If the mag has a blank floor plate and no stampings, is it legal under NYS law?

Thanks.

Well this is my first post, but when I buy my mags I make sure there is at least some kind of manufacture marking just to date the thing.

Are they parkerized steel or aluminum? If they are steel, they are most likely British SA80/AR mags and are preban(also pretty good mags, they work great unlike most steel). If they're aluminum then I am not sure, have you checked for internal markings?

You should be sure your self that they are September 94' or older. If they have absolutely NO markings then how would the state PROVE they were made after Sep. 94'? Thats usually what I go by. You can also ask in the http://www.ar15.com/forums/f_8/9_.html .

Considering you can buy blank floor plates as replacements for broken ones, I would avoid relying on that. Especially in a high volitile and anti-gun state like NY.

Besides, the floor plate does not necessarily dictate when the entire magazine was made. If you buy a mag repair kit, it comes with a new spring, new floor plate, and follower.

I would think that the burden of proof would fall on NYS to prove they were NOT pre-ban.

The burden of proof is always that of the defendant. Good luck with that.

The burden of proof is on the prosecution. Defendant doesn't have to lift a finger.
