Does anyone have a scorpion with the SBtactical sbtevo brace, the new folding one?   Does it go past the 26 inch defintion of a "firearm"

I believe it falls short at about 25 and some change.

Correct me if I'm wrong, but since the brace is not permanently mounted it's NOT counted towards overall length.  

I've always been told flash hiders don't count since they're removable unless they're pinned & welded.

IF a brace DOES count, the shockwave on my Evo can easily be adjusted for over 26" overall.

Using the 26" logic that is used on the uzi carbine with wood stock, it would require a tool to disassemble.  
The scorpion with shockwave requires a tool to change size, so one would  THINK as long as it is assembled 26"+ you would be good to go.

If the sbt allows the takedown button to be exposed, likely not since one with small strong fingers could remove it without tool.

I dont think I've seen anyone exploit this rule yet, but most likely because with the brace maxed out to get you 26"+, you wind up with a hideous LOP.

Doesn't the firearm have to start life as an "Other" on the 4473 for the >26" with a vertical grip rule to apply?

I think with shotguns, yes. However because you're running into a length change modifying the class of firearm here, that wouldnt be the case.

I measured mine and it falls short of 26 inches.  With the flash suppressor removed it's short by 2 full inches and a little more.
