My father just passed and had a Mossburg 88 with a pistol grip and extended mag tube.

Since I don't shoot the shotguns I have my Uncle has asked for it for home defense.  I have no problem with giving it to him but need to know if a shotgun like this is legal in CA.

Would he have any obligations to register once he goes back to CA this fall?

I ask as he had lived in San Diego for 30 years and was a dyed in the wool liberal until moving to Ohio for the past 5 years.  He (I) know nothing of CA law on this (he is very new to firearms) and I don't want him to get into trouble when he moves back there after the second cold day of winter here in Ohio.

I believe he will have to register it, by sending in a form.  but it is legal.  pump shotguns are GTG is long as they are not too short.

He lived in SC for 30 years but moved back to Ohio with my father for the last 5 years.  After last winter I figure he will make it through the first cold day of winter here this year and be on the road back to CA on the next day. I wish he would stay but 30 years are a lot of roots to give up for a nephew (me) you don't know all that well.

Pistol grips and extended mag tubes are legal in CA if registered?  If so I will let him know.

yes PGs and extended mag tubes (10 rounds or less) are OK on non-autoloaders.  he needs only to "report" the gun when he moves back to CA.

if you want to keep him around, take him deer hunting.  I hunt in MI and there is nothing like it in CA.

If it had BOTH a 9-round tube AND a pistol grip, it would still be CA legal.

Here are the relevant parts of Section 12276.1

(6) A semiautomatic shotgun that has both of the following:
  (A) A folding or telescoping stock.
  (B) A pistol grip that protrudes conspicuously beneath the action
of the weapon, thumbhole stock, or vertical handgrip.

(7) A semiautomatic shotgun that has the ability to accept a
detachable magazine.

(8) Any shotgun with a revolving cylinder.

looks like I was rusty on my SG law.

an 1100 with a 10-or-less round mag and a PG is OK.

You may have been thinking of the defunct 1994 Federal Assault Weapons Ban.

For shotguns:
semi-auto + pistol grip + >5 round capacity = banned

The AWB was the main reason I purchased a Beretta 1201FP at the time.  I wish I still had it...

Some guy at work told me that a Benelli M-3 Super 90 with a pistol grip
is on the "ban list" (Like AR-15's)..

It's a semi-auto (and pump) AND has pistol grip.

BUT it has an 8 round capacity.

So Legal or Illegal?

He is wrong. It's not on the ban list. I just checked to be sure. As long as it is pistol grip but has a solid stock, it is good to go. The folding/collapsible stock would be an assault weapon, however.
