 time (basically a tenth of their original sentence) they are serving full time, what the law calls "one for one".   A year sentence means out in 6 months with good behavior. Under some programs, if you have a job lined up you may get out earlier than that.  

Can they serve more than one year ?   Absolutely.   We have a guy there right now whose projected out date is the year 2021.    He had 6 pending felony cases, 6 probation violations, and 3 separate sentencing enhancements due to selling large quantities of drugs, and selling them near a school. It all compounded.  And because they were all non serious, non sexual, non violent, he will never make it to state prison.  All thanks to AB109.  All said and done he got 29 years in county jail.   That was 3 years ago.  

All in a county jail, any county jail, designed for year max sentences.
