THE IMAGE ABOVE IS A PAID ADVERTISEMENT I am sending off my first 2 Form 1's tomorrow, and I have a few quick questions about a trust. Specifically, along with my 2 Form 1's (front and back), $200.00 separate checks made out to the Department of Justice, do I include: 1) one copy of my Declaration of Trust, or do I need to include two? 2) one or two copies of my Certificate of Trust (not compliance), or is this not necessary? 3) only 1 copy of my certificate of compliance or do I send 2 since I'm applying for 2 tax stamps? Also I'm assuming that it's OK to send both Form 1's together in the same packet, as long as everything is paper clipped separately? Thanks so much, and I apologize in advance for the redundant question. Just wanting to make sure I don't screw this up, and cause any unnecessary delays. |

Two originals of each form 1 (submit in duplicate), for a total of four forms 1, front and back. Not just one of each front and back. Two checks are not necessary, but if that's how you wanna do, it's OK. One for $400 would have worked, too. The Cert of compliance is not actually necessary, but it's ok to send one. |

What about the full trust document, 1 copy or 2? Also, do I need to send in the certificate of trust, along with the full trust, or is that overkill? Thanks again |

Only 1 copy of the trust document is needed, but it can't hurt to send two, if you want.
I don't know what a certificate of trust is, so can't help you there. |

Great. Thanks for the info. I included 2 copies of the trust when I mailed the packet today. Probably overkill but they can always throw one away. The certificate of trust is simply the 3-4 page document that essentially says you have a trust. It's signed and notarized as well. I think the BATFE used to accept those, but now they want the whole enchilada. I don't know why they would need both the declaration and the certificate but I thought I would make sure. Anyway, the forms are in the mail. Now it's just a waiting game. Come on 2013…

BATFE published in their newsletter in 2008 that if you are using a corp or trust, NO Cert of Compliance is needed. HOWEVER, at least one Arfcomer got his forms kicked back for the LACK of this form. Appears some examiners want it, and some do not. What does all this tell us? Rule: including that unecessary form never causes a problem, but there is a chance of a problem if you don't include it. |
