Currently, all my lowers are registered SBR's. If I'm hunting and put a 16" upper on it, can my friend use it without me and the form 4 present? Essentially, is the lower now always treated similar to a silencer whether or not it has a <16" barrel on it?

Yes, that's fine unless your friend is in possession of the parts to make it into an NFA configuration...

AR SBR's are like swingers, they can go both ways.

If properly registered, they can sport a shorty uppper on them, and be a full NFA item, with the possession restricitons.

But if you have a rifle upper, they are a regular rilfe without restrictions.
