My friend's dog bit a flower delivery person. She has no homeowner's insurance.



She was in the hospital when this happened, the basic facts are the person made the flower delivery, went back to the house and opened the storm door after supposedly seeing someone in the house, then the dog came around from the back yard and bit her. Dog was contained by electronic fence outside. The delivery person said in a voice mail she had been bitten before. This dog - a retriever mutt combo - has no priors.




She just got served with a summons, the delivery lady has retained an attorney and wants $25k. She has no assets.




Thoughts on a defense or Ohio law?

Not a lawyer, but here are some statutes that I found searching the ORC:

955.28(B)--Owner liable for damages
955.22(C)(2)--Dog must be under reasonable control of some person
955.99(E)(1)--Penalties

If your friend really has no assets, then the ol' saying about getting blood from a turnip comes to mind...

What is the evidence that the dog bit her?



Wow I just spent the last bit researching this, the average payout for a dog bite its $26k.



I wonder how many times she has been bit and sued somebody?



And whats to say she didn't provoke the dog to get bit?

That's how you file civil stuff in Ohio. You can only say "in excess of $25,000" but you can't say the real number.
