THE IMAGE ABOVE IS A PAID ADVERTISEMENT
I was told the other day that it is illegal for a California gun shop to accept a firearms transfer from a non-FFL. Any truth to this?

So that doing a private party transfer is illegal?

Nope - handguns need to go through an FFL with both private parties.

If you mean accepting a transfer from an out-of-state unknown, yes, I think that requires an FFL to FFL transfer.

I have had several private party ship direct to my local FFL. No issues. The FFL receiving needs a copy of senders' ID; a state issues drivers' license or military ID. That is all. And this is for long guns, and short ones.

No to both questions. My FFL has received both long and short guns from a non-ffl holder. I have also shipped as a private individual to a FFL.

No Federal law prohibits such shipping, It is up to the individual FFL weather he(or she) will accept from a non-ffl.

There are no Federal or CA laws that mandate that a firearm must be shipped by a FFL dealer.

It is up to the individual FFL on if they will accept a firearm shipment from an individual or from FFLs only.

Well then, that brightens my mood, now to just find a dealer up here that will A) do this and B) Won't rape me with a mojave green on the transfer fee.

I accept tansfers from non dealers all the time.

Hell it's easyer untill there is a problem. Most of the time it goes super smooth.
Once in a while, the buyer is prohibited.. then you have problems. You cant send the gun back to the shipper becasue he isnt an FFL.

In almost ten years behind the counter... I have had maybe 5 transfers not go so well.

Me too... I thought you must have been north or Santa Cruz to call it up here..

I guess Antilope Valley feels like "up here" from the LA basin ;)

Help me out on this one, The shipper is still the owner if the buyer is prohibited, yes? I have shipped firearms for repair or refinish and they are shipped back to me directly(non-ffl). Why can't you ship it back to the seller?

Because it is not a repair.

The only time an FFL can ship directly to an individual is when it is a gunsmith returning a firearm to the owner.
I actually keep a seperate book for gunsmithing to make a clear distinction between them.
