I was looking over my trust and my lawyer set the age 21 for my beneficiaries for the nfa items... Isnt 18 yrs of age, the restriction? When I do pass and its time to distribute the nfa in the trust... Will my beneficiaries legally qualify to own and transfer the trust nfa into their names so long as they are the age of 18? I would like this confirmed so I can have my lawyer change the age. Thanks!

First, see the letter below. Under federal law, SBRs and SBS's may be legally possessed by those between the ages of 18 and 21. State law may vary, and override federal law. Other ATF rulings I have seen indicate suppressors are also in this category.

However, machine guns, DDs and AOWs are in limbo under federal law, so I would not venture there unless the recipient is 21.
