I will be going to see a friend in Texas and I plan on taking my SBR AR with me. I have the form 5320.20 back and approved. My question is I usually fly out of

Milwaukee, WI (where my SBR is kept) less of a hassle But this time I will be flying out of Shitcago (chicago, IL). I will be traveling from our place in WI over the

boarder going to Chicago and flying from there to Texas. My question is should I be okay with form 5320.20 driving from a NFA friendly state (WI) to a non NFA

friendly state (IL) Flying out of IL to TX? I think i should just want to double check.

Thanks Folks

Maybe try in the IL hometown forum? Post back here what you find if you get a chance as I'd be interested to know. Hopefully they don't do things like NY.

Arrest you.
NYS has many accounts on record of not honoring FOPA.
If someone from VT goes to Albany to fly to TX with a handgun they get arrested if they don't have a NYS pistol permit. Similar things happen with the port authority downstate. I haven't heard of any issues with NFA stuff specifically though but I wouldn't be surprised.

I have no idea how Chicago does things though just to be clear.

You don't want this happening to you in Chicago and those guys were only there to pay their taxes.

I would personally avoid Airports anywhere in IL with an NFA item at all cost. Just fly out somewhere else or leave it at home, the laws in IL change every 5 minutes as you pass through different towns, cities, and counties; plus you may not have a required FOID card either. This is just my opinion, but I travel to IL a few times a year and I have never felt comfortable even mentioning firearms in that state without fearing the Gestapo might be within earshot. Your call, but they don't have to honor FOPA if they don't want to, NY has proven FOPA offers zero protection for citizens time and time again......
It was broke when I found it.....

You are protected under federal law as long as it is legal at your destination and where you are coming from. This would include traveling through an airport in an NFA-unfriendly state.

As was pointed out, some states like NY tend to ignore the federal laws. You might win eventually, but it's going to be a long time and will be expensive. You'll miss your flight if they want to be a pain about it too.

Now from personal experience, I have driven from Michigan, boarded a plane with an Uzi SMG in my declared checked baggage and did not have any issues. This was in '06 or '07. Looking back, I don't know that this was the smartest thing for me to have done, and I don't plan to try it again. Again, I was completely legal in doing so. But convincing an unfriendly prosecutor of this would have been a lot more hassle and expense than I really care to go through.

You can legally ship the rifle to yourself at your friend's place, c/o the friend. This would give the least potential for problems.
