Just got off the phone with the ATF and they told me my paperwork has been put in problem status as of June 18th. It's been pending since Jan. 30th. I was told I would be receiving a letter from them. I am assuming that this letter will tell me what the problem is or that I'm going to have to play detective to figure out what's wrong. I have a feeling I already know what's wrong. I believe that the the dealer (who is also the attorney that drew up my trust) told me to send the wrong copies of my trust. Plus the fact that I had no Schedule A since I didn't have anything in the trust yet. I know a lot of guys have put $1 just to have something in the trust, but the attorney told me that wasn't necessary. Until I get the letter from the ATF I can only speculate what the problem is.

I know that it pisses me off to have waited this long and have a problem come up, especially one that probably could have been avoided in the first place.

On the plus side, you are at the top of the pile, so once the problem is corrected, it'll be processed (most likely) in very short order! Good luck!

Thanks! I spoke to my local dealer just after I posted this thread and they had received the letter. I was told my forms were kicked back because I didn't have the Schedule A. The dealer/attorney put $1 in my trust and mailed them the Schedule A. I think that is ridiculous on the part of the ATF but whatever, I just want my stamp so I can get my can. I'm going to give it two weeks then I'm going to call back and make sure I'm out of problem status.

In some/most states, the trust does not become legally valid until it contains something. A trust is a legal entity solely designed to hold property, and it must have something to hold before the legal creation takes effect.

When I started my trust, I had originally put a copy of Unintended Consequences into it, but after a little thought I decided that I didn't want to take the chance of pissing off the folks that actually approve my NFA paperwork. So, I changed it to my son's favorite book that I read to him when he was little - When I Get Bigger, by Mercer Mayer.

Can't you just add the rifle you're going to SBR into the schedule prior to sending the paperwork in?

I don't know. I have a stripped upper that's eventually going to be a SBR in the future.
