Just looked at the sellers feedback, most shit he selling is fake.

Sellers new return policy's: "Due to the nature of this item. We will extend a 3 day no fire inspection period. If during this period the item does not meet buyers expectations we will offer a refund. Given the following conditions are met. Buyer notifies us via contact buyer that they want to return item do not attempt to return the item through the e bay system this will add time to the return process and limit what we can do to fix problem and may void the return entirely.So once again just contact us through email or the contact seller button.If you open a case through ebay we will cease communication and file court papers that same day. All communication at this point will be in court. Buyer will leave positive or no feedback at all nor post anything negative.Buyer pays all shipping cost. Item is returned in the exact condition sent out with no marks or signs of wear or alteration item can not be fired. If all these terms are met we will gladly issue a refund upon receipt of item back. If any of these conditions are not met we will not issue a refund of any kind. OP, just file a claim for fraud with your CC. All it takes is a phone call. Hell, this works even with legit companies and products. My wife got me a new radar detector and laser jammer for Christmas. Only problem is she ordered the wrong detector. She bought direct from Escort. After 3 phone calls and 4 emails trying to exchange it, still no response from them. She called Discover. She got her money back, still no word from Escort, and the jammer and detector are still sitting NIW on my dresser, waiting to hear from them. OP, it really is that easy. |

Older thread but I'm curious if there has been any update on this? I have found myself in the same situation with a different seller, 5 miles away from this one. Same scenario. Wish I would have found this prior to purchasing. I'm also curious what the civil suit is filed as, he claimed he was treating mine as a fraudulent charge back which hasn't occurred as I have not done a charge back and am letting eBay handle.

I have no doubt his "case" would get thrown out but my concern is this; if you counter sue for court cost and travel cost even if judgement is found in your favor there's no way to guarantee payment. The only real way to get any kind of retribution is a criminal case; is there any way to go for extortion with this guy since he's trying to get an absurd amount of money for his shady counterfeit item business?
I keep finding mixed reviews of he's even capable of suing an out of state person, most sights I've found keep saying he would have to travel to the buyers state. Does Utah no have this provision?? Maybe if we get enough scammed people in on this we can file a suite as one and defer costs... |

If they pay you need to notify the courthouse so they can notate the person's credit report accordingly least you fall foul of the FCRA. |

Still battling with eBay for a refund. They have given the seller several chances to pay for return shipping. Unfortunately I have explained several times the item is now evidence and I was advised to maintain it in my possession. Supposedly I will have an answer from eBay by May 3, unless they extend it again for some reason. I believe Midwest industries and their lawyer have been in contact with the individual as well.

OP, was any thought given to a counter claim for fraud or violation of a consumer protection act? In my State this guy would be setting himself up to pay your attorney's fees and quite possibly treble damages.
