68A-12.002            General Methods of Taking Game; Prohibitions

PURPOSE AND EFFECT: The purpose of the proposed rule amendment is to remove certain restrictions on methods for taking game birds, crows or game animals. The effect of the proposed rule amendment will be to allow noise-suppressed (i.e., silencer-equipped) rifles and pistols for taking deer, gray squirrels, rabbits, wild turkeys, quail, and crows.

SUMMARY: The proposed rule amendment would remove the prohibition on the use of noise-suppressed (i.e., silencer-equipped) rifles and pistols for taking deer, gray squirrels, rabbits, wild turkeys, quail, and crows.

SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION: The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: the nature of the rule and the preliminary analysis conducted to determine whether a SERC was required.

Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

RULEMAKING AUTHORITY: Article IV, Section 9, Florida Constitution.

LAW IMPLEMENTED: Article IV, Section 9, Florida Constitution.

ETA: OK, I went and looked at the definitions, and silencers were only prohibited for taking: game birds, crows or game mammals.

Glad to hear that hunting with a suppressor is now legal.




I looked at the following link:








And saw that hunting with a full auto firearm is still illegal.  There should at least be an exception if it is used in semi-auto.

Question:

So I can hunt with my Saker 7.62 once it gets out of jail.  Can I use it on a SBR? Or does it have to be on a "non-NFA rifle'?

As far as I can tell, there are no prohibitions on using an SBR for taking game in Florida.

You might want to double check with FWC though.


Just be professional,  not like "I can use my danggon SBR high capacity azzault Mk18 SOPMOD Delta SEAL riffle fer blastin deer, right?"

The way the law was previously using a suppressor while hunting hogs on private property was completely legal because it was considered property of the land owner. And still is today. The problem is when hunting hogs on public land, hogs magically become a game animal not an invasive species. The rule in the EO that is published only calls out certain game and specifically leaves out hogs.

I'm trying to go through the regs now to see exactly how its spelled out, but I am not seeing an exception for hogs on public land (yet, trying to go through the FAC without much luck).

I believe you are thinking of WMA's.  Then they are as holy as the kings deer.  Could be mistaken though
