My stamp should be coming soon. Can you legally go ahead build the upper as long as you don't mate it with the lower? I would like to do it this weekend if legal cause I'm busy during the week. Thinking I will get approved Monday or Tuesday

Technically, and legally, no. Having the parts needed to build an SBR, without an approved form, is considered to be constructive possession of an illegal SBR.

For the umpteenth time, when building SBR from parts, always build it as a pistol, slap on stock when stamp arrives.

For clarifiacation, this only works if starting with a virgin lower, or a lower first built as a pistol. If the lower was first built as a rifle, this is a no-go.

For clarifiacation, this only works if starting with a virgin lower, or a lower first built as a pistol. If the lower was first built as a rifle, this is a no-go.


Or for restricted states, MA does not allow AR pistols so that's not an option.
Once I got approved I picked up my BCG and barrel from my dealer but I had everything else ready to go. Had it completed the same day I got my stamp.

Even though I have not received the stamp yet, I have paid the tax and registered a NFA firearm with the AFT Form 1 as required by the above response from the AFT.  So am I legally able to, per the AFT,  acquire parts to assemble the firearm?

No, they may have taken your money, but the form isn't valid until stamped and the gun isn't in the registry until that point either. If that was the case everyone would be doing it.

I think you are confusing this, when they talk about paying an SOT, that is for an FFL, and completely different than a non-licensee building an SBR. Once you have yer stamp yer good, until then it doesn't matter if you've paid for it, it isn't approved yet and not valid.

Just be patient. There will be plenty of parts in a few more months when yer approved!
